Arcadia Financial ripoff, vehicle was stolen, Arcadia bought it from the stealer and is trying to get me to pay for it!! EVEN AFTER A COURT ORDER!! Charlotte North Carolina

MUST READ!! I cannot believe what I have gone through with this company in the past 3 months. Ok here goes, my vehicle was stolen from my job's parking lot. I called Arcadia and told them that it was stolen and that law enforcement was working on getting the vehicle back for me. WELL THEY DIEN'T LISTEN!! On the day before the Raleigh PD was just about to bust the guy for larceny, Arcadia had someone go and pay the stealer $1600 plus dollars to save a lien that they had in the first place. The theif falsified letters saying he would sell unless paid $1600.00. Instead of Arcadia listening to their customer, they jumped the gun and paid this man for steling my truck!!

He was arrested for larceny and ordered to pay back the money to avoid going to prison. However Arcadia is refusing to release the vehicle until they are paid back. In the meantime, me, the customer is without a vehicle even though they know it's not my responsibility to pay them back!! This happened on June 14th and today is September 27th! On top of all that, this company has placed a voluntary reposession on my credit!! I am outraged in how they have handled themselves. They are very unprofessional, and certainly do not put the customers best interest into consideration. Even when it's a legal matter!! I am the victim here and Arcadia has treated me as if I am the criminal!! I am embarrased to say that I have to do business with this company! 1 legal assistant of mine said they owe me money and should have never gotten that vehicle. On top of that, he said the very day they found out that I'm not the one at fault, thay should have released it to me. I can't wait for the right attorney who knows the law inside and out to call me, willing to represent me in court. You have my number, I'm accepting all applications.

Chuck, I think you are probably the moron in all of this. I filed a complaint with the Better Business Bureau, as well as the attorney general of the state of Arizona. The BBB has put a nice big BLACK MARK on their record and the attorney general is conducting an investigation.

Chuck, I traded my freaking car in, balance current and everything. I received my payment book from the new financial institution (a CREDIT UNION) that I am now making payments too and I began receiving calls from Arcadia, and oh yeah... AFTER I FILED A CEASE AND DESIST ORDER! They were not talking calmly, not acting like professionals, but rather screaming and threatening me.

Hell, they even threatened to send someone (probably Guido) from the collections department to my front door. That some collections let me tell you! All this because they hadn't received their payment from the credit union yet. I contacted the dealership, as well as the credit union and I was informed that Arcadia had, in fact BEEN PAID. They were unjustly calling me at my place of business and abusively harassing me. Their loan was paid, I had a new loan and they continued to harass me.

Put that in your pipe and smoke it Chuck. After a debtor is served with a cease and desist order, the ONLY reason they are allowed to contact you is to INFORM YOU of their intended actions. NOT TO HARASS YOU, NOT TO DEMAND PAYMENT, NOT TO TRY AND COLLECT THE DEBT. They could have called to inform me they had the vehicle assigned for repo THAT WAS IT! No, instead, they called me demanding I get them the money they already had! It wasn't my responsibility to update their d**n accounts, it was theirs! On top of that, I spoke to Capital One, which OWNS Arcadia and had my account information also. There were no delinquent payments, nor was my old car assigned for ANYTHING AT ALL. The lady from Arcadia that called me, LIED (against the law) and said she had the car assigned already.

I'm sure you've never paid anything late in your entire life, right Chuck? You feel it's your civic duty, as an always paid your bills on time critic, to come up here and harass people. Well, I may be no lawyer Chuck, but I am well educated in the FAIR DEBT COLLECTIONS practice regulations, as well as the laws by which debt collectors must abide. I feel for anyone that is financing a car through Arcadia, or Transouth. Get out of your loan just as SOON as you possibly can! Don't screw yourself! Chuck, I suggest you go do some reading and learn a thing or two. Maybe then, you'll be able to talk intelligently.

The poster said that the lender wanted the money they paid the criminal not the amount of the loan. They have no right to hold the truck because they paid to a criminal and are part of the crime.

I have just read or attempted to read some of these complaints by some of the most uneducated fools I have ever come across..while I have no doubt the collection centers of Arcadia have issues with regards to collectors saying things they shouldnt some of these accusations are just idiotic.Realize that most of these centers are filled with lower paid employees usually black, sorry but is true, who have less of an education .The guy who had his car stolen and Arcadia paid the thief to get it back,,you are a moron..and Misty, that is correct you are no attorney,,and while your posts in here show a small amount of education , you seriously have no clue what you are talking about..this company gave you folks money to buy a car and you agreed to pay it back on time.most of you didn't thats why you are angry at the world..and if you are so sure of your cases being in the right why are you not winning in court instead of spewing it here! false info that projects your lack of education on this internet site .

I have a couple of questions for you regarding your plight. Did you have the car insured? If so, why in God's name did you call Arcadia??? The are listed as the "payee" if anything should happen to the vehicle (i.e. be stolen or wrecked.) What have the police had to say about all of this?

Ok, if I were you this is what I would do my poor co-Arcadia sucker (I just got out from under them!) File a complaint with your local police department. Tell them that Arcadia was the recipient of stolen goods and there-in should be considered involed in the crime. Next, contact your local Better Business Bureau and file a complaint!

Next, file a complaint with
the Federal Trade Commission, as well as your state's banking Commission. I would also lodge a complaint with the Attorney General of your state. They have the ability to prosecute.

The more people that stand up and complain, the better off everyone is. Any company that offers financing, or even debt collectors, must be licensed to do business with your local banking department (atleast that's the law in Arizona.) I looked up some links for you to begin the complaint process.

This May Be A Long Shot

Have you contacted the District Attorney in your area and advised him of the problem? It would appear to me (and I am no attorney) that Arcadia was aiding and abetting a criminal in action. If he/she doesn't listen, try your State Attorney General's office.

You might also look at your state's website to see if there are any consumer assistant offices that can help. As for the voluntary reposession, I would copy everything you have, including police reports, and send them to the credit bureau, certified mail, return receipt requested, disputing the mark on your credit.
