I just got back into town and started assessing all the companies problems. As you see I am not filing bankruptcy. I am restructuring and doing what I can in the next several weeks to obtain financing and capital to finish all the builds to help all the 25 customers to fully get what they are promised. We are capital depleted and that would be the easy way out, to file bankruptcy that is. We have a ton of cars to finish in all stages and people to satisfy. I could file bankruptcy and leave everyone holding the bag but I am not. I have several cars and monies owed and talked to almost all customers involved. They all including you dont want a total loss but a total gain of everything due. Its going to take 60-90 days for me to make this happen. I will not abandon ship and take the easy way out. I will also include the general email that went to all customers so no one losses anything. This also avoids a year to year and a half in court and no one left holding the bag. I have full intention of making sure that all customers receive full communication and updates any time on the progress of their situation. Lets all face it, if I were going to just walk away, I would file the paper work in 30 days and make this all go away. I'm doing all this emailing to let you know no way on earth am I taking that route. Everyone has to take a breath and a step back and give me the time needed to right the ship. Attorneys, threats of jail or warrants will not help your situation or pocket book. Only me going forward with future builds and financing will produce cars or monies. This does not take a rocket scientist to figure out. I hope one or two dont ruin it for the multitude involved. I will be working night and day to keep my word and trust that you instilled in me to produce your Trans Am.
And I solely take the blame for the any shortcomings that my company or myself have bestowed upon any customer. All I can do is dedicate all my time and effort to doing the right thing." From what I take of this email is that anyone that has a pending order just needs to wait and hope that he delivers or he files bankruptcy. If I am not mistaken, there are laws that prohibit individuals or companies from arbitrarily filing bankruptcy. I tried filing a police report with the Buncombe County Sheriffs Dept., but the Deputy I spoke with stated that since I had already filed with the Dept Of Justice, he could on file an incident number. The Deputy Stated that the DOJ is a higher Authority and I did the right thing by streamlining the process. I could go on but I am sure I would be just stating the same thing as everyone else. If anyone has any other information pertaining to other leagal avenues or alternatives to getting our deposits back I would like to know. I dont trust that he will ever deliver on any of his promises.
