ACA International is a trade association of some 5,000 debt collection agencies and other debt collectors purporting to have a Code of Ethics and provides a complaint process to self police the debt collection industry. In effect the process is a sham to prevent further governmental regulation of the debt collection industry.


An Ethics Committee rules on complaints. However, membership of the Ethics Committee is kept secret, as is the membership of the Board of Directors of ACA Inteernational.


If a legal case has already been filed the complaint process cannot be used.


The first complaint I filed alleging violations of the Fair Debt Collection Practices Act of 1977 (FDCPA) was dismissed because the action of the debt collection agency was "not intentional." The FDCPA does not require violations of it to be intentional because otherwise it would be impossible to prove any violation.


One can apply for a "reconsideration," and all of my requests for "reconsideration" have resulted in the first decision being affirmed.


When I requested a written copy of the decision of the Ethics Committee giving the reasons for the affirmation I was told written opinions were not issued. An appeal can be made to have outside independent counsel appointed, but how can one appeal from a decision that one is never given?


Do not waste your time following ACA International's complaint process - it is all a sham.


As part of the complaint process a representative of the Ethics Committee telephones you and a conversation is required. In my case the representative calling breached my privacy and the person I share my home with learned I had made a complaint and I had to reveal I was having a complaint with a collection agency! As it happens, that representative - an attorney - had been given an award by ACA International and the Association of Privacy Professionals, Portland, Maine!
