In 2007 I was diagnosed with a life threating disease and was forced to leave my job and we fell behind on our mortgage payments(2 1/2 months) So in December we called Beneficial and asked what could be done to get us current. They said make a payment of $1,200 and change and that what would bring the account current, they would take the rest of the past due balance and put it on the back of the loan and our next payment would be do March 24, 2008 that was perfect so on December 21 they took the money and all was suppose to be good. March 20, 2008 the phone rings and it is Beneficial, they are claiming we are 26 days past due I said that is impossible the payment is not due until March 24 they said according to their records it was due February 24 we explained the contract that we entered into in December and they did not seem to care so I said fine make the payment I was going to make it in 4 days anyway and we would call the gentlemen we made the contract with on Monday and get everything cleared up, big mistake, huge mistake once we agreed to pay we voided the old contract and entered into a new one but I did not know that at the time.
On Monday we called Alex (the guy we made the contract with) and left a message. Well this went on for months he would not take our calls or return our calls we finally spoke to some that agreed to take our proof and submit it to the review department. Months go by we get a phone call from Beneficial collections department and they tell us that they chose not to honor that contract(I was not aware you could pick and choose what legal binding contracts you were going to honor). Then they began foreclosure proceedings. We fought them for months they were instructed they had no choice but to honor the contract and they promised they would and then did not we were getting nowhere.
In late November we got a phone call from them and they say they do not want to foreclose can we work this out we say sure what choice did we have.You will never believe what they suggested you guessed the same deal we got shafted on the first time. I explained why we were hesitant and they kept assuring us that that was a fluke and would never happen . So I called their attorney and they told me that because we were in foreclosure everything had to go thru them so there would be court papers with the terms on them, so we called Beneficial back and agreed to make a payment of $2,600 and change that would bring the account current, all other fees and charges were to be tacked onto the back of the loan the first payment was due February 24, 2009. Guess what non of that occurred my account is not current, all the fees are still there the only thing that did change was they stopped the foreclosure and I am still waiting for the papers from their attorney.
Now they are foreclosing again. Now I have had enough so I contacted the FTC, they said that what they did amounts to Felony Theft by Deception and Fraud, they said I should contact the Attorney General's office, the Bank of Commissions for my state and an attorney. I filed complaints with all of them and over the next few days I have scheduled interviews with 4 news stations (3 local and Fox News) this company has to be stopped, they are destroying peoples lives and getting away with it I am prepared to do whatever it takes to stop them. I am trying to put together a class action lawsuit against the entire company not just the mortgage division because they have the same corruption no matter what division, if you have been wronged by this company and want to come forward and be part of the lawsuit please get in touch with me.

If you'd rather not send your phone number, I COMPLETELY understand. And I REALLY don't want ANYONE doing something they don't want to do or don't feel comfortable with.
I hope to hear from a LOT of people that have had problems with these predators and also keep in mind that IT DOESN'T MATTER IF IT WAS 10 YEARS AGO, if you got screwed or the runaround I'd like to hear from you. And if you know anyone else you think needs to know, please pass this info along.

BUT PLEASE remember this WILL NOT happen overnight and could take a while to file, there is a LOT of crap to organize and present to an attorney. And here's the MAIN thing to keep in mind just because we all are unhappy about HSBC, BENEFICIAL, etc... DOES NOT mean it can be a class action, we need to show a PATTERN of deception, fraud etc...
Also, please try to find my original report and add your comments to that post so I can keep posting updates on just that post, search for HSBC Brandon Florida, and the author in Ohio.. In the meantime I will contact the owner of this site and see if they will allow me to post my contact info but I would guess if they do let me it would on my original post.

