AMERICAS SERVICING COMPANY IS NOT A LEGAL ENTITY. It was a dba - that is doing business as Norwest Mortgage. America's Servicing Company (a fictitious name for Norwest Mortgage) in 1999.
Norwest purchased the Wells Fargo logo and changed Norwest Mortgage to Wells Fargo Home Mortgage, Inc. which is a wholly-owned subsidiary of Wells Fargo Bank NA.
Wells Fargo Home Mortgage, Inc. legally registered in 2000 Domestic for Profit Corporation in CA. And other states Wells Fargo Bank NA registered Wells Fargo Home Mortgage, Inc. as a Foreign for Profit Corporation. Business continued as usual selling to consumer mortgages now using the Wells Fargo valuable logo.
Wells Fargo Home Mortgage, Inc. did not reregister the (trade name) dba Americas Servicing Company. I don't know if this is a legal issue but certainly these are facts.
Wells Fargo & Co/MN & Wells Fargo & Co & Wells Fargo Bank NA & WFC HOLDINGS CORP cooperatively engag in unlawful business acts and false claim actsand much more. Including and not limited to: Deceptive Adversting to influence consumer behavior, Antitrust violations restricting a free market selling loan originations of consumers only to Wells Fargo Preferred Vendors, and only to Wells Fargo Commercial Clients and only to Wells Fargo Subsidiaries and only cooperating with Investors who 'one hand wipes the other' launder in currency allowing for all consumer mortgages Wells Fargo Bank NA to be SERVICER of the asset-security (money laundering scheme) and pyramid schme (asset-debt) and Sarbanes-Oxley Act violations for accounting practices that will be revealed to show inflated treasury deposits.
For example one consumer mortgage mine. $440K appraisal. Greg Warhem sells us as a financial professional that the best use of our asset to pay down debt, to pay state, federal and municipal taxes, medical bills, and fix home repairs for two years in a fantastic market and to improve our credit would be to purchase the 80/20 Refinance Wells Fargo Mortgage package.
Wells Fargo Bank NA processed fraudulent loan origination documents on 6/5/2006 instructing the attorney WFHM Ajrona Leka (WFHM DIVISION) instructed Stephen R. Scipione Esq. on 5/30/06 that a closing would occur on 6/5/2006 and his staffer Debra Allegro and copied was Stephen R. Scipione instructing them to place on the Title Insurance 1st Mortgage $352K and 2nd Mortgage Star Mortgage Servcies $88K. Title Insurance in this case protects the LENDER and the consumer pays for the policy %$1,195 $352K and $895 $88K and so Wells Fargo Bank NAis protected against fraud (their own?)

If they are using on the internet the caption above that is to say Wells FArgo Home Mortgage, INc. dba Americas Servicing Company copyright 2010 is that a lye and unlawful business practices? and False Claim Acts ? and unlawfully engaging in intrastate and interstate commerce in all 50 states since Wells Fargo Bank NA by their own hand John Stumpof and Board of Directors had on the http://www.wellsfargo.com website thru early part of thrid week of January 2010 the America's Servicing Statement below.
See Wells Fargo's letter describing what Americas Servicing Company is (First it is a lie) and second Wells Fargo & Co, Wells Fargo Bank NA, Wells Fargo & Co/MN and WFC HOLDING CORP are intentionally misrepresenting and deceiving consuemrs that Wells Fargo Home Mortgage does sell consumer mortgages and they do not. Wells Fargo Bank NA only does loan originations and that is why they are the #1 Loan -#1 Servicer and in either market bull or bear make their money while Wells Fargo Commercial Clients wind up hurting and Wells Fargo Commercial Clients who purchase higher yielding consumer products get harmed and Attorney General Edmund Brown in CA received in a no-fault claim against Wells Fargo Securites LLC (a different one than that with the same name today) for $1.5 Billion dollars for intentionally misrepresenting to consumers what the product was and a woman with Lung Cancer needed her money and found out the sales person from Wells Fargo (pattern and practice) LIED and she could not get her money in a week.
