An Open Letter to Mr. Brian Moynihan
CEO of Bank of America
Dear Mr. Moynihan
I write this letter with a very heart, but it is yet a letter I must write. Be assure that I get no pleasure from this, but rather I hope that unlike your predecessor you will find it in your heart to do the right thing in this very special case.
In January of 2006, a woman by the name of Marianna G. Goncalves sold her home in the City of Brockton, Massachusetts. She was represented by a Real Estate Agent, and the closing was held at the Offices of a licensed Attorney. What she did not know was that these men were not honest, and that this was a scam to defraud her. The closing was held late on a Friday. Marianna was told that because the deed coiuld not be recorded until the following Monday, the Attorney was giving her check, in the amount of $69,000.00 to the Real Estate Agent to hold until he could record the deed. At this p;oint I call to your attention that Marianna Goncalves could not read or write the English language. As a matter of fact there should have been a Court Certified Translator at the closing. There was not. Reluctantly she was coerced into this agreement. Again I call to your attention that the check, made out to Marianna Goncalves was not endorsed. The Real Estate Agent took the check to Bank of America, signed the check himself, deposited the check into his account. Later he want back to Bank of America, withdrew the funds and transferred the money to Webster Bank. From there the money disappears. This was all the money Marianna and her four children had in the world.
With no funds and with a language barrier, there was little Marianna could do. Bank of America did not want to hear about this. As a result, Marianna and her four children became homeless. They were evicted by their new landlord. They ended up living out of her car, which was later repossessed.
In 2008 this matter came to my attention. I immediately contacted the Bank. In addition I contacted Congressman Barney Frank of the House Banking Committee. Upon consensus of opinion a Law Professor took up her cause on a contingency basis since the woman and her children hardly have enough to eat. We assumed that Bank of America would do all it could to help us in settling this matter, and clear it's good name. Well that has not been the case. The firm representing the Bank has been arrogant, and insolant. They have repeatedly tried to dictate terms, and they have done all they can to delay this matter from being put before a judge and jury.
Needless to say all they are doing is to delay. They do not have the power to stop the case. In the process however they will amass a much greater fee for themselves, and do further damage to the name of the Bank. I cannot believe that this would be in concert with your wishes. I this really the image your Bank wants portrayed to the American People. I am not an Attorney, nor do I profess to be one, but even as such, I would not want to walk into a Federal Court and face a Federal Jury and represent Bank of America after pulling such stunts.
I believe that an employee, or employees of the Bank did a favor for a client of the Bank. They cashed a check, that they should not have. The check did not belong to the Real Estate Agent, and it had not been endorsed over to him. HE WAS CASHING SOMEONE ELSES CHECK. A check for a large amount of money. The best thing was that the Bank would admit that it had made a mistake, and do all in it's power to rectify the error. That would have been the honest thing to do. That was not done.
As of this date, your Attorneys are still up to their tricks. They use delaying tactics one after another. As you prepare to hand out bonuses totaling hundreds of millions of dollars, to your staff I call to your attention Marianna G. Goncalves. She has trouble paying her rent. She has had her electriciy turned off more then once for non payment, along with her telephone, and her heat. She lives in Rhode Island and works in Massachusetts. She has no car. Every morning she has to walk 3.7 miles to be picked up and taken to work. She has to do this no matter how bad the weather outside is. SHE HAS TO DO THIS 5 DAYS A WEEK. The woman has suffered enough.
I ask you to call your attorneys and tell them that this matter will be settled this month, and it will be done so without fail. I ask you to tell them not to attempt to further defraud her. After all what is the price of the Bank's good name. Before they settle on an amount, let me ask you this, how much is your bonus? What makes you better then Marianna G. Goncalves? I ask you this last question? How much will a jury of her peers award her in this climate, in this era of Bank hating? Are you sure that an Appeals Court will lower the award, or for that matter even hear the case? How much more dmage is your Bank willing to take?

