I have received two different collections letters from AFNI. One for Cingular and one from Sprint. I have requested in letter form, with certified return receipt, that they validate the debt they say I owe. I have since sent two letters per each collection letter since September 2007. They have responded to my validation request by sending my letters stating I must give them copies of my drivers license, ss#, utility bill, lease/mortgage paperwork. They state they do not have ample information to confirm the debts and once they receive this information from me, they can conclude their investigation. Are they crazy!

Sounds like identity scam to me! By law, they are suppose to validate the debt if you reuest them to and they have 30 days to comply. They amounts are outlandish. AFNI-Cingular has filed collections for $1124.00 and AFNI-Sprint has filed for $682.00. They have not validated these debts and they continue to pursue collection activity via phone and listing with all 3 Credit Bureaus.

There needs to be a Class Action Suit filed against this company. They should not be able to get away with violating the FCRA they way they do. I plan on filing a small claims case in Houston and let's see if they respond then. They are currently hurting my FICO score!

FAQ: What to do when AFNI has placed a bogus negative entry on your credit files for a debt that you do not owe:


Send a letter to all three credit bureaus (preferably Registered Mail with Return Receipt) with the following request:

I do not recognized this alleged debt. Per the Fair Credit Reporting Act I am requesting that you validate this alleged debt.

To speed things up, include a photocopy of your driver's license and social security card with each letter. If you don't include these items, the credit bureaus may write back and request this information, delaying your request by around a month

Under normal circumstances the credit bureaus should remove the negative notations. If they don't and write back that the debt has been validated, you have a fight on your hands.

If AFNI has placed bogus negative information on your credit files and one (or all) credit bureaus have come back claiming that this alleged debt has been validated as legitimate, you should:

#1) Send a Registered Mail with Return Receipt directly to AFNI, stating the following:

This debt is not mine and AFNI is in violation of the Fair Credit Reporting Act in reporting erroneous negative information to the credit bureaus that I owe this debt. If this erroneous entry is not removed from my credit file within thirty days, I plan to file official charges against AFNI with the Illinois Attorney General [note: AFNI is located in Illinois, so complaints would be filed in Illinois] as well as take other actions per my rights under the Fair Credit Reporting Act

#2) Send a Registered Letter with Return Receipt to any (all) credit bureaus still reporting this bogus negative information with the following request:

Your firm is in error in reporting this erroneous negative entry for this alleged debt from AFNI. I am officially requesting the written communication between your firm and AFNI that led to validation of alleged debt. If the response to this request is a form letter stating that this is a "frivolous" request, this refusal to provide any evidence for this alleged debt will be documented for evidence of Fair Credit Reporting Act violations.

#3) Keep your fingers crossed and hope this works. If the negative information is STILL on your credit files after these efforts, it's time to see an attorney who specializes in Fair Credit Reporting Act violations.
