Bank Of Currituck - April Jenkins - Ernie Bray - William Meiggs tries to Bully & unlawfully threaten homeowners by lying about Loan Modification Moyock North Carolina

I called April Jenkins and left a message on her voice mail. She called back within several minutes. However, she had me on the speaker phone...with other people listening to my problems and inquiries. Ernie Bray (VP) was listening and jumped right into the conversation and started yelling at me and exclaiming that they still have the note on my loan and that they never sold it. I don't remember asking or inquiring about my note. (I guess he assumed that I would ask that question since that is a delay tactic on a foreclosure). I was inquiring about a Loan Modification due to the fact that I lost my Engineering job in Oct. Our household income had been cut more than 50%. They were lying to me about my loan...and then they said that they won't help us on that because it is a volunteer basis, and they weren't volunteering. They said that they ALREADY modified my loan last year. I corrected them and said that the loan was a consolidation loan of first and second mortgages. They argued and tried to convince me that I didn't know what I was talking about. I finally won that battle. Then they said that the Loan MOD program isn't for my type of loan...only for a Fannie or Freddie type of loans. I argued back and stated that the FRANNIE/FREDDIE loans are 'refinancible'...I have a conventional loan and meet ALL eligibility requirements for a MOD. They just kept repeating that they were not going to do that and lose money and that they helped us enough. And, if I keep trying to pursue the Loan MOD, they will start the Foreclosure proceedings. I told them I wasn't going to back down. They bullied/threatened me and said that they are going to start the foreclosure process tomorrow and take my house next week. I'm only one month behind. I had just gotten a certified letter yesterday (3-11-09) that stated that I am 30 days delinquent on my loan and that I need to make a payment within 30 days before they would take any action. All they do every time I call is gang up on me with other people in their office on the speaker phone and with the door closed. I can reassure you that they would not talk to me like that if I was standing there in their lobby! I had already gotten my facts together about the Loan MOD from an attorney, so I know my rights. I have an appointment with a HUD counselor on Monday 16, 2009 to discuss and fill out forms. She said that I have every right to a Loan MOD. They have done this type of ganging up on me several times in the past via speakerphone bully-tactics...using unlawful threats. I'm sick and tired of being treated like this...I am the customer. It is illegal to unlawfully threaten a consumer. I've had enough verbal abuse from this bank!!!