Bank of America & Wingspan Portfolio Advisors are FRAUDS

Sorry to hear about your friend. I use to work for Bank of America through a third party contractor called Wingspan Portfolio Advisors. We were instructed by our supervisors at Wingspan Portfolio Advisors to commit fraud all the time. We lied. Tampered with original loan documents and mislead customers daily regarding their mortgages, modifications and foreclosures.
All under the watchful eye of Bank of America's Vice President who was with us in our center almost daily. Wingspan Portfolio Advisors is owned by the corrupt Steve Horne who in turned hired and even more corrupt group of folks to run his various departments. Melanie Pellegrino, Justin Belter, Kevin Conn are among some of the most corrupt and evil people I have ever seen or worked with. They had no soul or conscious.
While Bank of America customers were pleading with us to help them we were intentionally pushing them towards foreclosure especially if their homes had equity in them.
I left the company in disgust.
Not only were these people frauds terms they where also racist. Justin Belter referred to a black coworker as a nigger and melanie pellegrino referred to blacks as roaches and monkeys. The company also had total disdain for Hispanics and Muslims.
I say sue their a**es.

This war would allow the bankers to manipulate the price of oil to new highs, and it would also allow them to eventually take control of that entire region. However, it might also spark a Nuclear War, which would trigger the collapse of all economies on planet earth.
Our 'system' in the USA thrives on corruption. That is precisely why it will collapse again. Provoking another war in the Middle East would allow the ones in control to blame the 'terrorists' for the collapse of all economies if the war goes nuclear. I believe it will happen. I also believe it is a 'plan' by the ones who are in control. Both Obama and Romney believe in war. So does Benjamin Netanyahu, the Prime Minister of Israel. The Central Bankers are the ones who are ultimately in control of the governments of Europe, USA, Israel, and many other nations. So it makes sense that they also control the militaries too.
'World Empire' is their ultimate goal. If they have to 'destroy' much of the world in order to take control, they'll do it. (They're doing it now.)

To all concerned, Marianna never did get her check back. Bank of America stole her money, hired a high priced Boston Law firm to represent the Bank, used high powered tactic and they got away with the crime. Yes that is exactly my opinion. That they are criminals and they committed a crime and they bought themselves out of the situation. It is further my opinion that this is what happens when you have Judges and Politicians in your pocket. Who needs the MAFIA? We have the BANKERS.

Anyone can 'Google' this- DID SPECULATION FUEL OIL PRICE SWINGS, and watch that 60 Minutes segment from 2009 on the web in order to understand why oil prices surged in 2008, right around the time that the banking system in the USA and around the world was collapsing.
FACT: In September of 2007 the price of oil was between $76 and $81 a barrel for the month. Oil rose sharply throughout most of 2008, right around the time Bear Stearns was collapsing and many other Wall Street companies were having severe financial difficulties, like Lehman Brothers, General Motors, AIG, Fannie Mae, Freddie Mac, and almost all of the big banks that were bailed-out by the taxpayers.
On July 4, 2008, oil closed at $145.29 a barrel. On December 26, 2008, oil closed at $37.71 a barrel. That's a decrease of $107.58 a barrel in less than six months!
Simply 'Google' this- CRUDE OIL PRICE HISTORY, and go to the chart to verify the above prices.
Anyone with a functioning brain could determine that the price swings from September of 2007 until December of 2008 were NOT a result of worldwide demand or supply. Oil was obviously being manipulated (speculated) for profit, in order to keep the system afloat. Right after the government handed over the TARP money (taxpayer's money) to the bankers and much of Wall Street in the later part of 2008, the price of oil mysteriously plunged by over $100 a barrel.

Oil prices are high again. So, we can logically conclude that the bankers, and others, are 'manipulating' (speculating) the price of oil for profit in order to keep things afloat, for now.

