WHEN IS "PAYMENT DUE DATE" NOT A DUE DATE?I recently discovered that even though I was mailing payments 5 to 7 days prior to my "payment due date" via Priority Mail; I was being charged interest. When I called to inquire why...I was told that banks are allowed something called "white mail"...mail that they are allowed to HOLD for up to five days without opening it.
So even tho' I was able to track my payment and find that it had indeed made it before my due date...it was not opened and credited until two days later. I want to know how this can be? Why aren't consumers furious. What's to keep banks from routinely holding a quantity of this "white mail" and charging interest and late fees? Yes, this is written in your contract that you received when you applied for your credit card.
I'm sure I read it nearly 25 years ago (I've had the card for at least that long) but who remembers that stuff? Especially when I am one who generally pays early; it rarely happens that I pay interest.I'd bet that the majority of credit card holders are not aware of this practice and would be FURIOUS if they did know.How is it that we've let banks, IRS, and various other institutions obtain so much power over our finances.
I want this to STOP. I've had it. A friend of mine was enduring obvious harassment from the IRS and my husband and I were actually AFRAID that we may get called as witnesses and if we stood up for our friend that the next year would find us being audited. This is a REAL concern for many Americans. But back to the issue; white mail. Let's make it stop! Or at the very least require payments to be posted on the date that the mail is received regardless of when these @#$@ banks open it.

Karl, I am all for free speech. I served in the military to defend your right to spout your paranoid nonsense. The point I was trying to make was that your poems are irrelevent to this posting, as they are to many others. As I stated elsewhere, there are more appropriate forums in which to engage in these kind of dialogues. The purpose of Rip Off Report is for consumers to help each other with constructive advice and support. Your postings do neither. While they are informative, they are inappropriate to the forum. You, Rita, Charles.... you all need to find another way to work through your issues.

DEEPAK POEM
This poem's about a very great man
I saw him one evening in Boulder
Had the top down that night- it was warm
I'll even drive with it down when it's colder.
He's a cardiologist who lived in the East
Fixes hearts and really likes to write books
A true healer who helps all the people
Not a CEO or one of those crooks!
I was never really much of a reader
Rather be driving and screechin' some tire
Then one day read a book by Deepak Chopra
'The Spontaneous Fulfillment of Desire'
Kept on reading it over and over
All the sudden everything became clear
I was just like a Porsche 911
But was stuck in a very low gear.
The shift had been made- so I floored it
Over 150 on that dry mountain road
All six cylinders were screaming so loudly
Felt the 'prana' inside me EXPLODE!
I can do it- it's really quite easy
YOU can do it- I know that it's true
No more 'One Fish' or 'Two Fish' or 'Red Fish'
The whole universe is inside of you!
I guess that this poem is over
Can't think of much more I can say
Time to read one more book by that healer

There once was a man
He was a Harvard Professor
His brain never stopped working
It had a built-in compressor.
He knew about DECEPTION & FRAUD
Knew about LIES & CORRUPTION
He knew the market would BLOW
One big financial eruption!!!
Now our country's collapsing
We hear cries, shouts & moans
Blame it on fraud & corruption
And DECEPTIVE HOME LOANS!
But the big-shots don't care
They made MILLIONS, it's true
Lowered your stocks & RETIREMENTS
Now they're LAUGHING at you!!!
The Professor teaches what's right
But most will DO what is wrong
CEO's think that they're KING
Now we know they're just KONG!
Now we all understand
It's man's love for the DOLLAR
Forgetting one's lessons from the Professor
A great man who's a scholar!
Time to wrap this one up

There once was a Penguin
Who could really stop that puck

Those Red Wings kept shooting
They were trying to score
But that Penguin kept moving
He said- 'Give me some more!'

