Hi im reporting chase because they gave me a credit card i was making the minimum payments, but situations got difficult and i was left with 3 kids to raice bymyself. I moved from the adrres they had on file 2 years ago and i never received any collection letters to inform me of the status on this account. I work from 4am to 8pm to sustain my 3 children i pay a babysitter and and have alots of expences from them. I just got back to work from being 5 months on dissability and i just got my first paycheck and 190$ was missing I asked my employer and they told me my salary is being garnishedby chase. I was shocked because they are taking 25% from my check Im the only house hold in my home, i dont know what to do and i dont even know how much the debt is at this point. The only thing I know is that i pay 1000$ rent for a 2 bedroom apartment and i have utility bills and i have to also feed 3 kids and chase is taking the food away from my kids mouth now that the holidays are coming I wont even have money to buy them gifts. I m really sad and desoriented because i dont know what to do to stop this ripoff, because I dont know how much they say i owe them . Im willing to pay 50$ a month because being a single mother of 3 is not cheap. Please Help.

Dear Concerned Mother,


It sounds as if you are in a terrible situation but I cannot agree with you that this is Chase's fault.  When you moved your bills were returned to Chase.  They would have no idea how to find you.  What are they supposed to do, just let you have the stuff you charged?  The agreement when you get a credit card is you charge the merchandise, get a bill and pay for the bill.  If you don't pay in full you can pay a little each month. The agreement isn't pay what you can and if things get tough then just keep the stuff you bought and they'll pay for it.  Come on, you know this isn't a rip off.  You said you were on disability for several months.  During that time you should have realized you weren't getting your bills. You should have called and worked this out. I think you probably figured they wouldn't find you and you left it at that.   I agree there are laws in place if you weren't properly served, however you owe the money and Chase didn't do anything wrong.  Instead of wasting time trying to get out of a debt you really do owe, why don't you get the father of your kids to help support you.  It is his obligation to do so.  Now THAT is a rip off..... Father's or mother's who blow off child support.

Nothing you say on any thread is ever about the subject, nor does it make sense. 

For years there has been a well known person here that thinks the world is out to get him and his Mom.  You make him look like a rocket scientist.

Silly, This is your fault. You charged on a credit card, moved and thought it would just go away? 

How is this Chase's fault?  Did Chase force you to take the card?  Did Chase force you to charge things instead of paying cash?  Did Chase force you to ignore paying for what you charged for 2 years??

Ask your boss for contact info of what collection company is garnishing your wages. Then call those people to find out what the balance is.

Suggestion...

Okay the first question is at any time were you aware you were being sued for the debt?  That is were you ever served notice from the court stating you had a suit pending.

If the answer is yes and you just decided to not show up, then unfortunately they got a default judgment against you.  At this time your only choice would be to try and work out something with the creditor where you can pay it off without wage garnishment.  But if they have a judgment and your state allows 25% of your wages to be garnished, it is very unlikely that they will accept only $50 a month, if they are currently getting $190 per paycheck.

Now, if you have absolutely NO knowledge of even being sued, you may be able to have the judgment vacated.  To do this you are going to have to get information on the judgment.  Your employer should have a copy of the Garnishment Order where you can track down where the suit was filed.  Once you have that you need to find the Proof of Service from the Clerk of the Court where the original suit was filed.  If you can show that you were never properly served(such as invalid address, or description of person is not you) then you have valid grounds for the motion.  If you do get the judgment vacated the garnishment will stop, and you should be able to apply to get your wages returned.  However, the creditor can still file another suit and if it is a legitimate debt you may end up in the same situation again.