Anyone can 'Google' this- DID SPECULATION FUEL OIL PRICE SWINGS, and watch that 60 Minutes segment from 2009 on the web in order to understand why oil prices surged in 2008, right around the time that the banking system in the USA and around the world was collapsing.
FACT: In September of 2007 the price of oil was between $76 and $81 a barrel for the month. Oil rose sharply throughout most of 2008, right around the time Bear Stearns was collapsing and many other Wall Street companies were having severe financial difficulties, like Lehman Brothers, General Motors, AIG, Fannie Mae, Freddie Mac, and almost all of the big banks that were bailed-out by the taxpayers.
On July 4, 2008, oil closed at $145.29 a barrel. On December 26, 2008, oil closed at $37.71 a barrel. That's a decrease of $107.58 a barrel in less than six months!
Simply 'Google' this- CRUDE OIL PRICE HISTORY, and go to the chart to verify the above prices.
Anyone with a functioning brain could determine that the price swings from September of 2007 until December of 2008 were NOT a result of worldwide demand or supply. Oil was obviously being manipulated (speculated) for profit, in order to keep the system afloat. Right after the government handed over the TARP money (taxpayer's money) to the bankers and much of Wall Street in the later part of 2008, the price of oil mysteriously plunged by over $100 a barrel.

Oil prices are high again. So, we can logically conclude that the bankers, and others, are 'manipulating' (speculating) the price of oil for profit in order to keep things afloat, for now.

You need to understand that the banking system in the United States of America (most of it) is corrupt. It is ultimately being controlled by the same corrupt people who control Wall Street. The ones who control the banking system and Wall Street also control the U.S. government.

The legal system in the USA (much of it) serves the large corporations. Many of these corporations are the ones that make up, and support, the corrupt banking system which ultimately controls the United States government and the governments of Europe. That is precisely why this woman, and others, will most likely never see justice and get what was STOLEN from them!
The 'Laws' in this country PROTECT the corrupt people who control this country, and the politicians in this country (most of them) serve and protect these same corrupt people.

We have copies of the check, front and back. It shows that the check was not endorsed by the owner of the check but by someone else. It also shows that Bank of America cashed the check date and time and branch. We have filed complaints with the FDIC The Comptroller of the Currency, also a formal complaint has been filed with the Senate Committee on Banking. It is time for Mr. Moynihan to do the Ken Lay perp walk, and the only way for that to happen is for we the people to demand from the United States Senate. Washington seems quite free to hand out our money to these Banks, and the Banks gleefully run to the Capitol to get it, only to later hand out billions in bonuses. Wake up people. Write, text, e-mail the Senate. Yes your voice does matter. Senators have to run for re-election, and we have the vote.

these poor bankers like everyone else lives paycheck to paycheck and it would be very heartbreaking to know one of them could not afford to buy that new 200ft yacht--now they could only afford that 195ft yacht--i believe you are asking to much!!!---with this we all wonder why there is class warfare??maybe it is cause they steal from the poor??--or is it cause us poor are just jealous??--while we all hear of bankers getting millions in bonuses as they collect billions in overdraft fees it is the poors fault that these banks rearrange transaction dates and deposits--it is our fault cause we cant keep accurate records-and we have no ACCURATE record of what they are doing with our money??---remember--it is never the fault of the bankers and it is our fault we are taken advatage of cause we can't speak english--we have little and try to keep accurate down to the last dollar records to have these records rearranged to show overdraft----it is time we realize we are all just f#ck ups and these bankers deserve to keep stealing our money-after all--they earned it right??--everyone earns there money somehow--stupid people!!!!!!---------on a serious note---do you actually think top bankers will actually give a f*k as to what happened here--let alone barney frank??--barney frank probably gets a cut of these overdraft fees and stolen checks and goes to a gay nudy bar and spends it--this is after all more imprtanat than some broad who can't speak english