Read this carefully and you'll see how to contact me and what I need. If you do a search here for HSBC and Brandon Florida you should be able to find my initial report.
A class action is a slow process but I am lining up others that have been given the run around by these predators know as Beneficial, HFC, HSBC etc...
I can also tell you that regardless of what you might read from some others saying "Beneficial doesn't have to do anything they don't want to" it's NOT necessarily true. If we can show a PATTERN OF DECEPTION and UNFAIR TRADE PRACTICES, like, promising loan modifications if you do "X" and you fulfill your part of the agreement and then they renege, we have potential grounds for a class action.
Anyways here's my story, see if it sounds at all familiar.
I was offered a 6 month trial modification that would convert to a permanent modification if "you make all 6 payments on time" I did and then they backed out. I have come across A LOT of people that were promised the same thing and have started to collect names, addresses, phone numbers, contact information and details of your experience while dealing with Beneficial, HFC, HSBC and all other subsidiaries of HSBC, to begin to develop a legitimate class for a potential full blown class action, lawsuit.
This won't be easy but we gotta start somewhere and be serious about collecting any documents that would back up our claims. I need sworn, notarized statements that detail the experiences you, and anyone else, have had while trying to get a loan modification from any entity owned and or, operated by HSBC or any of their partners.
So, if this is something you're willing to do I need to speak with you ASAP!
Also, if you know or can find others that have been through the HSBC wringer, and lied to, promised modification that never happened or any other type of bad experience PLEASE let them know about what I am trying to do and have them contact me at Beneficial"the at sign"mail.com. But understand I will need sworn, notarized statements that explains in detail your experiences while dealing with Beneficial, HFC and HSBC etc...
These statements don't need to be anything fancy you can even hand write what happened to you during your dealings with Beneficial, HFC and HSBC. Just write or type what happened take it to a notary and sign it in front of the notary and then have them notarize it.
DON'T embellish your story keep it honest, simple and straightforward. Include dates, phone calls, who you talked to and any other details you feel we might need to know, BUT, keep in mind the simpler the better, and if you have paperwork that you feel supports your statement attach it to your notarized statement and include in your statement a line that says something like "see the attached documents".
That's where we are right now, and any help you can provide will be greatly appreciated! This will be a long process but the sooner we start the sooner we might get some relief from the predator know as HSBC.
I look forward to hearing from ANYONE that wants to be involved. And PLEASE pass this information along to anyone you think might be interested in this action or has suffered because of the conduct of Beneficial, HSBC, any of its subsidiaries or any of their partners. And if anyone has any information that links Beneficial, HSBC etc... to ANY other financial institution we'd REALLY like to hear from you.
Again, I urge you to pass this information along to ANYONE that might be interested in becoming part of this action. We will need a LOT of "Plaintiffs" to make this work. Also feel free to contact me with any questions or, even better, suggestions.

In 2009, HFC threatened to foreclose on her house because we (the beneficiaries) refused to pay them.
I am not sure what action the Class Action Suit was going to take, but we received a letter from HFC last week stating that the mortgage was DISCHARGED!
We own the house now and will decide what to do with it since we all have our own homes.

I currently have a pending lawsuit against HFC/HSBC filed in USDC Middle District of Tennessee which I filed pro se. It has been in court since Sept. 2010. I am now in need of an attorney to assist me with this case because it has gotten beyond my ability to handle it properly. I have been unable to find one in my immediate area qualified and willing/able to take the case. Ive come way to far to give up now.
This company foreclosed on my home 3 times, all without merit. The first two times I paid their ridiculous amounts to stop the sale of my home. Both times they lied about making account current. They kept adding more charges and always showing account past due no matter what I did. The third time I said enough is enough and filed suit against them.
But Im in need of legal help/advice now or my case may get dismissed due to my lack of legal knowledge and ability to meet court criteria.

Fact: HFC/HSBC has violated the law by NOT disclosing reasonable information to the customer. It doesn't matter that the people were late in making payments. The customer, with good intent, tried to recitify the situation by contacting the company for information to resolve the issue and HFC/HSBC failed to disclose information that would allow the customer to reaonsable resolve the issue. These are not whiners. These customers were acting in good faith; HFC/HSBC was not.
If you think HFC/HSBC is providing good service to its customer, why don't you go work for them. Oh, that's right. HFC/HSBC isn't an american company. You would have to move to CHINA to work for the Hong Kong & Shanghai Banking Corporation (HSBC).