The $1.5 Billion payment did not hurt Wells Fargo who sold stock in the summer and got exactly $1.5 Billion - a wash. But luckily Attorney General Brown won the case and helped all of those consumers and the state of California.

This is to inform you on this date, the Office fo the Comptroller of the Currency (OCC) approved the application to merge Wells Fargo Home Mortgage, Inc., Des Moines, Iowa, into and under the charter and title of Wells Fargo Bank, National Association, San Francisco, California. Wells Fargo Home Mortgage, Inc. is a direct wholly-owned operating subsidiary of the Bank.
This approval was granted based on a thorough review of all information available, including commitments and represenations made in the application and those of Wells Fargo & Company's representatives.
As a reminder, this Office must be advised in writing in advance of the desired effective date for the merger so that the OCC may issue the necessary certification letter. The merger may be consummated on or after the date of this letter subject to the Bank having first received all other required regulatory approvals. If the merger transaction is not consummated within one year from the approval date, the approval shall automatically terminate, unless the OCC grants an extension of the time period.
The OCC will issue a letter certifying consumation of the transaction when we have received:
1. A Secretary's Certificate for each entity, certifying that a majority of the board of directors approved the transactions, and
2. An executed Agreement and Plan of Merger.

Pursuant to conversion with Jennie Crawford, Des Moines, Iowa refers to the locale of an office and Wells Fargo Home Mortgage Inc is a California corporation and the one involved is the attached merger.
I am a consumer WHO PURCHASED MORTGAGE PRODUCT(S) FROM Wells Fargo Home Mortgage and by express and implied acts the salesman was an agen t selling me a contracted product of Wells Fargo Bank NA.
Greg Wareham is an employee acting as an agent and acting as a financial professional. But upon investigation the Wells Fargo Home Mortgage employees have an unfair competitive advantage for they are not licensed.
Now some states changed the rules and in GA July 1, 2006 others could be the financial professionals.
I don't know what the NJ rules were on June 5, 2006. I don't know what the rules were in MN when the 'closer on 6/5/2006' did the closing. I don't know that the rules are in TN when the transactions were processed between an alleged closing or was there a real closing? For why was Star Mortgage Services used? The entity did not exist in NJ. I cannot find a trade name. There is a UCC document in NJ. There are Star Mortgage, Inc. in MD SOS. and other states.
The NJ Department of Banking and Insurance had on record for a Star Mortgage Services (dissolved in 2003) a phone # and that Phone Number linked to Atlantic Home Loans, Inc. And that Phone # is the same on the fax sent from a company purporting to be WFHM, Perth Amboy. And Perth Amboy is the address of Atlantic Home Loans, Inc. And Atlantic Home Loans, Inc. is in many states. And I don't know but I bet at the time was a Wells FArgo Commercial Client, perhaps a Wells Fargo Preferred Vendor. Perhaps a Wells Fargo Commercial Investor.
Employee letters multiple from Bonnie Schooler and Janice Turner replying lies and they are in collusion and make statements on Behalf of John Stumpf lying. For example, Bonnie Schooler who works for WFHM Division since 8/8/08 stated that the loan origination was fine for our closing.
In writing to serious allegations I intentionally recorded on the BBB which are moved from NJ Trenton BBB to Des Moines Wells Fargo Home Mortgage an unlicensed entity in Iowa engaging in intrastate and interstate commerce as who?

who worked at the time in Parsippany NJ and reported to Sales Manager John Nelson at WFHM 15 Commerce Blvd, Suite 302, Succasunna, NJ. Ajrona Leka (Admin) and Sales Associate assisted Greg Wareham who sold us 80/20 REFINANCE. Ajrona Leka processed documents 5/4/2006 through 6/5/2006 in which she instructed the Wells Fargo Bank NA Attorney Stephen R. Scipione Esq. to 1) place the Title adding Star Mortgage Services for $88K for the closing to occur Friday (6/5/2006) and 2) WFHM fax sent to homeowners insurance company by fax from Atlantic Home Loans, Inc. phone# and address instructing Weichert Insurance to add to the FMI homeowners policy a 2nd mortgage for Star Mortgage Services for $67.5K.
