Buyer Be Ware ----- Around the Middle of November 2006 I bought my Daughter a Used Chevy Cobalt, 2006 4 door sedan that had only a little over 7000 miles on it. We waited in the salesman's office while they worked to clear the car that we were trying to purchase. It had been traded in sometime that week or day. Well around 8 p.m. My Daugher and I were told the trade in had cleared and that Bill Heard could not process the paper work to sell us the Cobalt. All went smooth that day.
Now it on December 11th 2006 I get a phone call from the Salesman who sold me the car. He states to me that there was a snafu with the customer who traded the car in and their Financing for the vehicle they were trying to purchase did not go through. Now almost a month later I am being asked to return the car so that they can return it to the rightful owner.
Bill Heard has told me that they are bringing two White Cobalts in and that I will have first choice at these 2 used cars. I am having a problem with this whole thing. Right now I have the car in my possession.
For any Buyer looking to purchase a used car from Bill Heard please do not purchase a Used Car if Bill Heard can not produce the cleared Title. As it stands now I am left holding the bag for a car they had no right selling me and am left wondering do I trust Bill Heard on the car they are bringing me in exchange for this car?
This is totally wrong a Month later I am being asked to return a car that we have been driving that does not belong to us and Bill Heard knew this from day one when they sold me the car.
Not sure what my next step is and what my legal rights are to all of this. What I do know is that until Bill Heard Town Center in Kennesaw Ga can get the car back they are in a pickle but so am I.

This is not uncommon with any dealership. With you it just happens to be Bill Heard. Dealerships submit loan offers to several banks and finance companies at the time the buyer is in the store trying to buy. Whatever bank or finance company that comes back with the best offer, based on credit reports alone, is the one the dealership goes with. The deal is made with the customer based on this preliminary offer by the bank. More often than you may think the bank later finds out the customer has submitted incomplete or incorrect information from the start at the dealership and has to withdraw their offer. This can be a few days or even a few weeks after the sale. To call this dealership or any other dealer dishonest is in itself dishonest. Even if the financing does go well it takes weeks for a hardcopy title to come back from the state. If dealerships had to wait for the title to come in the new car buyer couldn't take the new car and the dealership would have to sit on the trade. That ain't goanna happen! It also sounds like the dealership has tried to make amends by offering you a choice between 2 other cars. I have to believe they would make other efforts to make up for you getting caught up in this mess, maybe a free tank of gas and a car detail. Have you asked?

Read the reports on this site... that should tell you what you need to know about Bill Heard.
What they did was let the other party buy a car on a 'Spot Delivery', the other person's credit fell through, and now they have to get their trade back.
Legally, you probably have to give the car back, since it was never yours to begin with. Bill Heard should've never sold you the car - they knew that the financing wouldn't wouldn't be approved for the other party.
I would give it back, and go somewhere else to buy. I wouldn't trust BH to sell me a glass of ice water in hell.
Also, if you're going to buy used, get a Honda or Toyota, stay away from American cars all together, they lose a TON of value. Hondas, Toyotas, Nissans, etc are so much more reliable and cheaper to maintain.