Today, March 11th, at 12:15 MST I met with a Certified Public Accountant in Castle Rock, Colorado. She has many years of experience as an Accountant, and specializes in preparing TAXES for companies, corporations, & individuals.
I asked her this question- 'Is there a LAW that requires an American, who earns a SALARY, or a WAGE, on his or her LABOR, to pay Federal Income TAX?'
She replied- 'No. There is no such LAW.'
Then I said this- 'Then why are there people in jail regarding this issue?'
She DID this- She grabbed a Federal Income TAX Return, and pointed to the area where it says this- QUOTE: 'Under penalties of perjury, I declare that I have..........'
And then she said that THIS is the REASON that people are in jail, or are in TROUBLE, with the IRS.
You see, if you LIE, & CHEAT, then you can get into trouble because you FILED A RETURN that was not true, & now you're on the hook, do you understand? However, she said that there is NO LAW that requires you to FILE, or even PAY, Federal Income TAX. It's on a 'voluntary compliance' basis. And the main REASON that so many Americans do file is because the COMPANIES & CORPORATION where they WORK take the money (taxes) out of their PAYCHECKS!!!!
HOWEVER, She stated that THERE ISN'T A LAW THAT REQUIRES an American who earns a SALARY, or a WAGE, on his or her LABOR, to FILE, & PAY, Federal Income TAX! Susan,
Today, March 11th, at 12:15 MST I met with a Certified Public Accountant in Castle Rock, Colorado. She has many years of experience as an Accountant, and specializes in preparing TAXES for companies, corporations, & individuals.
I asked her this question- 'Is there a LAW that requires an American, who earns a SALARY, or a WAGE, on his or her LABOR, to pay Federal Income TAX?'
She replied- 'No. There is no such LAW.'
Then I said this- 'Then why are there people in jail regarding this issue?'
She DID this- She grabbed a Federal Income TAX Return, and pointed to the area where it says this- QUOTE: 'Under penalties of perjury, I declare that I have..........'
And then she said that THIS is the REASON that people are in jail, or are in TROUBLE, with the IRS.
You see, if you LIE, & CHEAT, then you can get into trouble because you FILED A RETURN that was not true, & now you're on the hook, do you understand? However, she said that there is NO LAW that requires you to FILE, or even PAY, Federal Income TAX. It's on a 'voluntary compliance' basis. And the main REASON that so many Americans do file is because the COMPANIES & CORPORATION where they WORK take the money (taxes) out of their PAYCHECKS!!!!
HOWEVER, She stated that THERE ISN'T A LAW THAT REQUIRES an American who earns a SALARY, or a WAGE, on his or her LABOR, to FILE, & PAY, Federal Income TAX! She did say that the IRS could make one's life very miserable, & will sometimes seize property, and other things. I guess that people have simply become intimidated by them, huh?
You can believe whoever you'd like. I believe her, & I believe that Aaron Russo's documentary is TRUE & ACCURATE. (AMERICA: FREEDOM TO FASCISM) You can 'Google' it & watch it on the web!
I hope EVERYONE has the ability to pay DOUBLE this year so our governnment can continue to PROTECT, & SERVE us, don't you?

After reading your most recent Update it made me think that the constitution of the United States may have been interpreted by the government in an INNCORRECT fashion, right? Since there seems to be no LAW that requires an American who earns a SALARY, or a WAGE, on his or her LABOR to pay Federal Income TAX, perhaps there's been a COMPLETE misunderstanding by our government, correct?
It seems as though our lives HAVE been controlled by 'contracts', which you stated in your Update, huh? But if these CONTRACTS actually prove to be NOT VALID, then almost everything we believed to be TRUE in America is really one big LIE, correct?
If that were the case, then the USA would COLLAPSE, wouldn't it? Because once a LIE is exposed, it will create opinions; NEGATIVE OPINIONS! These 'negative opinions' will eventually trigger the COLLAPSE, right?
It's almost EXACTLY what's taking place in the USA right now, isn't it?
WOW! What an exciting time in our country's history, and in its present, & even in its FUTURE, huh?

First, let me start by thanking you for your comments. Second, yes I do have "proof" that my payments were received prior to the "due date" posted on my statement. Due to the ability to track receipt of Priority Mail I have on a number of occasions called to complain that I was charged interest and yet my payment was received prior to the "due date". On those occasions I have had my account credited the interest and made to feel that they had done me a HUGE favor. Yes, I'm aware of the correct way to pay a bill...I'm nearly 55 and have been paying bills in a timely fashion for most of my life. And if by some chance I've misunderstood that policy; then doesn't it seem that it may be just a little vague? Don't most people interpret a due date of the 15th for example as meaning that "if I get my money to them by the 15th, I've paid by the due date"? How is it that "due date" requires close study to determine it's true meaning? I have a college education...how do people that have not had the advantage of perhaps even high school manage these vagaries? (I don't mean that last statement to be condescending...it's an honest thought.) It's my opinion that the banks don't care...they rely on us to be passive; to just give up...to quit fighting. It does seem to be a never ending battle to ensure that we are not being taken advantage of. Yes, it is our responsibility as adults and Americans to know what our "contracts" say. The problem is that our lives have become one big contract and it's nearly impossible to stay current on all fronts. Why should I worry that if I send a payment in TEN days prior to the due date that it won't be credited on or before the due date? Why is it my job to monitor their a companies mail department? Why should I worry that if I send an overnight express mailing 5 days prior to the due date that it would be held an additional five days just because they are making so much money that they don't have time to count it all? It's ludicrous. I'm just a normal everyday housewife, not a CPA, not a banker, not anyone special. Just someone who works really hard for her money and wants my country, my bank, my vendors to treat me fairly. I don't want to be the "due date" police. Am I alone in feeling this way?

Go to Prision. Yes Mr. Conspiracy theory is at it again, I really want to know what they put in your water in Colorado. But now Karl is not only just posting consipracies, but giving advise that will in fact end you up in prision. You MUST pay Income tax, this "urban legend" pops up every tax season. The Code(and yes Code is Law) that requires it Title 26 U.S.C. Some specific sections are 26 U.S.C. 1, 26 U.S.C. 1(a).
Karl, if you truly believe you do not have to pay income tax I challenge you to do
the following.
Send in the following to the Admin of RipOffReport this includes
Full Name
Address
SSN
Along with a sworn declaration that you are not required and do not pay Income tax
The Admin will then post a response here that says you did in fact do that and your information and declaration was forwarded to the IRS. You then need to post the offical response from the IRS, that is if they have computers in Federal Prision.
Of course this only works if you actually do have a job and earn enough that would require you to pay Income Tax.

