I refined my mortgage with Argent Mortgage co in November 2005 with promises of a better deal. after a short period of of time, I was notified that6 my mortgage was being transfered to AMC Mortage co. this went along fine until i received a letter from them stating I was behuind in payments. after reviewing all my prevoious bank statements, i sent a letter off to the mortgage company explaining the error on their part and provided proff of payments. i continued to receive letters from the company stating that i was still behind on payments and that foreclosure procedures was in the process.

i immediately contacted an attorney and filed chapter 13 bankrupcy to avoid losing my home. after appearing in court and being ordered an court order to pay for supposely missed payments, the company accepted only two of the court payments . at this time AMC mortgage refused to accept payments on the loan saying I was in default. after several attempts to reach the company via phone, email and their attorney to no avail. i received a letter from AMC mortgage that my loan was being transfered to Citi Residental Lending and they had also filed foreclosure proceeding against the property.

after trying to reach the new company via phone. by the way turned out to be number for previous company. i tried to mail the mortgage payments to citiresidential leading only to have them returned as "currently on a Home Retention Group Plan and this is not the agreed amount according to the plan". they left a phone number to call. but if you call the number either the person who answers the phone can't help you or you only get voice mail to leave a message where noone ever returns the phone calls.

i received an another notice that my home was going to foreclosure again. by the time the letter was received at my home address. i had less than a week to try a block the pending sale of the home.

we have gone to court over this issue and the judge sided with the lawyer for the mortgage company. currently i'm appealing the decision, but according to the judge the home has been sold and ratified through the court system. at the present time, i'm in the process of moving and trying to clear the bad reputation these companies have given my name let alone missed up my credit.

Loan Modification Relief/Citiresidential Lending

Whew! Is all I can say. I have been trying to obtain a loan modification agreement with citiresidential for over a year. I fell behind in May 2007 and have just received and overnighted an agreement I can live with which has brought all of my late payments current. It was a long and difficult process. I didn't know much about loan modifications and did not realize how much it could change my credit and pending foreclosure. I have felt like as if I were being held hostage. I urge others who are in this position to get a service or an attorney to help you through this process. I cannot tell you how many documents I have faxed and refaxed to document my financial situation not to mention the many phone calls and messages left. But DO call and call and call. The best advice I can give is to get unlimited calling on your cell phone. I think my persistence and seriousness about keeping my home, complying with sending and resending and resending requested documents, patient tone and some help from up above allowed me to receive this modification and to finally move on with my life. I wish you luck in your endeavors.

My Comment on AMC/Citi Residential

I am going through a similar situation with AMC/Citi Residential

I missed a couple of payments back in March of 2007. At the time the mortgage was not Citi Residential but AMC mortgage. I was given a forbearance agreement for 4 months and inform that if I pay on time I would be eligible for a loan modification. The forbearance agreement was for April July in august I could apply for loan modification. I paid forbearance payments on time. After I made my last forbearance payment in July. I contacted AMC Mortgage to apply for loan modification.

The representative that I was working with me left a message twice a day. I did not get a response until the 2nd week in August. The representative wanted to know how much money that I could put down. I informed representative that I could put down $2500 or $3000.00. The representative said that she would put request in.

I did not need at this time to send in updated information my check stub, bank statements, hardship letter were already on file. A week past since I spoke with representative and no return call. I call representative for about 2 weeks and finally I got a response that my request was turned down. Representative asked if I could put down more money. I said I could probably come up with $5000.00. Representative said fine she will put in request and paper work will be sent out to me by August 29, 2007.


August 28, 2007 came I did not receive modification agreement. I continue to call got voicemail. A few weeks into September I got a letter that AMC Mortgage Company was change to Citi Financial. Since I did not hear anything from AMC mortgage I sent in a mortgage payment. Within a few weeks that payment was return with a letter stating that payment could not be accepted because there was not an agreement on file.

A week later I received a call from Citi Financial that I they would like to work with me and put me in a modification plan with a payment that I can afford. I was informed that paper work would be sent out and instructions on what I would need to send in to process agreement. I received paper work 2 weeks later 1st week of October. The letter stated that once documentation is received it can take 4 to 6 weeks for processing.

