Asset Acceptance giving false info?? Warren Michigan

hello as i see i am not the only "lunatic" out here. apparently my account is with bally's who sold it to asset. these people are so rude. when they called i was very calm although through the internet i already disputed the charge. i very nicely let them know that i was disputing the charge and they seriously told me that i could not dispute the charge-a piece of trash bill collector (not a lawyer) trying to give me legal advice.

they informed me that i signed a contract so there is no legal recourse. little do they know (i say 'they' beause i got the same crap from monica rogers and a manager named amy) this particular contract is voidable. there is a little piece of legislation called truth in lending and since they feel that bally lent me services and they failed to notify me of potential consequences of the contract, it is voidable.

so i asked for the contract that i signed with bally's and they said that they dont have it and it would take 6-8 months to get it as well as a 15% surcharge. now if this legally binding contract is what holds me to the debt why cant i have a copy of it??

also when i informed them that i would be hiring an attorney the woman (Amy) asked me where i would get the money to hire an attorney? i told her she was crossing the line and had no right to ask of my money situation. she then told me that she had every right to know how i was getting money for an attorney but could not pay them.
am i wrong or maybe crazy to even think that i have a chance to fight this debt??

when i signed up for bally's i did not have a steady job and had sparse work. i thought the contract was for the month to month promotion that bally's had in 2005. so if i had the money i could go to the gym. now i went to bally's twice in the first week so why should i pay for services that i did not want.

now i am a member of lifetime fitness and when i had a similar situation (my monthly installments had lapsed for 4-5 months, which for my plan equalled about 500 dollars) and do you know what lifetime reps said?? dont worry about it since you did not come to the gym we will not hold you responsible. i have been a member with them for 2 years and counting.

now in retrospect, i dont remember receiving any documentation concerning the debt from bally's just harassing phone calls from asset.
WHAT A ******* joke!

well at least when i need to vent about something i know to call asset because they probably deserve to get chewed out no matter what my problem is
