I hired these guys to create an e-commerce site. Everything was going great, they got paid in full and were working on the site. Granted they were way, way late, but they were working on it.

Right when we were about to go live, I am told that I owe them money. This was a surprise to me since they got paid in full per the contract. So I asked about it. They sent me an invoice where they created things on the site I never approved. So I asked about it. II got a very pissy email back. I even went back through my 400+ emails back and forth and nowhere did I request the strange changes.

They were also off on their ETA by about 5 months. They kept stringing me along. 

Anyway, the site never went live because they are keeping it hostage. I asked them to NOT access the server, and as soon as I did, they went in and changed things. Now, they claim they did not touch the site. Whether it was BOP that accessed it or their contractors, I don't know, but someone did because it is no longer working.

When I questioned them about the site not working, I was told it was their site because I did not pay for it. Ummm... what? I have the checks to prove they cashed the funds in full.

Then they turned around and said they have nothing to do with it because it's not their site, it's mine. Ummm... what? They just said they were not giving me any server access information because I did not pay for the site.

They also lied along the way and told me things were completed that were not, such as the emails for the site. Never set up, except for one.

BOP doesn't know which side of their mouth their lies are coming out of. 

When I asked them to honor their contract they told me I was extorting them and they wou ld go to the police. My response was to be sure to tell them that I am not the only one they've done this to.

 

They got paid in full, about $23K and did not deliver a working site. Complete scammers. Do not do business with them. RUN don't walk.

Clearly Big Orange Planet is extremely good at spinning tales. The statement above is one of the biggest ones yet. Complete lie. When I complained that BOP allowed each customer to have 30,000 stores for ONE single fee, BOP said too little too late. Never once did they say they would make any changes. In fact, as the website stood last, it allowed multiples store for a SINGLE fee.

How convenient that currently this particular portion of the website has been sabotaged. However, records from the web hosting company prove they did access the server and made changes even though they are falsely claiming otherwise.

In conclusion, not matter how much BOP tries to deny it, or not address it, they have done this to other clients. This scheme is part of their formula in doing business.

Stay away or this will happen to you, guaranteed.

Changes...

How can changes cost money when the site was never completed? There was never any deviation from the original plan. Had the site gone live and had the changes been made after, then yes, completely agree.

In addition, if these "changes" were costly, one would think the "expert" would inform the client of the cost in advance. Nothing of the kind was EVER done in 400+ emails of conversation.

Again, BOP is full of lies and guilty of unlawfully accessing a server.

Lets not forget that Big Orange Planet admitted in an email it misappropriated funds to defend against a lawsuit. Perhaps this is why they are holding the site hostage. Instead of using the funds to build the site, they used it to defend another fraud they committed against a different client of theirs.

ok ye gods, its like talking to a 4 year old here,

anyway- correct multiple stores with one sign in was in the contract- but then  goflystar 

demanded each store for a user be charged on a per store basis- a substantial recoding job. When presented with the invoice for this recoding, the reaction as noted in the primary post was berating the idea of multiple stores was ever in the contract in the first place, though it was written in by goflystar.

Yes we did, I quote.

1) “There is no evidence that we “hacked' whatsoever. As we have
 categorically stated we did not. Just not how sane people operate!”

    2) “As per the contract goflystar signed until they have paid for their site
   they do not own it. Again, standard stuff.”

   So accessing our own site – not unlawful. But again, we did not, and goflystar (aka Mona Smith)
   has no evidence we did. 

*Big Orange Planet also did not address their extortion attempts for
changes NOT approved. *

As shown in our primary rebuttal above we detailed the changes goflystar requested, we
implemented them and then goflystar refused to pay for them- they couldn't and wouldn't-
easy to deny one's own spoken words, a little more difficult when written down.

Oh and by the way, after the site launched, we were offered 25% equity by goflystar to make it a success,

Let's assume, as Big Orange Planet asserts for the sake of argument, that multiple store sign ups for each individual was included the original contract - why did they claim additional work hours for this? It would have been included in the original price. 

Throughout our conversations BOP regretted the contracted price because BOP's emails state that a site like this would cost $150K to build. Clearly BOP got in over its head, clearly they regretted the price quote and the only option they had was to try to extort more money by holding the site hostage; by claiming additional work, when it was in fact included in the original contract.

