My roommate started using Alltel on Dec. 26, 2005 under a two-year contract. Out of his own kindness he added a second phone line for me back in July of this year (2007).

Marcus' contract was due to end on 12/26/07. I was added as an authorized user on the account. I remember speaking with a representative from Alltel's retention department stating that we would NOT have to pay an early termination fee. We have been getting the run around. One rep would say yes we would have to pay $200 for early termination, but I asked this rep to carefully notate the account because when we cancel this account we do not want to have to run into any problems.

The rep states he notated the account. Well, today when Marcus canceled the account he was told he would be slapped with the $200 early termination fee. He did not wish to argue with them.

I called them at about 5 pm this evening and spoke with an upper supervisor who stated he never 'saw' where I spoke with anyone in that department, nor did he see any notations on the account that the fee would not be charged. The supervisor would not give way, saying there is a provision in the contract that states if we add another line that it would make the contract be extended for two years FROM WHEN the second phone was added. I was looking over the contract and didn't see anything of that nature.

I feel they are liars and cheat people. I was lied to by one of their incompetent reps and their management was not going to sway at all. They clearly wronged us and I want everyone to know about it, and if I could get legal action somehow, I would certainly fight them legally. They are crooks.

Alltel did not rip you off. The Postmaster will state it was not mail fraud.

Why do I say this??

When you do a new line of activation or an upgrade, the first bill you get after that will state something to the effect of thanking you for signing up for X amount of months and at the end of the bill is a copy of the terms & conditions.

I know. I got this when I added my parents to my account as well as upgraded my phone.

I guess I just read my bills to good.

Bad advice

A note of caution: cell services are not done with a "contract" but a service agreement, meaning you agree to the terms and conditions. You do not have to sign anything. Making payments also states you agree to abide by those terms and conditions.

Nothing here was wrong - the OP is just mad because they have to pay a very correct $200 ETF.

Trust me, reps have told me one thing then another. Noting an account? I've called an hour apart and no notes from the previous moron, er, rep.

Your situation: did you sign a contract for that 2nd phone? If not, they simply can't enforce it. So, go to the store and see the manager and threaten a mail fraud complaint (USPS.gov). Yes, if your bill comes through the mail or your expect it to, the USPS Inspector HAS to investigate it. The salesperson can even be prosecuted (mail fraud is 5 years mandatory and/or a $5,000 per occurrence). C.C. your U.S. Senator on the mail fraud complaint. A complaint takes about 30-90 days to complete.

Filing a mail fraud complaint against any company that sends you a bill is one of the best ways to nail them. They don't like, basically a federal officer--postal inspectors are federal law enforcement, asking lots of questions.

How were they misinformed? They had to sign the contract, therefore, it's all in writting, infront of them, before they sign.

I have to say that you should have been told when you added a second line that you would have a 2 yr contract for the second line. If you purchased the phone at the sale price you will get contract. Only the primary line's contract expired in December. So I have to say that you were not ripped off just misinformed.

If you added a second line to the account then that is the line that is placed under the NEW 2 year contract, the original line is not affected by this secondary line. However if you performed a phone upgrade on the initial phone line then that would extend that contract for another 2 years from the date of upgrade.
