Arizona Division Of Child Support Enforcement Unfounded, Unjust Garnishment of Wages active duty service member in the US Army stationed at Fort Hood, TX Phoenix Arizona

I am an active duty service member in the US Army stationed at Fort Hood, TX. I have been paying court ordered child support for almost 10 years now through various states were my daughters mother have moved them to. I am currentl paying child support to Arizona Child Support. In the 10 years I have been paying child support, i have only missed three payments, and that was while I was unemployed. As soon as I was employed again, I made up the arrears as soon as possible.

I recently took a second job to help my family as we were struggling financally. I was literally working two 40 hour a week or more jobs to help my family get by. DES found out about my second job and immeadialty initiated a 50% garnishment of my wages from my second job. They did this with no justification, or attempt to complete the process legally. I was not, and am not in arrears at any point. The court ordered amount of child support is garnished automatically from my military wages. I contacted them and was told that the money should not have been garnished since I was not in arrears, and a new court order had not been granted. I followed their guidance on how to have my money refunded to me to the letter. It took over 6 weeks to have the money returned to me. I also asked for a copy of the court order for my records, since when the order was implemented I only received a letter saying that the child support was to be paid to Arizona. I still have not received anything from them after being told that I would receive all paperwork.

I took the second job because we were hurting financially. I needed that money to pay the bills that we acquired. By DES taking 50% of my wages I was not able to meet my just debts and fell behind in many of by bills, causing late fees and interest to pile up. If I take them to court I could be awarded the interest and late fees, but I do not have the money to hire an attorney. If i lived in Arizona I possibly could represent myself, but since I love in Texas this is not possible.

Beware of Arizona child support, they will take whatever they want, whenever they want without justification. Then drag their feet once you call them out.
