Boyer Retirement Group Darren Boyer Rip Off...Scam..Buyer Beware... Ogden, Utah

Feel free to laugh, I did when I first read it. :)  It would be hilarious if it wasnt me and my company.

I was shocked to find that an individual with an axe to grind could blatantly lie and write anything they chose.  Any individual, competitor or nutcase can write a complaint.  The complaint is not verified, just posted.  Imagine for a second that your ex boyfriend , ex girlfriend or business competitor could write anything they choose without consequences? Real or Imagined and it stays at the top of the search lists.  

 Our reputation and good name are and always have been paramount.  We have been forced to pursue and obtain a Permanent Injunction from the Second Judicial District Court order stating that the author of this report portrayed Darren Boyer of Boyer Retirement Group in false light:

"Having reviewed the allegations of the Complaint and supporting exhibits, the Court finds that Defendants defamed and defamed per se the Plaintiffs, have portrayed Plaintiffs in a false light, and have engaged in intentional and reckless infliction of distress against all Plaintiffs.  Defendants have particularly published the following defamatory and defamatory per se statements:
 
1.       Defendants have published false statements that they met in person Darren Boyer of
Boyer Retirement Group.
2.       Defendants have published false statements that they engaged in a potential business meeting with Darren Boyer of Boyer Retirement Group.
3.  Defendants have published false statements of Darren Boyer of Boyer Retirement Group smelling of whiskey,
4.  Defendants have published false statements of lewd and obscene actions during said meeting.


In light of the above findings, the Court further finds that Plaintiffs have suffered and will continue to suffer irreparable harm if an injunction regarding these false and defamatory statements does not issue, that Plaintiffs have no adequate remedy at law because of the unlikelihood that Plaintiffs will recover any monetary judgment, that the balance of the hardships favors Plaintiffs because an injunction can be appropriately tailored to limit only the illegal conduct, and that the public interest favors granting the Plaintiff relief.

IT IS THEREFORE ORDERED that the Defendants, their officers, agents, servants, employees and attorneys, and those persons in active concert or participation with them who receive actual notice of this order by personal Service or otherwise, are permanently enjoined and restrained from:

(a) Publishing false and/or defamatory statements of a factual nature or which appear to be a factual nature, regarding Darren Boyer, Boyer Retirement Group and/or Jessica Jacques alleging that any of them met with Plaintiffs in person regarding a financial transaction.
(b) Publishing any false and/or defamatory statements or reports that gives the appearance that Darren Boyer, Boyer Retirement Group and/or Jessica Jacques engaged in a potential business meeting with Plaintiffs, at the websites <ripoffreports.com>, <badbusinessbureau.com>, and <complaintsboard.com>;  Etc.
(c) Publishing    comments on <ripoffreports.com>, <badbusinessbureau.com>, and/or
<complaintsboard.com> etc. regarding Darren Boyer, Boyer Retirement Group and/or Jessica Jacques in support of false and/or defamatory statements; and
(d) Further publishing or disseminating prior false and/or defamatory statements made by Defendants about Darren Boyer, Boyer Retirement Group and/or Jessica Jacques. 
           
         IT IS STILL FURTHER ORDERED that Defendants shall immediately remove all postings identified below from any and all websites where those statements are currently published, and Defendants will refrain from republishing those statements;"

Yet this remains. 

To all our loyal and prospective clients I sincerely apologize for being linked to something like this.
 
For those of you who are curious as to why this complaint was posted; 

We responded to an email from a marketing company.  After several frustrating weeks, we asked them to stop and refund a prorated unused portion of our payment.  
 
After trying earnestly to come to an equitable settlement, I decided to enter a BBB report after they kept $3,200, providing very little if any of the services they promised.  I also found several complaints for them under this website rip off report.com.  I decided to add mine to the cause. 
  
 I filed a report on Rip off Report trying to make sure others did not waste their money as I did. 

In retaliation, they posted a false and slanderous report that is the first thing you see when my name or company is searched on the internet.  Their retaliatory report DID NOT originate in Utah or with anyone that has ever had business dealings with us.   
 

So, if your main complaint was the fart, shouldn't this be a "ripped one" report?

I was just reading various posts on ripoffreport.com and came across this "consumer scam complaint".  After reading the complaint, I scratched my head wondering what did this guy do wrong, other than fart?  This is not a consumer scam complaint.  This is rather just a couple who has no patience or tolerance and has some sort of axe to grind (with this guy or just woke up on the wrong side of the bed).  Seriously, why should I or others waste our time reading "fake" rip off reports.  This guy did not rip you off.  All he did was rip a fart..  Report "actual" rip offs or find something better to do with your time.
