In mid Feb, 2003, I recieved by mail a gift certificate from Cabela's, with their catalogue. This gift certificate was purchased by the company I work for because I earned safety points in a safety 'benefit' program with them.

After looking through the Cabela catalogue I settled on purchasing some goose down underwear with my certificate. It's pictured and described on page 325 of the "Spring 2003 catalogue." [The only goose down underwear shown in the entire catalogue]. I then went online to Cabela's, www.cabelas.com to purchase the item.

This is the exact wording of the Spring 2003 Catalogue ad on page 325:

We made a special buy on a limited supply of this Goose Down Underwear and we're offering it at the lowest price you'll find anywhere. [Please note these are the only Goose Down Underwear to be found in the entire Cabela Spring 2003 Catalogue]

Please also note that, At Cabela's website, and using their "keyword" search engine, there was no goose down underwear of "any kind," to be found. I wrote to Cabela's via email pointing out that I'd found a product in their catalogue that I wanted to purchase, but could not find it at their website, so that I could do so. I recieved this explanation via email:

Hello,

The reason they do not show on hand is that they are now out of stock, and not available for back order. We do still have the ones shown at this link.

[Please note once more, in a previous keyword search at Cabela's using the words "goose," "down," "underwear," "goosedown," and/or any other combination of these keywords, produced no link to any item of goose down underwear at Cabela's website, nor including the link supplied by Cabela's personnel's return email above]

I have saved an exact a copy of the link provided me in the Cabela email to file, I only wish I could upload it to the badbusinessburea.com website so I could show you the almost identical wording of the product in question. This product appears to be identical in description, (especially in description of the quality of Goose Down used, and the physical structure of the product), and in opposing photograph's in the
two ads, exept for color shown and the mention of the registered trademark "Thermostat."

While it is impossible to detect the difference unless actually seen, in hand, the first (in catalogue), carry the Cabela label, as pictured, but a different manufacture is inferred by Cabela.

If you cannot connect to the link provided in Cabela's email above, [it is accurately transposed, but may be broken by word wrap], I offer you this copy of the ad's decription:

I submit that since this catalogue was distributed in winter 2003, at an unknown date, [and is not carrying a publishing or distribution date inside the flap], as the Spring 2003 Catalogue that its obvious that Cabela's has employed at least one of several variations of the old tried and true "classic bait and switch," sales tactics produced over the years in their selling practice.

I have asked that they sell me the underwear at the advertised price, warning that I will report their tactics unless they did so, I was refused, as the following email from Cablela personnel
shows:
Hello [X], Thanks for visiting cabelas.com

I do apologize for your inconvenience and Misunderstanding on the situation on the Down underwear. Unfortunately we are not going to be able to sell you the down underwear that Mike sent you for the price that was on the other set of underwear. The Underwear that you had first wished to purchased was a special offer from the manufacture as stated in the description. As with the special offer we received them from the manufacture at a lesser price. Thus allowing us to Extend the cost savings along to our customers. Only a certain amount of units of each item were available at this price with the purchase from the manufacture. The Underwear that Mike sent you was just a suggestion as to a replacement for the items you were interested in and were sold out. Since they are not the same item we are unable to send the Higher priced items to you at the lesser price of the special purchase item. Unfortunately we were unable to calculate the amount of demand that we would have on the Underwear that was a special purchase from the manufacture, so we unfortunately ran out of stock much earlier than we had expected. Again I do apologize for the inconvenience and misunderstanding in this situation.

I don't think you were scammed on purpose

Alot of times these catalogs become out of date as little as weeks after being printed and mailed out to consumers.

There was fine print in there protecting them about items selling out, etc. They had a great sale which was good enough for the paper catalog and it sold out. I do not see how they are entitled to matching that sale on price on a similar replacement.

Maybe I am missing something? What is the matter with accepting the item became out of stock through the sale before you could purchase it without demanding and wanting a different item for the same price as compensation?

What did your lawsuit bring from this? Any updates? If it was me I would have moved on after the item being out of stock and not sweating it.

I Will Make This Short About Cabelas

From What I See There Is Only (2) Reports Which Is Very Low---I Have Buying From This Company For Around (20) Years And I Am Extremly Happy With The Way Of Doing Business--I Have Spent Somewhere Between $5000 And $10,000 With Them--I Have Spent Enough With Them That I Get There Hardback Catalog Each Year From Them---IF You Are Not Unreasonable With Cabela's You Will Find Them A Great Company To Deal With

Just 6 days after filing this report, and the same with the BBB, a woman from Cabelas named Jodi called me and said they'd decided they'd sell what I had been seeking at the advertised price! They did not mention the BBB, or BadBusinessBureau. I asked her if she'd mind sending me an email to confirm that, and she had someone else do so. It had no instructions about how to order. I return email asking how to do this. I was told everything was on file, and whoever I placed my order with would know what its about.

I decided not to try to order online, in spite of what it says at the bottom of every page of the catalogue: "order online at www.cabelas.com" I called instead. I was transferred once, (after calling the "order," line, and then put on hold by the customer service line for 15 minutes before I hung up.

In addition to what I'd originally wanted to order, I wanted a down vest also on the same page of this catalogue, I was told they were out of stock on those as well. (The guy I'd been speaking to on the phone, was looking for an alternative, just like the last "alternative," I'd bet. More money, same vest.

After hanging up, I emailed the person who'd sent the confirmation that I could get the down drawers at the advertised price, and told him I'd been on hold too long. He emailed back and said we should let the BBB handle the complaint as we were getting no where, and we were at an impasse. I didn't write back.
