AMERICAS SERVICING COMPANY WILL NOT HELP THEIR MORTGAGE HOLDERS!
A record of the three Letter Code names, dates and times all documented through this following process:
2/21/09 contacted ACS to see about getting a loan motification. My credit was perfect at this point with no late payments, etc. was told there was nothing available. Maybe when I am late on a payment I could get some help but she wasn't sure.
called a couple of days later and spoke with rep. who answered phone stated there is no such mod department. I asked to speak to anyone who might be able to help me with payment modifications or anything. I was put on hold for many minutes and finally the rep. gave me info on what to fill out. wanted financial info specifics, dept, stubs,w2 etc.
I was told that I could fill out and fax a request for help and was given the info on what I needed to put down on the paper for the request for help, which I did. I was told I would need to wait for a return phone call. with regards to my upcoming payment the rep told me I would need to wait and speak with the person who would be assigned to my case. this could take up to 60 days but was not sure...
3/1/09 I waited about a week and with no reply I called back again. I did this over and over and over. Finally I was told there was no record of my fax being recieved. I was very frustrated so I refaxed as per rep. I was told to wait again and I would be contacted. I called back many times over many weeks only to be told yes we have your paperwork but we will have to get back in touch with you. I said well I need help in my upcoming payments because I simply do not have the money, my pay has been cut in 1/2. I was assured someone would contact me and it could be another 30 to 60 days...
a few weeks went buy after calling every few days just to keep in touch I was finally transfered to someone in there loan department (they then called it a loan mod dept, thought they didnt have one...) THis gentlemen said everything looks good, just need to wait and they would be in touch.
I waited a couple more weeks. Finally I called back and got someone on the phone who told me I would yet again need to refax the info I sent because it did not have my signature. I informed the rep that I asked the original rep to tell me EVERYTHING that was needed on the fax and I was told step by step yet NOTHING was stated about a signature... I think this was a total stall tactic. WHy was I not told about the signature by several other reps earlier? To this question I was told "I DONT KNOW". Months have gone by and I waited and waited for a phone call but never got one. Finally months later after numerous phone calls of being told to wait I received a letter stating my request has been denied because of my income.
I finally was sent a letter asking for all of the past payments to be made current!!! I then received a phone call from their collection rep who informed me after a discussion on this whole mess that he would send out YET ANOTHER SET OF DOCUMENTS so that I could fill them out and fax them back. After our conversation I never received said forms and only received notice that my loan is going into foreclosure.
This is where I now stand on a home by the way where the value has fallen 50%!!!
What in the HELL is going on with these companies that operate this way!!??!!
I NEVER signed a contract with ASC, my loan was sold to these inept unprofessional and UNORGANIZED children!!
Get this.... Read about my problems with my 2nd.... with CITI Mortgage.... its worse than this!!!!!
I would be glad to receive help from any attorney or any source out there and I hope that ANYONE who would consider a loan from ACS and/or their parent company Wells Fargo will find this post helpful. My wife and I will become homeless in the next couple of months.... American Dream becomes an AMERICAN NIGHTMARE........ 9/13/09
