calvery claims i owe an outstanding debit with them>>> ok so i called them to get a copy of the contract they say i signed .Calvery told me that they hired vision financial to handle my account .Calvery gave me the number i called them ask for a copy of the contract (to prove i owe this) i first spoke to a lady who told me that i needed to speak to her supervisior.

Thats when it started the man was so obscene and vulgar told me i was not getting anything outright refused to provide anything to prove i owe this. then started to yell and curse me and telling me how worthless i was and called me a few obsene names.( i was so embarresed that my coworkers had to hear all this while i was on my job) I hung up on him and he called my job 4 times after. he was told by my manager to not call me again AT WORK.

Im outraged that he has a job or that he can talk to anyone that way . He said he wasnt in customer service.... He thought he would put me in tears and i would pay this. I refuse to deal with this person. Where are my cival rights put in place? Its ok for him to talk to a ANYONE that way. and why he persist to call my job. Im a single mom with 2 children i dont need my job at risk. Calvey and (or) vision owes me an explanation. Is it in training to do what deemed neccessary to close this account? I want to know what my RIGHTS are? AND INTEND TO FIND OUT ...

Who on earth is this collection manager?

AUTHOR: Mrs. T - ()

I have a few words for the collection manager at Vision Financial.  1)  Professionalism.  2) Legitimacy  3)  Interpersonal Communications.  I have never read anything quite like this coming from a so-called legitimate business.  Your company needs some serious revamping and although it is "Not your policy to send any information in writing regarding the debt you are trying to collect," no one in their right mind would or should pay you a thing without first retreiving all of the information regarding same.  Some advise to a company that apparently does not care about their reputation, take an interpersonal communications course.  The keyword in business is success.  Your company's policies and communication styles leave a lot to be desired.  Also, can you please explain why my husband receives calls from an Illinois number, I receive calls from a Georgia number and when I ask for an address to request information in writing regarding this debt that you are trying to collect from us, your employee, Chris Parker, informs me to look on you website, which has a Missouri address.  A note to the collection manager and author of this very unprofessional blog -- my husband has past debt.  I am clearing them up one by one.  I have always done what is right financially.  When I asked your company for information regarding a debt that you called me about, Mr. Parker's reply was, "We don't do that."  Until you do, each and every time you call for payment of this debt, my reply will also be, "We don't do that."  We are not about to pay any company who cannot verify the debt they are trying to collect.  Get it together, Vision Financial.  And for any and all of you who have received feedback such as what their "collection manager" has written in this blog. consider the source.  These people are not professionals.  If they were, they would not be speaking to people in this manner.  They act like it is personal.  I am sure the person on the receiving end of the collection manager's blog does not owe the collection manager money.  This appears to be a bottom of the barrel collection agency.  Hold your ground and make them prove a legitimate debt.  And when they speak to you as this collections manager has done in this blog, keep in mind that these are not professionals.  They are apparently people who could not get a job anywhere else.  No legitimate company would allow representatives to speak to people in this way or post things like this on the Internet.  I'm floored by the unprofessinalism of this company.

You do have rights but you're also misinformed

AUTHOR: mitchellss - (United States of America)

Once an account such as this enters third party collections, like the company that has contacted you representing Cavalry Portfolio Services Inc., they do not have to provide any original documentation on the account. Cavalry is a debt purchaser and when they purchase an account like this, they are given only limited information from the original creditor, and you are not entitled to any of the documentation including signatures. You are given that option at the beginning of the collections process, and are also urged to hold on to any documentation for your own personal reference. The third party agency does not have to provide that to you. They send validation letters once they receive your account, which state that you have 30 days to dispute this account, otherwise it will be condisered valid, and that is under the FDCPA. As far as the collector using profanity, I'm sure he was dealt with, as calls from these agencies are monitored and recorded, as well as audited by the client, which in this case, would be Cavalry Portfolio Services. My suggestion would be to jump on a settlement offer and take advantage of it.

Check out your legal rights

AUTHOR: Donna - (U.S.A.)

First of all it is correct that if you pay your bills you will not be turned over to collections or collectors. But there are times where it is a matter of survival when choosing which bills to pay! Like do I spend $40 on groceries for my children or do I pay my credit card? DUH!! I am going to feed my family! Collectors do not care about the reasons you could not pay!