I was privledged to secure copies of pre-loan origination documents from the very attorney who did the closings for Wells Fargo Home Mortgage now listed as defendant in the Compliant for Foreclosure (HOW they were not a company) they are not a legal entity at thetime of sale nor was Americas Servicing Company, nor is Star Mortgage Services, nor was the fictitous PO BOX in Kennesaw GA. Structured Asset Funding Co (MD) and its fictitous name Capital Home Mortgage MD.
Wells Fargo Bank NA LENDER benefitted from the loan origiantion fraud and that is why John Stumpf who was given on 1/20/2009 copies of the loan origination fraud documents that clearly show a fraudulent closing occured 6/5/2006 (afterall I was not there and did not sign nor did I agree to the extra 5% in fees added onto the closing 3 closings in which Greg Wareham, Stephen Scipione, Mark Delaney Notary, Closer, Agent for Stephen Scipione Esq. brought to us 6/7/2006 mortgage and loan documents we saw for the very first time. We did not know Wells Fargo Home Mortgage was not a legal business entity. We did not know that Wells Fargo did not do consume rmortgages. We did not know in secret covert operations that Wells Fargo sold our loan origiantion via a secret supply chain of Wells Fargo Preferred Vendors and only using Wells Fargo Commercial Clients and only Wells Fargo Subsidiaries and Wells Fargo Investors who concurrently placed currency into Wells Fargo Home Mortgage Institutional Lending for the asset-security side of the transactions depositing in Frederick MD funding from the 6/5/2006 transactions that Wells Fargo Bank NA Attorney Stephen Scipione Esq. faxed 6/5/2006 and Wells FArgo Bank NA/MN 2650 Wells Fargo Way, Minneapolis MN 'Closer' Jasmina Bevanda and her mortgage counselor 'Julie Sainio processed the closings including a thank you letter asking Stepohen Scipione Esq. to rate Julie Sainio's services.
The pre-loan origiantion documents clearly show intent to take properties by deception.
Futher, I've learned after May 2004 that all busienss was conducted by the legal entity Wells Fargo Bank NA dba Wells Fargo & Co of which none of the business entities are registered in NJ.
The Bad Faith and Wells FArgo & Co/MN Board of Directors trained the employees to use the supply chain they designed and sell to consumers one sales pitch and solict commercial business their primary job. IN fact the employees are required by job descriptions you can read on the internet to solicty professionals and to engage in community services in furtherance of business for Wells Fargo & CO/MN, Wells FArgo & Co., Wells Fargo Bank NA and WFC HOLDINGS CORP.
The bad faith includes the (intent to take property by deception) from consumers targetted and lied to or the legal term is deceived by deceptive advertising intended to influence consumer behavior.
Since Wells Fargo denies knowing anything about the mortgages on 6/7/2006 one of any sense would begin to realize the 6/5/2006 closing are normal business operations for Wells Fargo & Co, Wells Fargo & Co/MN and Wells Fargo Bank NA and WFC HOLDINGS CORP for on June 5, 2006 when loan origination fraud occured ( I know because I was not at the closing yet the documents were faxed with cut/pasted initials with a 6/5/2006 date and currency was funded 6/8/2006 and net funding deposited into the Wells FArgo Bank NA Attorney Account).
WELLS FARGO & CO, Wells FArgo & Co/MN, Wells FArgo Bank NA & WFC HOLDINGS CORP HAVE harmed all consumers in all states substantively and greivously harmed the nation domestically and internationally.

In a huge 50 state pyramid scheme Wells FArgo sold in secret the loan originations for a fee and in secret converted the assets into debt and the business was given only to Wells FArgo Preferred Vendors and Wells FArgo Subsidiaries and Wells FArgo Commercial Clients.
