We traded in a vehicle to Auto Junction Inc. on 11/06/08 towards the purchase of one of their vehicles. We had obtained outside financing from USAA for the vehicle purchase & provided them with a check from USAA for the full purchase amount plus the negatie equity from our trade in on 11/06/08. Auto Junction was to pay off the loan on the vehicle that we traded in within 10 days.

They cashed the check from USAA within 48 hours. We began accruing interest on the new vehicle on 11/10/08.
We contacted Auto Junction on 11/17/08 to confirm that the payoff check had been mailed on our trade in. We were advised by their Finance Manager, Tom Carman, that they were not going to pay off our trade in unless we gave them an additional $3000 more than what is stated in our signed purchase agreement because of something they found on the Carfax report for our trade in. Why didn't they pull a Carfax before we did the deal? Don't know - we pulled one on the vehicle we were purchasing. I guess someone didn't do their job.

The car we purchased ended up having metal showing through on the inside of one of the tires, NO oil, the filters had NEVER been changed and it was just plain filthy, but I bought the car from them "as-is" & they did the same with our trade in!

We do not feel that we owe them anything and would like to have our trade in paid off as originally agreed upon. We had a contractual agreement on trade in value and paid value for the new vehicle.

They have since threatened to pay off the new vehicle loan through USAA and repossess the vehicle that they no longer own. The title has already been transferred to our name and the lien holder is listed as USAA on the new vehicle. In other words they are trying to scare us into giving them more money by threatening to take ILLEGAL action against us.

I asked to have my options in writing & they refused. We also asked if we could record the conversation & they hung up on us. We have filed a complaint with the BBB, the State Attorney General & with the MVD Inspector General's Department. We will also be retaining council before we speak to them again.

Auto junction does 30million a year in sales so I'm proud to say, most of our customers are honest people, so it's not common practice for us to question their integrity. But when we ask Alliey about her trade she lied and said there are no issues. THE CAR WAS A LEMON LAW BUYBACK!! What if a dealer sold you this car and didn't think it was import to make you aware that it is a branded title? Don't think you would be very happy. Especially since you just listen to this person complain of how the last dealer screwed them and their just looking for an honest dealer to help them out of the miss they're in.

We went over and above what was required, including letting her get an inspection, transferring the title to the car she bought and paying hers off promptly. Now with that being said she knew before she bought the car it needed tires, oil change and whatever else she claims. (I didn't even charge you for the couch you broke when you sat down to tell me these lies.) This lady and her very submissive husband tried everyway to get someone to say we did something wrong BBB, Attorney General's office, MVD and her husband is a errands boy for an attorney here in town. But she got shut down everywhere, so this is the only place she could complain without being told she was wrong.

Hope you never get the chance to meet this people, but if you do you will understand where I am coming from.