So as to that issue. Payments are covered under the Fair Credit Billing Act.
4 164. Prompt crediting of payments.
Payments received from an obligor under an open end consumer credit plan by the creditor shall be posted promptly to the obligor's account as specified in regulations of the Board. Such regulations shall prevent a finance charge from being imposed on any obligor if the creditor has received the obligor's payment in readily identifiable form in the amount, manner, location, and time indicated by the creditor to avoid the imposition thereof.
"prompt" has generally come to mean upon receipt, IF you are following the instructions for payments. "White Mail" is mail that was not sent per the instructions, and yes by law they can hold this for up to 5 days. Generally a creditor will have special mail(overnight,priority) sent to another address. So for example if BofA requires you to send it to a different address and you sent it to the standard address it could be considered "White Mail" and held.
If you followed their instructions for Priority Mail and sending in payments, and they still held your payment you may have a good case to sue them under the Fair Credit Billing Act.

It seems as though 'Federal Income Tax' is a TAX for companies & corporations on their 'PROFITS' & their 'GAINS', and is NOT a tax that is REQUIRED by LAW for a typical American worker who earns a 'SALARY' or a 'WAGE' on his or her 'LABOR', according to all the information in that documentary.
Former IRS Agents, Tax Attorneys, Jurors who sat on Tax Cases, & even a Congressman (Ron Paul) all attested to this in that documentary by Aaron Russo.
EXAMPLE: If you own a Painting Store, and you purchase $1 MILLION dollars of paint from your suppliers for the year, & mark it up by 35% to make a profit, your PROFIT, or GAIN for the year was $350,000, correct? You will pay TAXES on the $350,000, not the $1,350,000.
So, the PROFIT or the GAIN is what Federal Income TAX is intended. (For companies & corporations). The PROFIT, or GAIN on the sale of $1,350,000 was $350,000, right? So THAT'S what is TAXED, & that's what Federal Income TAX was intended, according to all the documentation.
Now, if an American worker chooses to 'VOLUNTARILY COMPLY' to pay Federal Income TAX, he or she may do that!!! It's VOLUNTARY, according to all the information in that documentary.
Now try and shift gears and think of this- If you DON'T own a Painting Store, but you are a painter who goes into people's homes and paints their bedrooms, bathrooms, family rooms, etc., you AREN'T selling them a product, correct?
You are providing your LABOR to them, & in return you receive a WAGE, or a SALARY, as a result of your LABOR, right? There WASN'T a PROFIT or a GAIN because you had to use your arms & legs & skills to do the painting, wouldn't you agree?
So, the money that you receive from the people who had you do the painting isn't supposed to be LEGALLY taxed by the Federal Government because it is NOT a PROFIT, or a GAIN! It's a WAGE that was a result of your LABOR, do you understand?
If you want to pay, and file, a Federal Income TAX Return, you may do so, but there ISN'T a LAW that says you must do so, according to ALL of the information in that documentary. There are only CODES for those who CHOOSE to File & Pay Federal Income TAX, according to all the facts presented in that wonderful documentary by Aaron Russo. You should watch it and SPREAD THE WORD.

P.S. If you, or anyone else doesn't BELIEVE any of this, then you should go down to your IRS Office and ask for a copy of the 'LAW' that requires you to pay Federal Income TAX. Not the CODE- the LAW that says you MUST pay it. If they can't provide you with the LAW- then HOW can it be AGAINST THE LAW, right? Maybe this is why people are WINNING their TAX CASES against the IRS, huh?
There is a CODE in our neighborhood that says if we see CRIME happening that we should report it. But it isn't against the LAW to not report a crime if I see it happening. A CODE is NOT a LAW, get it? If my neighbor's home is being broken into right now I can watch it happen and watch them take all of their belongings if I want, and I don't have to report it because there isn't a LAW that says I must do so, correct? However, I would report it, and then I'd follow the criminals in a 911 Carrera and I'd take my cell phone, & I'd let the Police know where they were!!
The criminals wouldn't be able to outrun me because I'd be in a faster car, right?

Corporations will sometimes hire Law Firms
When they are sued it's just what they will do
Most will retain just one Law Firm
Others might even hire two!
All lawyers get hungry, let's face it
They use plastic for that mid-day lunch meal
Their clients run corporations who are big-shots
CEO's who will LIE, CHEAT & STEAL!!!
But these Law Firms will receive big retainers
It's the MONEY they want and they need
They're no different from the ones they're protecting
It's a GAME of DECEPTION & GREED!!!
Now the PEOPLE are starting to take notice
And these Law Firms someday might regret
That the ones who FINANCIALLY INJURE
Have their names now in poems on the NET!