I faxed and mail necessary documents the next day. 4 weeks past I did not hear anything I called informed still in process. In the mean time I cannot send a payment in and interest and fees are building up. Finally the week before thanksgiving I received a call from the representative working on my loan modification that he needed updated information new pay stubs, bank statement. Fax needed information. I call Representative every day checking on status, answered would always be in progress.

Since I had a good repore with representative and was always able to speak or if left message would receive a call back within a day. I felt that maybe I would get some results soon and be able to modify loan and get back on track. December came and I receive a letter from Citi Finanancial that my mortgage in process of foreclosure. I immediately contacted City Residential to find out what is going on. I was informed by representative that is the procedure that my modification should be approving soon. Finally, I am tired of waiting so I contacted an attorney. I was advised of my option.

I informed attorney I want to wait until I hear from Mortgage Company. By the end of December I received a notice for Sheriff Sale with a date of 2/20/2008. The Last week of January I get a call from Citi Residential that my modification was approved. I will be receiving documents, my interest rate was going to be lover for 7 years and then my rate would go back to the current rate. I would need to send in my down payment of $3500.00 by February 15th and send in notarize documents back to Citi Financial. I received the documents February 1, and the mortgage payment was 1585.00 for 7years. My original mortgage was 1253.00 I called Citi Residential and asked why is the payment going up $332.00 I was informed that the missed payment would be put into the loan and interest would be lower and my payments would be lower. The only resolution was that I would have to accept the payment.

I could not afford to have an increase in mortgage payment so I sought the advice of an attorney. The attorney advised me to file a chapter 13 to get back on track. That was done. I had to pay the attorney $2000.00 my mortgage payment was to remain the same and I would have to pay $650.00 monthly to bankruptcy trustee. I agreed because I wanted to keep my home. I do not have a lot of bills just car note 2 student loans no credit card debt.

I am thinking $1253.00 for mortgage plus $650.00. The payment of $1903.00 is steep but if it would save my home I was willing to do it. The chapter 13 was filed in 2/20/2008 I appeared at a court meeting 3/24/2008. I start paying my mortgage payment I sent off 3/29/2008 and my 1st payment for bankruptcy 3/29/2008 and every month up July I was making my payments I received a letter from Citi Residential in July that I was 2 months behind in mortgage and that Citi Mortgage is in process of getting an order to lift automatic state.

I immediately contact my attorney and was advised to get copies of cancel checks for mortgage payments. My April and May mortgage payment was cashed my June and July payment was not cash and was return to my attorney a few days after I had contacted my attorney. I contacted Citi Residential and was told that I have and escrow deficiency and my escrow was short of over $4000.00 $312.00 would be added to mortgage payment until the end of the year. The the deficiency balance was added to mortgage making mortgage payment $1565.00 monthly.

So, when I sent in my mortgage payment of $1253.00 it was short by $312.00 so it's like I was not making a full payment. I asked why I was not sent any information in reference to change I was informed that since I was in bankruptcy no correspondence would be sent. This did not make any sence to me.

I spoke with my attorney and they were never notified by Citi Financial attorney that my payment would change. I argue that if this was the case that my payment would go up why this would not be included in bankruptcy plan, Citi Financial and their attorney had to sign off on terms and conditions the paper work contain my balance and monthly payment. Why was this issue not addressing then. I only went by what papers were approved by court.

At this stage I have had enough. I am now giving up on keeping my home. I have paid my last mortgage payment in July. I informed my attorney of my decision my mortgage payments are in suspense until a balance of $2100.00 paid and thereafter mortgage payment $1565.00. I was informed by attorney if I did not pay $2100.00 by 7/28/2008 3 of my mortgage payments will be returned.

I am in the process of finding an apartment that is cheaper. I understand that for number of years I will have a blemish on my credit rating and I will have to work triple hard to get it fixed. This experience has truly been overwhelming I am just glad it will be over soon and I can move on with my life.

I say to you Beth and many others in our similar situations, fight until the end and when there is no more fight left in you, let it go. It is not worth the stress. It might take time to rebuild but you will be able to get another home. Think of this housing crisis as a valuable lesson. I know it will never happen to me again.
