This company is systematically violating customer rights and without anything in writing or signed by customers making demands for exorbitant fees for "transferring" a phone number. My 81 year old mother attempted to gain services from Birch approximately one year ago (March 2012). She was told she would receive particular services for her fee namely voice and data. Data was not provided and she was told after allegedly entering into a "contract" with them (so they say) they did not offer data in her area. She sought to end the agreement and they refused to allow her to demanding alot of money to "give" her back her phone number. (not sure of the sum demanded a year ago) So she paid this company for a year (timely and monthly and now has one last monthly payment due) for one half of the services she bargained for telling them at the end of this alleged one year contract I am out. (verbally and in writing) She contacted the company the other day and she was told magically that she had not given them enough notice in advance of the end of the contract period to terminate the agreement and she had been automatically renewed for another year and that if she wanted to get out she had to pay $600.00 to get her phone number transferred. This company is a fraud. She received nothing in writing and even I, as an attorney, can find nothing which supports their verbal statements which have been made on the phone. She has called and been given the supervisor handoff two step. This company operates by, if you agree to something on the phone then you are locked in but if you inform them telephonically that you are out they refuse to recognize this. But frankly furthermore my mother in fact sent them a letter a year ago informing them of her notice. Guess what? they deny receiving this notice. FCC/FTC you must do something about this type of provider! I am sure the state of Kentucky will be interested in stopping this. I will remind readers this is an 81 year old lady. These actions are a form of elder abuse. It is taking advantage of a senior citizen and it is happening, I would not doubt, by this company every day. I demand a full governmental investigation of this company and their trade practices. Telephonic purchases cannot be allowed to proceed in this manner there is simply too much at stake.
