I was hoping that maybe you can help with what direction to take from here. The DL customer service rep that I spoke with did give me the info to the Borrower Service Department of Direct Loans that I can fax or mail the case info to. This is the department that will initiate our request. I appreciate your time and help.

False Certification
If you received a Direct Loan or a Federal Family Education Loan (FFEL) Program Loan on or after January 1, 1986, you may qualify for a False Certification discharge if you (or the student for whom a parent received a PLUS loan) received a loan that was falsely certified by an eligible school. Your eligibility to borrow is considered to have been falsely certified if the school--
1. Admitted you on the basis of ability to benefit from its training and you did not meet the applicable requirements for admission on the basis of ability to benefit; or
2. Signed your name without your authorization on the loan application or promissory note; or
3. You have a physical, mental, or legal status or condition at the time of enrollment that would legally bar employment in your field of study.
4. You are the victim of identity theft.
In order to permit a student to borrow a Federal Direct Loan or FFEL Program Loan, schools are required to certify that student borrowers who lack a high school diploma or GED have the ability to benefit from the training offered by the institution.
False certification of a student borrower's eligibility occurs, for example, if the school failed to test such a student's ability to benefit or conducted testing in an improper manner. Schools may satisfy the ability to benefit requirements, for example, by testing students or offering courses in remedial education.
Misrepresentations, by the school, on the other hand, regarding the school's educational program or its financial or administrative capability, including the school's placement services or the quality of the school's facilities, faculty, or equipment are not part of the process of "certification" of the student's eligibility to borrow and do not entitle the borrower to False Certification loan discharge.
If your loan is discharged, you will not owe any more payments on the loan, and you will get a refund of payments you have made in the past. Also, if the loan is discharged, the servicing agency will tell credit reporting agencies that the loan was discharged, and any adverse credit history resulting from nonpayment of the discharged loan will be deleted. In addition, your discharged loan will not prevent you from applying for federal student financial aid.

In the past year we have written numerous letters to our State Representatives to no avail have any of them helped us. We got form letters that said, "thanks for writing to us and have a nice day" from Patty Murray, and Maria Cantwell never answered us at all. Jay Inslee was kind enough to at least lie and say he would look into it for us and never contact us back.
What could we of possibly done to make our lives better and get off welfare that to get an education. An education that would save the Government Billions by actually getting people off of Welfare. Looking into these schools that are positioned through out stated that claim they can help you achieve you dream of being self sufficient would have been to easy. The fact that we thought that this would make us successful and would of gotten you off Welfare and put food on the table of thousands of people.
Never would I of imagined that we did not even deserve a chance to succeed at anything other that sit on Welfare because they didn't take the time to make sure the money they give to these Technical Colleges ware actually a legitimate School that would actually give you a chance up from the next round of Welfare recipients. To show them that they too, can succeed at getting off the system. Instead we showed them not to depend on anyone in our government for help. That we are on our own and that even though we are working hard to get ahead that the system is going to fail us each and every time.
I think some of Legislators need to step up and be accountable for their shortcomings as representatives. They should be watching out for residents of this state. They are supposed to protecting us from fraudulent schools that are taking money for school loans and the Government allowing them to do it.
When are the going to step up? Do we wait till election time? They need to know that even though we are poor and some might be on Welfare that we do have a voice at the polls. And as fast as they were put in that they can be taken out of their jobs.
Come on guys. Take a stand and help the people that they have a voice and can make a difference in people's lives.
Lets face it. In past elections if there was any thought of voter ballots being tampered with, they scream fowl and ask for accountability and a re-vote. If we are wronged as citizens by our Government, they are not there to stand up for us.
WE NEED THESE LOANS WROTE OFF. That is the only thing that is going to allow Justice to be served.
