ASSET ACCEPTANCE I HAD DISPUTED TNIS ACCOUNT ON MY CREDIT REPORT. IT WAS THAN REMOVED. ASSET ACCEPTANCE HAD THEN FILLED WITH THE COURT TO HAVE THEM MAKE ME MAKE PAYMENTS.I TRIED TO APPEAL THIS WITH THE COURT, BUT THE CLARK TOLD ME IT WAS TO LATE TO FILE WARREN Michigan

Asset Acceptance had brought my account from Bellys Fitness which i didn't know anything about it. I had closed this account with belly's three days after i had open it. Years later here comes Asset Acceptance Credit. By the way i disputed this account which was removed from my credit report. Asset than had file with the court. i tried to appeal this but the clark said it was to late. I did't know anything about this until it was late.

Now that this company have this account i now have topayfor something i didn't use. i never work out at Belly's. Asset had add a high interesr rate on this account which total $3,900. I shouldn't have to pay for this if i close it with the company and disputed it on my credit report.

Learn how to spell
Number 2 - Asset Acceptance is a third party debt collector - I have dealt with them in the past - they purchase old debts then try to renew them
DO NOT TALK TO THEM ON THE PHONE!!
go to www.budhibbs.com and learn your options on how to deal with these bottom feeders
Did they sue you? Did you get a subpoena delivered to you by a process server??
If not, then you need an attorney and there are plenty of attorneys who would love to sue the crap outta this bottom feeders

Some things to check..

Do you have proof that you cancelled the Bally's contract correctly. Usually these contracts are written in such a way that cancellation is impossible. It does not matter if you never used it you still owe the money. Not knowing how you had it removed from your credit report I will focus on the suit.

For the lawsuit were you served(notified). If you were and just ignored it the clerk was correct you are basically SOL. If you were never notified of the suit(which with Asset Acceptance would not be out of the question). You can request all the court documents on the suit including the "Proof of Service". If you were not properly served you need to file a Motion to Vacate the judgment. This is not the same as an appeal. The clerk should be able to help you in filing this, if not it may be worth a couple hundered dollars and talk to an attorney.

Now, if the motion is granted the suit may not go away. Asset Acceptance can re-file and have it heard again. But at that time you can put out a proper defense such as you did cancel, or they are beyond the Statute of Limitations(the period they had to sue). The best case is that if you can prove that Asset Acceptance lied about proper service you can go after them for damages. A common thing to this is that they may have served you at an address you never lived at or lived at years before and they knew what your current address was.
