Below is a summary of the rip off that 6801 Shore Road, their board president, and their managment company (Metro Managment) specifically Judy Rivera committed against me and my fiance. Basic explanation is first then full letter that was sent to them as a attempt to save the deal. They still have not responded.

 

 

  1. 1.    The Application to purchase shares in 6801 Shore Road does not have an income requirement listed anywhere. The standard coop income requirement in Manhattan states that the yearly cost can be no greater than 25% of the applicants combined yearly income. This is why I was so surprised considering that it is only 20% of our combined income, a very substantial difference. If there was an income requirement that we did not meet, months of wasted time and thousands of non-refundable dollars could have been avoided.
  2. Metro Management failed to disclose paperwork about pending lawsuits on the building, of which there are 2. Fanny May, which makes up for most lender guidelines, will not process a mortgage for a coop, which has pending lawsuits. Our mortgage which we were approved for and paid to lock in the rate was declined because of this information, which was withheld until the day that Metro Management cashed out Credit and Background check as well as the Non-Refundable Application Fee.
  3. Metro Management was completely unprofessional when dealing with me. In addition, the discriminatory remarks they made to me are completely unacceptable and quite honestly against the law. At no point, were we informed there was an “age” requirement to purchase an apartment.

Considering that we are the third applicant to be denied for Unit 5B, I feel that there should be some changes made to this application. This would greatly help your buildings share holders. It will also help other potential applicants to avoid a true waste of thousands of dollars and months of lost time. Not to mention that the application took over 40 hours to compile.

Good Morning Jodie,

 

Mary Smith (my fiancé) and I recently applied to become residents of 6801 Shore Road (Apartment 5B), and we were denied this past week. I feel that it is very unfortunate that we were not given the opportunity to speak with you and the board prior to our denial, as we would have made great neighbors and would have done everything in our power to be an asset to the building. While we are both very upset about the decision, I felt I would like to share with you a little bit about Mary and I.

 I have lived in Bay Ridge my entire life, and my family and I have always held 6801 Shore Road as one of the top coop buildings in Bay Ridge. My Grandmother, who just celebrated her 90th birthday, and is on the board of the Bay Ridge chapter of the AARP, talks about watching the building being built with my late Grandfather. At the time, they lived on 69th and Shore Road. She was very excited that we were purchasing an apartment in such a highly esteemed building.

 I am a 3rd generation Eagle Scout, a title that my family and I take very seriously. Being involved in our community is something that is of the upmost importance to my family. My Grandfather, is a retired police officer, and is the President and Founder of the 5th Avenue Business Improvement District. The 5th Avenue BID is crucial to Bay Ridge sustaining as a thriving community. My Father Jim Clark, is a leader in Troop 310 my Boy Scout Troop, as well as the Director of Communications for Metro North Railroad. My Mother is a very successful businesswoman, and has always been active as a Girl Scout Leader, and was the Vice President of the Home School Association at Saint Anselm’s School for several years (my two sisters and I are alumni). My family has taught me that through hard work, and dedication to community you can accomplish any dream that you have.

I had the opportunity to become immersed in wedding photography at 14 years of age through one of my Uncles. It became my dream to one day own a thriving Event Photography Business. After attending FIT and working as an apprentice for many mentors in the industry, I purchased **** Photography, a company that is now 25 years old, 3 years ago. While we have been reinvesting in the company and our growth, we are producing over $700,000.00 in sales yearly, and are on track to break $1 million in sales for this coming year (2016). I am truly making my living, my passion. In our application, our business accountant included a letter explaining our growth projections. We are completely booked for 2016, and have substantial bookings and corporate photography contracts through 2018. I learned a crucial lesson at a young age, that when you do anything you must do it to the greatest of your ability; people can feel your passion for quality.

My fiancé Mary Smith and I have been together for over 8 years (yes, a long time)! She recently graduated with her Masters Degree from Adelphi University in Speech Language Pathology this past year. Because of her hard work and many internships, she was immediately hired by the DOE as a full time Speech Language Pathologist. Mary is running the department at PS 124 in South Park Slope and has two SLPs working under her; I know she is very impressive.

I like to commit to great things, which is why I am writing this to you. I consider 6801 Shore Road to be a GREAT building. With any great business I know that you must have a level of standards that you adhere to. While I have no expectations from this email, I feel that as the president of the building you should be aware of the process that we went through and things that could benefit from restructuring for your future prospective buyers, as well as your shareholders who are selling their unit.

Our offer was accepted in late November of 2015, after we were approved for our mortgage. After working with our attorney and signing the necessary paperwork we left the 10% escrow deposit. From here, we supplied the mortgage company with all of the paperwork required to finalize the mortgage. We began building our board application as well. In mid-January we were informed that we were completely approved for the mortgage and that the lender was waiting for some documents from Metro Management, which were delaying the entire process. Upon completing our board application with the help of Nick Serrano, the seller’s real estate broker, and the Petit team, our broker, we were ready to submit the application. About a week later we were informed that the application had changed and that we needed to build a new application complete with 36 months of bank statements. While this sounds like a lot, we put together our application into a 6-inch binder (in triplicate) to be ready for our interview, we were understandably very excited as well!

 The last piece of information that was required was the lenders finalized agreement. This is a document that could not be completed because Metro Management was still withholding some paperwork (paperwork about any pending lawsuits). After a month of more delays I personally contacted Judy at Metro Management and was told that we could submit the application prior to the documentation being provided because the building is very secure and would be approved by our lender.  We submitted our application on Monday, February 22nd to Metro Management; this was a very exciting step.  On Wednesday, February 24th, we received a call from Judy asking for income verification from my business accountant about the net worth of the company and stating that last years $45,000 income would sustain. We were also requested to provide further verification that Mary is being paid $54,000.00 yearly by the DOE. We got the paperwork together from my business accountant and from the DOE immediately. I arranged to meet Judy at 6801 Shore Road on Friday, February 26th with the paperwork. Upon arrival at the building to deliver the paperwork in triplicate, we were told by Judy that we were denied for not meeting the income requirements. Upon asking what the income requirements are I was told that she does not need to disclose that to me. I was also informed that we are young and that was the reason for our denial. I inquired about our application and was informed that the board never received it and that she has the authority to make the decision on the board’s behalf.

 

            Every business has unique policies and strategies, which are vital to continue their growth, and to keep the quality of the business where it is. I can fully appreciate that. Below are the short comings with the current application process that as the president you should be aware of.
