I was just going over my credit report when I came across a verizon collection for 369.00 reported in 12-06 I have been a verizion customer for over 5 years and know for a fact that I have no outstanding accounts, so I thought someone had stollen my identity. I tried to look up this Afrin collection agency and that is when I came across this website. Thank goodness or they would have tried to play me llike a sucker. Now my credit report has this big yucky untrue stain on it that will follow me around. Isn't there something we can do Isn't this fraud and isn't fraud illeagle punishable by jail time a fine and revoking a liscense. Shouldn't they have to pay us for the damage they have caused. If you know a lawyer in my area (spokane,WA) let me know cause I will take a stand and make sure company's like this don't rip anybody else off ever again.

Alicia,

You have the right to sue for recovery of all damages from frivolous collections activity, and the false reporting to your credit. These are very easy cases to win, and most collection agencies settle out of court as they do not want to set the legal precedent of being sued and losing.

These lowlife are junk debt buyers and amateur collectors doing amatuer skip tracing. They buy very old debts like this for less than a penny on the dollar, and usually have little or no information on the actual debtor, and what they do have is obsolete.

Therefore, they use various directories and public records and contact everyone with the same or similar name in a fishing expedition.

NEVER call or speak to any debt collector on the phone, and NEVER call an original creditor in response to a third party debt collection contact. NEVER!!

Always demand everything in writing. And you only communicate in writing and by certified mail, return reciept requested. be sure to always put the certified# on the letter itself and keep a copy for your records. This is very important.


By the means above, send a DEBT VALIDATION request. DO NOT sign the letter, just print. In this letter clearly dispute the debt and DEMAND a copy of the original SIGNED contract that created the debt, as well as a full account history and itemization of charges.

Also demand proof that they own the debt including the purchase contract, proof of payment including amount paid, and a full accounting of the chain of title.

Also demand proof that they are licensed to do debt collections in your state.

With this done, you will most likely never hear from them again. I would sue immediately.

Now, as far as your credit goes, this is easy. Under federal law you are entitled to see all communications used in the procesing of your dispute, including any verification given by the original crditor. However, you have to specifically invoke this right under the FCRA. Send this letter by the means above also.

You can sue the credit bureau for damages if they fail to comply. Contact the NACA for a lawyer referral in this field.