FACT 1: Borrowers turn on the collections efforts when they fail to make payments.
FACT 2: Lenders have every right under the law to collect what they were promised.
FACT 3: When the lender begins the collections efforts, the average deadbeat comes up with any imaginable excuse to discredit the lender but the lender was so great when they approved you loan, right?
FACT 4: These whiners have nothing more than a plain and simple failure to perform under the contract they signed matter to which the lender has begun collections efforts.
FACT 5: When you don't pay your bills and YOU turn on the collections efforts...quite obviously YOU have NO CASE.
THAT'S WHY LAWYERS ARE NOT BANGING DOWN THE DOORS TO REPRESENT WHINERS. YOU HAVE NO CASE TO WIN, THEY CAN'T MAKE MONEY.

This is criminal because it didn't happen once, it didn't happen in just Minnesota, it is HFC/Beneficial company culture not to disclose this information, in writing or on the telephone. It is the continual and blatant failure of HFC/Beneficial to disclose this information under reasonable circumstances that violates the law. If other lending institutions operated this way, it would be considered normal expected operations for the lending community and the system would collapse. It is NOT the norm for other lending institutions and therefore, what HFC/Beneficial is doing is criminal.
I don't have a loan with HFC/Beneficial. I have never had a loan with HFC/Beneficial. I don't work for HFC/Beneficial. I am not a lawyer. I don't even work for a bank or lending institution. I am a consumer who is concerned that this company is allowed to operate this way.
Failure to disclose, in writing, such financials matter is in direct violation of the Federal Trade Commission and lending laws. HFC/Beneficial should be fined severely by the US government. If the Feds knew how much money they could get from HFC/Beneficial for these violations of the law, they would be taking action now. Forget contact your state representatives, contact the Federal government. Let our Federal government know what HFC/Beneficial is doing and point out, there are fines to be had.

We've had this exact same scenario happen only we went behind because they refused to aknowlege we had homeowners insurance and tacked on their insurance. Then when we wouldn't pay it (because we already had insurance and had it the whole time) they held our payment and wouldn't apply it to the loan thus acessing late fees that they never credited us back. I've got a foreclosure date of 1/1/12 after being promised that the late fees would be tacked onto the end of the loan and that no further payment was necessary for December. I have an appointment with my lawyer and because of your post I will be contacting my attourney general

Contrary to what the clown stated above, (obvious HSBC employee) there are a lot of people this company has taken advantage of, more than likely during vulnerable times in their lives, such as myself. My business professionals who had hit some bumps in the road. The first being at the inception of our mortgage a few years back. I was not getting a paycheck, and we had just depleted our savings and racked up our credit card as my wifes salary wasnt able to cover the mortgage and living expenses. At this point in time, we were contacted by a Beneficial representative regrading a mortgage refi to assist with the payoff of our debt. After seeing the terms, we had walked out. In turn we received countless calls to come back and reassess their offer, as it will only be temporary, and as we wont have any other options. Well we did, and we were promised that there are a few new programs that are coming out that would be perfect for us and reduce our rate from 10.3 down to as low as sub 6. At the very least, as long as we make our payments on time for 6 month periods the rate will be reduced accordingly. Well here we are, 4 years later, Real Estate taxes increased 110%, wifes business not doing well at all due to the economy, and still at the exorbninant rate. We are on the brink of foreclosure and they will not work with us, stating that we have too much expendible income. They will not however share their information leading to those results.
I have also submitted a complaint with the NYS Banking Assoc. if anyone else has any suggestions it would be appreciated!