Simultaneously the same date 6/5/2006 money was laundered into Wells Fargo 'Treasury' one of the subsidiaries or one of the Wells FArgo Commercial Clients processing accounting transactions in which Wells Fargo Home Mortgage Instituional Lending funding was taken in for investor of asset-security Structured Asset Funding Co (MD corp) and dba fictitous name Capital Home Mortgage. All of this done with other illegal names like Star Mortgage Services (UCC Document on file in NJ) and Cordova TN appers to be where the transactions may have moved and a forensic audit by the OCC will reveal where and when and what and how and who and why is obvious.
The fact is all of this was not done to ONE CONSUMER rather to all CONSUMERS and every state harmed and involves HomeLand Security and violations against the Patriot Act HR3162 and Gramm-Leach-Bliley Act November 1999 in which the Attorney General does indeed have Jurisdication. If I understood the Gramm-Leach-Bliley Act Nov 1999 and FFEIC documents financial holding companies are required to change the organization every 10 years.

If you did not start with Wells FArgo but received a Complaint for Foreclosure and Wells Fargo Bank NA is the Plaintfiff and Wells FArgo Home Mortgage is the defendant polease know you too have been harmed by Wells FArgo.
Officially I entered into an agreement with John Stumpf 1/20/2009 when he accepted my valuable loan origiantion fraud evidence and agreed to perform a top/down investigation and Legal Services, Wells Fargo & Co/MN and Wells FArgo & Co & Wells FArgo Bank NA and WFC HOLDINGS assigned Bonnie Schooler WFHM division to investigate - she refused lied and processed instead of a HUD Loan Origiantion RESPA Investigation in which we would have been safe for 90 days while Wells Fargo investigated and then another six months while they investigated the loan origiantion fraud and they should have called in HUD to assist. Rather they just wanted to see the documents and make me go away.
God is blessing us and we are still hanging in here and I pray my Governor who has under Article II of the Constitution Executive Powers will authorize the Attorney General who does have Jurisdiction per the Gramm-Leach-Bliley Act November 1999 to present a case as Plaintiff v. Wells Fargo Bank NA, Wells Fargo & Co, Wells Fargo & Co/MN, WFC HOLDINGS CORP and prosecute to the fullest extent of the law and take back what the US Constitution gives uss our civil rights under the Fourteenth Amendment, Fifth Amendment and Eight Amendment and US Constitution the right to be safe in life and property, the right to liberty, the right to due process and due process and all protections of federal and state laws and US Constitution and State Constituion.
John Stumpf had he been an honest business man would have gladly performed a top/down investigation to stop loan origiantion fraud at the local level. But instead it is normal operations for Wells Fargo to place deceptive advertising into the public domain to influence consumer behavior and take our only asset and covert it to debt and at the time of sale indeed the manufacturer is responsible for selling what is a defective product at the time of sale which caused substantive and grevious harm.
I asked for only what was due 1/20/2009 consideration of the fraud which would have meant I was to be given back what I paid in and renegotiate the mortgage.
Since the property is underwater the mortgage companies do not want to do that because the 2nd mortgage can be stripped off as unsecured debt. I did not know that then.
When I gave John Stumpf the copies of the loan origiantion fraud he and many employees lied to coverup the normal operations and committed additional unlawful business acts including intent to take property by deception and more flase claim acts for the Complaint for Foreclosure and the Assignemtn of All These Good Men also are fraudlent.
John Stumpf, Wells Fargo & Co., Legal Services, Business Address, 420 Montgomery Street, accepted the copies and we are in agreement he disregarded and ignored his Due Duty, Duty of Loyalty, Duty of Obligation to the Shareholders and by not performing a top/down investigation into local WFHM storefront loan origiantion fraud revealed by his own hand and his own employees validation John Stumpf and Mary Coffin indeed knew about the facts of the matter they revealed the internal operations and what is done and how they harm consumers and lie.
Consumer must unite and share their stories because they are the same.
Unfortuantely the 4 corners of the contract Wells Fargo depends upon to lie and using mirrors confuse the courts that the consumers are idiots and that we hurt Wells FArgo. Nother is father from the truth. I pray my government will take back what Wells Fargo took unlawfully not from just my family but from all consumers and their familes in all states of this great nation.