GOOD THING TO DO.
I believe that posting it here on the worldwide web was even a better thing to do. You can read another letter that was written and mailed to the Mainstream Media on 9-12-2007, if you'd like.
Simply 'Google' this- RIP OFF REPORT BANK OF AMERICA PAID A FRAUDULENT CHARGE TO MY CREDIT CARD, and that Ripoff Report should come up. The letter is posted in the comments section of that Ripoff Report, along with some poems.
I can prove that most of our system in the USA is corrupt. The 'system' that I'm referring to is the 'corporate' and the 'legal' system of the United States of America.
The ones controlling our country, & most of Europe, are out to defraud as many innocent people as possible, in my opinion. They'll use, and 'manipulate' the legal system to attain their goal, which is to FINANCIALLY INJURE THE INNOCENT PEOPLE LIVING HERE, and all over the world.
Guess what? They're being EXPOSED every day on the worldwide web, and it's only a matter of time until their "house of cards" comes tumbling down. Just a few minutes ago the Dow Jones was down 195 points. Keep watching what happens in the USA & all over the world in the coming months and into 2011.

And Robert...if this bank cashed a check without endorsement, or will not return the funds as it is legally obligated to in the case if it was a forgery/fraud...and then takes no responsibility...what would you call that? Yes this story is drawn out and much more detail then we need is given..but..it seems this bank messed up and left this customer to rot.

If this report is on the up and up...The BANK is the first line of defense..the bank is the one that ALLOWED, took and processed and cashed an un-endorsed check..you honestly believe they hold no responsibility????????? If this happened to you..what would you do? Be honest now..no rhetoric.

What's this? This is a sad situation, but the anger is directed at the wrong company. And NO I do not think there is enough information posted here to determine if the bank is some sort of accessory. Why did the OP write a "RipOff" report on the bank. Perhaps the answer lies in this one statement.
How much will a jury of her peer award her in this climate, in this era of Bank hating?
Perhaps they feel that jumping on the "Bank hating" bandwagon has a good chance to get some "play" in the media. But no one knows the person who embezzled the money, so of course that won't get any "play". Was that person prosecuted? If not then why not? I seriously doubt they would have built up what probably came through as a business for just one "score" of 69,000. So I am pretty sure that these people could have been found. If that person was prosecuted there are ways to possibly recover funds.
The OP talks about honesty then again blames the bank for someone elses DISHONESTY. Sure they "could" give her 69,000. Of course then what about the next person who had 690,000 withdrawn, then what about someone who had 6.9 Million dollars withdrawn? What about the hundreds(or perhaps thousands) of people that fall victim to various check cashing scams. Their loss is probably just as important to them even though it may only be a couple thousand dollars.
Something you really have to ask yourself. At what point is the bank no longer responsible for other peoples actions?
A few other questions
What was the ISSUING bank of the check that was deposited?
This happened on a Friday when he deposited the money. How much time lapsed between the deposit and when he went back to withdraw the money?
I am also a bit curious as to what the OP's relationship is to the victim? Because there is a two year "hole" from 2006 to 2008 where the OP is only getting what happened from Marianna(I presume) unless there was another party involved since 2006 as well.

I am not an attorney either, but it seems obvious the bank is at the very least an accessory/accomplice to a crime if the statements in this report are true.
This bank is horrible and unconscionable and as an American I am not too happy that this bank uses America in it's name. Don't expect this bank to do anything to help in it's "good name" has this bank has a despicable reputation of financially harming it's customers..and more so during this economic recession where it's predatory practices can work in more abundance.
That aside...I assume there is a copy of this check in your possession? If not the customer and attorney may be able to get it online or directly from the bank. The signature on the check copy is either proof of forgery, and/or that the bank honored this check against her account without her endorsement.
Also..and this should be done regardless...go to the bank and request a Federal Regulation E dispute form. The bank must reverse the charges if what you stated is true. Now the bank has 60 days so if this has been going on for more then 60 days the bank may try to weasel out of it. Demand that the bank make good regardless since the delay was caused by the bank not handling this properly or fulfilling it's legal obligations in a timely fashion.
