Last year Buckles & Buckles PLC of Birmingham,MI wrote me and claimed that they were representing Capital One Bank-USA and they were trying to collect money that I owed to Capital One Bank. It's true that I had been using a Capital One Bank credit card with a maximum value of US $ 300. I had also enrolled in the credit card protection plan so that in case I was unable to make my minimum payments I would be protected.

When I lost my job and was unable to make the minimum payments I received harassing letters and phone calls from Capital One Bank-USA representatives. I asked them about the protection plan that I had enrolled in but they insisted that I pay off the credit card first before my question could be addressed.

Buckles & Buckles PLC took me to court in Grand Rapids,MI. I appeared in court and explained my case. The judge ruled in their favor. I paid off the total amount which had reached US $ 700.

To my surprise today I received a letter from the  Michigan Department of Treasury, Third Party Witholding Unit informing me that my income tax refund is being widtheld because I owed Capital One Bank-USA money and their attorney is Buckles & Buckles PLC of Birmingham, MI.

Should I sue them for the pain they are causing me and all the damages that I am going to incur because of my tax returns being garnished?

Now, you went to court and lost.  If there was an issue with the payment protection this is where you should have brought it up in court. 

When you were taken to court and loose you are responsible for their court fees, attorney fees, and they are generally allowed to claim interest on the unpaid balance.  So if the "debt" was only $700 and you paid ONLY $700 I can almost guarantee you that you didn't satisfy the judgment.  As just the court and attorney fees probably added at least a few hundred dollars.  Then if you paid this over time, then you need to include the additional interest. 

Not knowing how much they took from your refund it is hard to say if they did anything wrong or not.  So you need to read what the judgement stated and get together proof of ALL of your payments.  If you can prove that you satisfied the judgment and they were incorrect in taking it you needd to deal with the State to get it back. 


If the link is redacted just search "MI Department of the Treasury Third Party Withholding Unit" and you will see the official site and in that site is how to get your money back.

As for suing them.  IF they were wrong in taking the tax refund you could try to sue them for any real damages, such as Returned check fees.  But trying to get any additional money for "pain" probably won't get very far.

When the court ruled in their favor, the court should have issued a written Judgment stating the exact amount you owed.  After you paid the judgment in full, Buckles & Buckles should have filed a Satisfaction of Judgment with the court (and with a copy to you.)  It sounds like either they did not do so or they did but forgot to send a copy to the Dept of Treasury.

If they filed a Satisfaction of Judgment with the court, then I would file a protest with the Dept of Treasury.  Send them a certified copy of the Satisfaction.

If they did not file a Satisfaction, then you need to gather up your proofs of payments and head back to court for some post-judgment proceedings.  They are entitled to collect on the judgment once only; they cannot collect the full amount from you and then take your tax refund.

BTW, never buy that insurance.  I got burned on it once, too.  Paid insurance on a revolving account for 15 years.  Then I was unemployed.  I filed a claim and they denied it because they said I did not file a claim for unemployment insurance soon enough.  Got the State Insurance Department involved and six months later they paid my claim -- but only for three months.  It's just not worth it.

I think you screwed up when you went to court.  However if you were unemployed and drawing benefits you should have been "judgement proof" and won the case hands down.

Something smells here. badly Also thats a good reason to not have taxes taken out of checks.  If you owe come tax time then you can pay (if you want).  You shouldn't have to wait to get your own money back.(and with no interest I might add)  Or in this case not get your own money back.  Nice of the credit card companies to be in bed with the state dept of treasuries now.

I never liked captial one anyway just based on all their stupid commercials.  Someone has to pay for all that advertising in the end you know.  Thats how you ended up paying $700+ on your little $300 card.

Now Im sure certain ones on this site (ie, shillers) will come on here and say that you shouldnt have defaulted on your card and you wouldnt have had this problem.  Thats an easy shiller line, and it is used alot on here.
To them I say sukit.  Go shill yourself somewhere else.  You did your part and took out the "protection" that was offered to you  (more like pushed on you) by the card company.  You payed your premiums and whaddya know! the card company reneged on their obligation to you.  I would get me a nice free lawyer since your low income and have them look into straigtening this mess out.

Now will come the shills.....
