After an investigation by Rip-off Report, we found that Blue World Pools is actively resolving complaints and addresses contractor issues. This EDitor has reviewed the Reports regarding Blue World Pools and has found a real and dedicated effort by Blue World Pools' management team to effectively resolve past, present, and future complaints. I didn't get sucked into signing a contract with BWP. As soon as I heard the price from the salesman, I called our appointment to a close. I could install an inground pool for that kind of money ($16,000 !!)
My complaint against them regards them running my credit when I expressly told them not to. I even went as far as to tell them if a credit check was required not to set an appt for me. They told me they didn't have to run a report.
I'm right on top of my credit reports since suffering from identity theft within the last 2 years. I pull my report up and find an inquiry from Blue World Pools.
I call the company and complain.
The repsonse from their employee (Charles Miller) was totally rude and laughable. First he told me that I authorized it. I adamantly denied that and asked him if I authorized it then he ought to be able to give me the last 4 of my social. He couldn't. He told me they probably ran a credit check by my birthdate and name.
Then he told me that it was a soft inquiry that doesn't show up to my creditors. I told him I had the report right in front of me and it DID show to my creditors. Then he told me they had a right to run my credit under a loophole in the Patriot Act !! I outright told him he was a liar and the the Patriot Act was not put in place so that shady businesses could do illegal credit checks.
Then he said (I guess he thought he was dazzling me with BS) that under FCRA Article 72 (which doesn't exist) they were entitled to run my report. When I disputed that comment, he told me to take it up with Experian. I told him I did and they said to dispute it with the creditor. His response was that there wasn't anything I could do about it and he wasn't going to argue with me. I told him he could tell it to the BBB & FTC because I wasn't going to argue with him either and hung up.
This company has openly admitted that they run credit reports before sending out their salesman to verify that the consumer is the homeowner as standard operating procedure. This is a violation of the FCRA. They are not allowed to do this under the law.
I have filed my own compalints (BBB and FTC) against them for a willful violation of the FCRA (Fair Credit Reporting Act) Section 604 (Permissible Purpose for consumer reports). I'm also debating whether or not to sue them for violating my rights under the FCRA. I can sue them in any US District court for up to $1000 + court/legal fees for each violation.
They responded to my complaint with the BBB, quoted (convoluted) sections of the FCRA and stated they were "100% in the "right"". I did not accept their response and rebutted.
I'm sure there are a whole slew of people across the U.S. had BWP come out and didn't purchase pools. These people probably don't even realize their rights have been violated. Talk about a class action lawsuit !!
ANYONE who has had them come out to your home and they ran a credit report on you and you did not purchase a pool from them; BWP violated your rights and you do have recourse Under the FCRA sections 616 and/or 617.. This is a direct willful violation of the FCRA Section 604 (a)(3)(F)(i) which states they can run a credit check on you if they have a legitimate business need and you initiate a business "Transaction".
The key word here is "Transaction". A business transaction is the exchange of goods, services or funds. There was no "transaction" between us, just an inquiry. They say their legitimate business purpose is to verify homeownership. This is illegal. I am writing all three Credit reporting agencies letting them know that his company willfully disregards the law under the FCRA.
If I was to believe their convoluted explaination of the FCRA, then whenever I walk into a store or have a salesman come to my home, it would be perfectly legal for them to run my credit because I MIGHT make a purchase from them and it MIGHT involve extending credit.
Futhermore, I specifically told them I did not want them to run a credit report and refused to supply my Social (they ran my birthdate and name). This puts them in violation of FCRA Section 604 (c)(1)(A) which states you cannot run a credit report unless authorized by the consumer for which there is recourse under Sections 616 and 617. According to the response I got thru the BBB, Sean Warren is going to try to have the inquiry removed from my Credit Report. This remains to be seen. I'll keep you posted.
PS I don't beleive many of the positive posts about the company either. How many people do you know refer to using their pool as a "Swim Session". The so called happy customers have to be crazy to think $10-16,000 for an above ground pool @ 21% interest is a good deal. PULEASE !!
As far as the people who signed contracts at $8-9,000 only to be told they had to add the Deluxe package($12-16,000) to get financing approved. You should have some type of recourse too. You signed a contract for a specified amount and they did a Creidt check BEFORE they came out to your home. If they changed the bottom line of the contract you signed, they are in breach not you.
