Attorney Bobetky, represented us in a land real estate transaction, he recorded a deed prior to reviewing or receiving the closing documents from buyer's attorney,( this was on the insistance of the buyers attorney, he wanted to ensure his lcient could receive an IRS 1031 to avoid capital gains taxes) days after recording the deed, the closing documents arrived and contained an escrow agreement not favorable to us the sellers, instead of revelaing the problem, he never disclosed or provided us with a copy of the escrow agreement,
he sent aletter to the buyers attorney stating we never showed up for the closing and "hit the roof" when we learned of the contents of the escrow agreement, his actions then caused the buyer to file a lawsuit against us for which he also never revealed, (he was served as POA, not us) he then answered the complaint with false answers stating we never went to th eclosing nor did we sign any of the cloing documents, we only discovered this after he passed the mess off to another attorney, who only made matters even worse.
He failed to represent us by recording the deed to protect the buyer not us. He recorded a deed with out reviewing or receiving the clsoing documents, and funds. He lied and stated we refused to sign, did not show up, (we also signed our dated wills that date, proving we were there) He then whited out our signatures to make it appear we never signed, he must have forget we had copies of the documents.
He told us "I am just waiting for you to file suit against me". He conspired with another attorney to conceal his actions, that attorney only made matters worse. Never offered a refund of $5800.00 we paid. He left Greenfield Mass, he is now "practicing" on Beaufort, NC