Listen I am not talking about a case built on people who simply do not want to pay their mortgage I am talking about a bank who in their original contract states that they have these programs and they are available to their clients at anytime so that no collection activities have to occur and then when hardship occurs they refuse to honor their side of the contract and allow the person to take part in one of the programs that was promised to them in their contract. I am talking about a bank who sends out appraisers that falsify appraisals and tell people that their house is worth more than it really is so the bank can get more money and leave you upside down on your house so you have no equity or ability to get away or to refinance with another bank. I am talking about a bank who changes some of the terms in your original contract without your knowledge or consent and then forges your name to the document. I am talking about a bank who takes out multiple mortgages on your home without your knowledge or consent and forges your signature on those documents. I am talking about a bank who holds your on time payments(left your bank account before the due date) until they are late so they can add additional charges and interest. I am talking about a bank that applies your payment to someone elses account and then takes months to correct it and then goes and reports you late ruining your credit and charges you fees for a missed or late payment and refuses to correct their mistake. I am talking about a bank who lies commits fraud, forgery, and theft. That is what this case is about. That is why this bank has been sued at least once that I know of and lost and had to pay out millions. This case is based on facts and broken laws.
There are a lot of hard working, responsible people out there who could never imagine that something horrific could happen to them leaving them unable to provide for themselves or to go out and get a second or third job. These people ask for help and there is nothing wrong with asking for some help especially when that help was promised and then when it is not delivered it can be devastating. So until you have walked a mile in their shoes you should not and have no right to pass judgment, one day you might find yourself needing help.

The reason any attorney won't get involved in a case is because they are fairly certain THERE IS NO CASE! If there is NO CASE, they won't get any fee! Yes, its that simple and no, there is not some ridiculous "grand conspiracy" to get anybody!
The "case" you guys are trying to make is that you fail to live up to your contractual obligations and the lender then begins their collections efforts. You wanted them to lend you the money but when you don't make the payments YOU AGREED to make on time, then you cry and whine because the lender begins collections efforts!
No lender is under any obligation to "help" anyone or to "be understanding", "feel sorry", "give a break" to anyone...PERIOD! The cold hard facts of life are when a lender agrees to lend us money, we agree to pay it back with payments on or before the due date...PERIOD! It doesn't matter if when have a job, get sick, experience family situations or any other excuse...we are on the hook for that payment when it is due and not when we want or can pay it!
I know so many of you aren't going to like what you've just read but it is what it is. If you are having problems meeting your obligations due to cash flow...then there is only ONE way to solve that problem...you INCREASE CASH FLOW! You get a second or part time job or the spouse gets a job, whatever. Sure, it isn't easy but whoever said life was?
My sister's husband passed away 12-25-08 and she has been dealing with Beneficial/HSBC since. She has hired, and fired, two attorneys because they seem to tuck their tail and run from this company.
So we filed complaints with the NC Attorney General's office. They investigated, told her to hire an attorney because they do not handle "personal cases". We have also filed complaints with the NC Commission of Banks, who has been investigating this case for 15 months now. They have contacted several people at HSBC Corporate and requested information, which has never been received. My sister has had two foreclosure hearings that have both been postponed, one by HSBC and one by their Trustee.
She does not have the money to keep hiring attorneys that do nothing. We have contacted the media, but have not had a response. We are definitely ready for the next step, because they told her that her house would be sold June 2, 2010. I have lots of info to give on this company so feel free to contact me about a Class Action Lawsuit....and soon!!!

My husband and I have had nothing but grief with HSBC Beneficial. We took out a 2nd on our home in about 2004. At that time it was with HFC, who later was bought out by, or became, HSBC Beneficial. That's when the trouble began.
When HFC had our note we could see the balance going down monthly. Then HSBC came into the picture. Every month the balance is MORE than the month before. At present we owe more than we did on the original note! It's ridiculous!
No one will talk to you and forget it if you want to get any kind of documention from them. Supervisiors will not call you back, no one has any original loan documents or is able to give you a full accounting of payments made. If they do provide you with anything it is in a format that NO ONE can discern. And even then if you can even slightly make it out it doesn't compute or is incomplete.
If anyone has started a Class Action Suit against them, sign us up! If not, let's get this thing going. We are more than tired of being ripped off by these guys.
