It's been 5 years now and going. Today we received another phone call from Asset Acceptance who are trying to contact my daughter and have put a black mark on her credit report. I am tired of the weekly to semi-weekly calls to my house and have asked that they do not call here again. Our story is not much different than many of your, but I will describe it anyway. 5 years ago last March my stepdaughter arrived from another country. Started attending college in Chicago for nursing. A couple of her classmates were going to Bally to workout and invited her telling her about a $19 introductory offer. So she went with them. Upon arrival she was told that in order to use the facilities she had to be a member. She mentioned the promotion and was escorted to a salesperson. By the time she had finished signing all the papers (she wanted to get to her friends) the salesperson had gotten her to sign a contract for $1200 and she didn't even have a job. Well, 3 days latter I found out what had happened and called and called this salesperson who never returned our calls (you see he told her she could cancel within 30 days). During that month she got sick at the club and had to go to the hospital from the pool or something. I took her to the club looking for that salesperson upon which we were redirected to a manager who informed us that that person had been terminated. He asked "how can I help you"? We explained our situation and were told we could opt out for $200. What 200 for what I responded and said let me talk it over with my wife. The next time we returned it was "Let me get this approved by the store manager who is not here right now", then we have to check with corporate we will contact you and so on for three months. After her illness there she never again went back. But they continued to take money that my wife & I gave her for college expenses out of her checking account. After 3 more months corporate refuse to the compromise and threatened her with breech of contract. Well you have to understand our fustrations finally we close her checking account and then a short while later a collection agency started coming after her. Now it in Asset Acceptance hands

Did they directly correlate her illness with Bally's pool (ie waterborne virus/bacteria)? They may actually owe YOU, and whatever company or person paid her medical bills...

Find out where the judgment was entered and see if she can file a motion to vacate the judgment. Consult an attorney as to what papers you need in order to file.

PS Never take the advice of an admitted debt collector concerning a debt...

Ok so you know for the future and maybe to help you know...i personally specialize in cases for ballys on the contract that she signed it states that the proper way to cancel a ballys total fitness contract is as follows:
first and formost if you live near a ballys and are phisically able to work out you cannot cancel
otherwise you must have a doctors note saying you cannot work out and also a 50 check or money order and mail this certified mail to the head quarters office and "IF" they approve the cancellation then you will recieve a cancellation letter, you cannot cancel in the club and they will tell you sure they will cancel it because all they do is cancel your membership there not cancel your contract...ballys works like when you buy a new car, they get paid 3 days after you sign that paper you actually finance your membership so this is why its still owed...HOWEVER since it is so old my advice to you is to call Asset and offer to pay if they take 70% off and i am pretty sure they will do it or something like that and then this will be taken care of! GOOD LUCK and BEWARE BALLYS