I recently received a call from Vision Financial regarding a credit card that I did not pay for this very reason. I proceeded with the following information and the collector was surprised that I knew so much about my rights that she asked me how I knew so much! If you educate yourself, then you give them nothing to stand on!!

First of all, make sure that the debt is actually yours. Request validation of the debt in writing. Ask the collector for their mailing address and the account number or reference number of the debt they are trying to collect. Mail the request to them certified, return receipt. The law states that they have 30 days to provide you with proof of the debt from the date of request and if they cannot or WILL NOT provide you proof they are required to cease from contacting regarding the debt. Most of these debt are called "zombie debts" and are so old that they do not have the proper proof that is required by law to collect on them and are trying to bully you into paying. Also in this letter you have the right to tell them to mail you all correspondence regarding this debt and not to call you at home, work or anywhere they have called you.

Second of all with all collectors, research the company! Most collection companies today are trying to become reputable and there is a organization by the name of ACA International that is the "The Association of Credit and Collection Professionals" that in order to be a member the collection agency AND it's employees must meet strict guidelines and code of ethics. This what their code states:

"Be fair and respectful to employees, associates, competitors, customers, the public and employers
*Treat consumers with consideration and respect (Ethics Rule II.A.1)
*Communicate with consumers with honesty and integrity (Ethics Rule II.A.2)
*Avoid threatening or initiating collection litigation on time barred debts (Ethics Rule II.A.6)"

"Validation Requests, Verification and Disputes
*Upon receipt of a written request for verification from a consumer, suspend collection activities on the account and provide debt verification, or
*If agency chooses not to provide verification or is unable to provide verification, cease collection activity, remove derogatory credit items (if any) from consumer's credit record, and notify client/credit grantor that collection activity was terminated due to the inability to provide verification of the debt (Ethics Rule II.A.3)
*If requested by the consumer in writing, notify the consumer that collection efforts have been terminated by the member (Ethics Rule II.A.3.d)"

This information was obtained DIRECTLY from ACA's website: www.acainternational.org

If the collection agency is a member of the ACA and you feel that they have violated their codes here is the link you need to file a complaint: (((Redacted)))
Thirdly file a complaint with the FTC or your local state agency that handles these situations. Collectors have a right to try to collect your bad debt BUT they do not have the right to threaten, be rude or lie to a DEBTOR (you).

So Marie, if I were you I would file the complaint with ACA and refer to the posting by a "Collection Manager" of Vision Financial. In my opinion that is CLEARLY a violation of ACA's Code of Ethics and should be reported.

Good Luck and I hope this has helped you and anyone else who reads it!

Lets talk about your rights.......

AUTHOR: Cc/loan_man815 - (U.S.A.)

Marie for greenville,NC

So when you spoke with a manager why would they have gotten you upset if all you wanted was information on a debt you already know you owe. Let me ask you Marie when is the last time you looked at your creditreport that is where all info is. If you really dont want calls at work you should try paying your bills. First off you are working so why is this bill still outstanding you dont get calls when you pay your bills. We may have gotten you the info you ask for especially if you owe cavalry since they have all the backup documents you would need. It is unfortunate that you got a rude person on the phone but collections is not customer service and we are not there to help hold your hand through the process. You apparently are a very ignorant lady since you expect customer service after years of not paying your debt. You get customer service from the original company you started with and by all means deserve every bit of it when you are current and paying your bill on time.

However when you end up in collections you dont get the luxury of a person you pays there bills on time. You know get treated like a lier and thieve in my eyes since really you did take money that you intentionally decided at some point for whatever reason not to pay. Who's to blame now marie since we now have to feel harrased everytime your bill comes up and we have to contact a debtor like you. If you pay your bills on time marie you will never end up in a collection company and have to get contacted about a bill that you should have paid to begin with. The reason why you got upset was because you couldnt pay the bill and I am positive of that especially since I probably pulled your CBR to see how much of a debtr you are. Grow-up and pay your bills it is tax season and like everyone else in life who has kids and is raising them use your tax money to pay this bill and get it over with stop wasting time. I am sure we can offer you a settlement to help you pay this off call us and get this taken care of 866-470-9586 ask for the cavalry manager and get a deal for christ sake stop running, and as far as the calls at work why did you call us from there if you didnt want calls there your whole story sounds like a debtors lie. You need to fix your own problems remember these words, "PAY YOUR BILLS DEBTOR."