Big Orange Planet can't keep its lies straight.

Of course I liked the site as it progressed. The rebuttal is full of untruths. Surprisingly they did not address the unlawful server access to disrupt the site. Nor did they address the fact that they have done this to someone else. Clearly a pattern of fraud and deceit.

Big Orange Planet also did not address their extortion attempts for changes NOT approved. 

Big Orange Planet has a clear pattern of this type of fraud and abuse. I am not the only client this has happened to.

Addressing the alleged breach of contract

 As per the contract signed any additional coding beyond the original project scope incurs additional cost. 

This is standard. It should be noted that not only did Goflystar sign the contract they also took time to make alterations to the contract. They were perfectly aware of every aspect of the contract they signed, as it should be. 

The original scope of the site was vast and we covered it in full. Creating a beautiful working e-commerce site, which we tested on a few folks and received the following comments on: 

March 13th-from site 'owner'Goflystar-OMG Ally!!!-Okay... so I just checked the site and it is amazing...

April 9th again from site 'owner'-Goflystar- OMG,OMG,OMG-I am listing s*** and it is f****** AWESOME!!!!Just in case you can't tell... I am excited.

April 19thVery cool, nice and simple.

April 17thHow cool! It's super cute and works really really well! Job well done!!!!!” 

 

Meanwhile along the way Goflystar decided to make some additions beyond the original project scope.Detailed below are the some of the additions requested via email, along with the relevant contract terms:We figured since goflystar 'went through 400 e-mails and nowhere could she find anywhere she requested the strange changes', we'd take a few minutes to find them for her. (some of this is really quite funny) 

a) 12/12/12 See how Etsy’s top tab shows below?I want our top tab to show GoFlyStar and (inline image)

But we need to change the look of the envelope (correspondence), heart (favorites) and store. The order should also be favorites, store, correspondence

b) 2/6/13When clicking on Buy, something like this should appear, with the main
categories on the side and the latest listed items:

c)4/1/132. We need to limit one store per sign in. It is allowing me to create a brand new store every time. Since we make money off the membership fees, if a seller wants to sign up with another store, they need to pay another fee.

Original contract states (clause added by Goflystar): 15. The ability for the seller to sign up for multiple stores with the same email address.



And then 6/17/13 -Goflystar- Multiple stores for A SINGLE USER????? Absolutely not. Why would I do that?(= priceless)

 

d) 3/26/13 it will not allow me to change from one subscription to another. Both highlight as shown below.

 

6/7/13The price change, I have an issue with that too. It was originally set up in
the original contract.

Original contract states (clause added by Goflystar):1. Sellers can sign up for a monthly fee of $4 and list as many items as they want for thisfee; or list an item for $0.15 each. They have to choose one option or the other.

There are a couple more douzies as well believe me.

 Obviously these additions incurred additional cost, as per the contract. However when the additons were complete Goflystar then refused to pay for them,putting them in clear breach of contract. 

The scope of the original project was paid in full. But the additions (which were considerable) were not paid at all. 

As per the contract Goflystar signed, until a client has paid for their site they do not own it. Again, standard stuff. 

On Wednesday 10th july we received a crazy email from Goflystar accusing us off all manner of things including hacking “their” site. 

  1. Until any client has paid for their site it is not theirs', its ours', this applies to all sites we make and is very clearly stated.

  2. Why would we hack our own site? Makes no sense on any level. If we wished to make alterations to the site to force Goflystar's hand in payment, which is what we are being accused of, we would simply take the site down. 

There is no evidence that we “hacked' whatsoever. As we have categorically stated we did not. Just not how sane people operate! 

Therefore what we now have is the following situation: 

 A client who refuses to pay for the work they ordered,

Who does not yet own the site, but none the less has changed access passwords(confirmed by web server host support)

. Therefore has stolen the site.We will be taking action on this right away

Who in order to justify and get attempt to away with this is creating a smoke screen of libel against the people she stole from and owes money to. 

Crazy stuff! A warning to any web developer thinking of taking this one on... stay away!
