Beware of the Lie.
I am a disabled individual who lives 32 miles to the nearest hospital. I have to be able to contact people in the event of an emergency. The FIRST question I always ask when looking for cellular service is " Does your company have service in my area"?
I asked that of my sales person and was reassured that there was service available to where I live. Then they proceeded to sign me into a two year contract which has a $200.00+ cancellation fee. I was a dead duck....

I can get a dial tone if I stand in a certain direction in my backyard. If a call goes through, it usually gets cut-off. If I turn my head while talking, I lose the call.
My friends and children who live out of state will not call me on my cell phone as they never get to complete a call because of dropped call syndrome.
I have repeatedly called to see if I can have this problem resolved. I am told that the company knows about this "dead" area and is working on the problem. Meanwhile I have to pay a monthly bill of around $80.00 for a phone I cannot use, and don't have $200.00 to cancel the service that was misrepresented to me.

I would send the certified return receipt requested letter address to Mr. McDonald asking him to intervene to allow you to cancel the service and return the cellphone without penalty because of the misrepresentation of the sales associate.

Talking on the phone usually isn't a good idea. Employees can tell you anything and then later claim that they didn't say something or the classic "you misunderstood" what they said.

Also, I would NOT USE the phone. Remember, your position is that you can't use it - so don't! You don't need a phone history that shows you using the phone tither and yon.

If this fails to resolve the matter, it seems to me you have a good small claims case. It's a simple matter to establish witnesses that the phone service is inadequate at your residence. Time is of the essence here. You should get that letter off PRONTO! I would send it priority mail, certified, return receipt requested.

I don't normally recommend any particular cellphone service, but Verizon does give you 14 days to "try it out" before you're locked into the contract. You have 14 days to cancell the service and return the phone. Since it appears you live in a fringe coverage area, this might be a more practical approach for you.

Be aware that it is possible that there is NO RELIABLE cellphone service at your home, but at least with Verizon you won't be out any money or pay any penalty if it doesn't work out for you.

I see two answers to my complaint and need to repond to them.

I have repetedly tried to contact someone of authority at alltell. There is no way anyone will get any information or name of a official. You will only be able to talk to a customer service nobody, who will never be able to help you for anything.

To the 2nd responder in WV.
I live in a desert area. No holes here. Elevation 1,800' and no basements.
I *paid* $145.00 cash money for my phone! I picked the expensive one hoping it would be more capable. When I complained about the dropped calls or the no service message, I was told that I could purchase a "booster antenna" for my car which cost around $200.00 more !!!
When I mentioned the town where I lived, I was told, "we know about your area, and are working to fix the problem". That does me absolutely no good. What they need to do is build or rent a tower. Something they are not going to do. We have "local" phone companys that have towers but they do not service any more than a few local countys. So there are towers available. Alltell just does not care....

I have had alltel for 7 years and have never had any trouble whatsoever and they have always been polite and helpful if I had any questions. Just some info for you..... the 200.00 cancellation fee is because when you signed a contract, your phone had a 200.00 discount on it, if you would have paid full price for it, you would not have had to sign a contract...... if you got it for 50.00, you could have paid 250.00 and had no contract but most people opt to sign a contract. The location that you have a dead zone in can be fixed...... first off, you have a 14 day trial period and you can return the phone and get out of contract, secondly, there are towers all around my town but I do not get service in my basement or even the mall where an alltel kiosk is located..... alltel doesn't go out to your house and make sure you don't live in a hole, they go to various locations when a new tower is up and calculate coverage from it's most distant points. They don't go into work areas, people's homes or valleys and make sure they put a spec of no service on your home or job....... that is why you have your contract grace period. If you can go out on your backyard and get a signal, they didn't mislead you at all, they knew service was provided in your area. Honestly, I believe you hav no leg to stand on in this battle, you signed a contract and it is past your grace period, service or no service.

Failing that, I would send them a certified, return receipt requested letter to corporate HQ stating that the service was misrepresented to you and you therefore would like the service terminated immediately with no penalty to you.

IF they insist on the fee after that, you could try going to small claims court for misrepresentation (fraud.)
