BUYER BEWARE!   Bard Optical / J.A.K. Enterprises, Inc. made glasses for me that were so defective as a result of poor workmanship that they caused me two years of double vision and migraine headaches.  I had numerous tests and doctor visits including a MRI of my brain to make sure there was not a tumor that was causing my double vision.  Finally my Ophthalmologist tested my glasses and found that the cause of these significant problems was the glasses.   

These glasses which were made at Bard Optical's own lab, had more than 4 times the recommended amount of base down prism in my right eye and more than 5 times the recommended amount of base down prism (set by the American National Standards Institute- INSI)  in my left eye.  This created a vertical imbalance that my brain and the muscles in my eyes could not overcome and the result was double vision and migraine headaches.  

When I contacted Diana J. Hall , the owner of Bard Optical, she responded with a letter that stated the prism is normal in lenses of this nature and that Bard Optical's services met the applicable standard of care.  In my opinion their standard of care is not what it should be.  I have a letter from my Ophthalmologist stating that it was the glasses made by Bard Optical that caused my terrible symptoms.  I had new glasses made at a different optical provider and the double vision and migraine headaches disappeared.  At that point there was not a doubt in my mind that it was the glasses that caused me years of suffering.  

After dealing with several lawyers that only ended up only wasting most of the time allowed to file a lawsuit, I filed a small claims lawsuit.  This ended up to be much more difficult than it should have been.  Bard Optical has a corporate office that has no signage of any kind on the building and it has the appearance of a vacant building which made it next to impossible to serve them the notice of the lawsuit.  It took almost two months from the date I filed to have them served. 

When they finally did get served, Michael A. Hall attorney for Diana J. Hall, filed a motion to the court to have the case dismissed.  He stated that Bard Optical is the assumed name of J.A.K. Enterprises, Inc. and that the lawsuit should be against them instead of Bard Optical even though both companies have the same address and Diana J. Hall is the President of both of them.  There is no other name listed on the Bard Optical website so you would never know what name to put on a lawsuit until you try to take action against them. 

At the hearing Michael A. Hall went into the courtroom to talk to the judge before I was allowed in the court.  When I was called into the courtroom, I asked the judge if he would allow me to keep the original filing date and then change the name on the lawsuit to J.A.K. Enterprises.  He made his decision very quickly and granted Michael A. Hall his motion to dismiss.  This decision made it impossible for me to refile because it put me outside the time allowed to file a lawsuit.  I then said to the judge "your honor if he can split hairs and get this dismissed on a technicality, then why can't I do the same?"  He asked me to explain and I told him that when Michael A. Hall sent me the envelope containing the Motion to Dismiss, it had a signed statement by Mr. Hall that he, under penalties of perjury, upon his oath served a copy of the motion to me by regular mail, proper postage prepaid.

This statement was untrue.  I had to pay thirty five cents to receive the envelope because there was postage due.  Instead of allowing me to prevail because he did not tell the truth under oath, the judge laughed and turned to Michael A. Hall who said he would repay me for the postage.  He was allowed to win on a technicality but I was not.

After we left the courtroom, Michael A. Hall handed me thirty five cents. The total expenses from all the medical tests and the cost of my new glasses was $9520.96 and he had the arrogance to hand me thirty five cents!!!  I hope that by reading this you will be armed with the knowledge to protect yourself and the people you love.
