My name is wes, im a 21 year old lower middle class hard working american citizen. Up until recently i had no reason to check my credit because i had NEVER applied for a credit car, loan, had a cell phone, rented a room, or had a single bill in my name.

I applied for an apartment febuary 28th 2005, everything turned up fine accept a single mark on my credit report from a company called Cavalry Porfolio. I was confused so i got their phone number and called them up only to get a very rude employee telling me i owed money on a sprint phone ( 173 $) from 2001.

I told the women on the phone that i had never owned a sprint phone in my life, i asked for them to give me any documents on this bill and told them it was fraudulent. I then was told my account with Cavalry was sold to Titan collections, furious to say the least i called the number i was give for Titan collections and was informed by another rude collections worker that " my account was not in their system and that it MIGHT be their in a week, but it also might be sold by that time. "

Tired and frustrated i filed a report with my local police department and they in turn sent me to a local sprint store (1420 contra costa blvd ste d, Pleasant Hill, Ca 94523) to retrive any documents or information on my account i can. Sprint was no help, their employee, Justin Lacap, refused to print out my account information, couldnt retrive a copy of my signiture from the sprint store the fraudulent account was set up at because he claimed they only keep records for 2 years. I was given a number by the usless people at sprint for their fraud department that refused to handle my case and sent me back to Cavalry.. this has been a horrable i urge anyone with similar problems to fight sprint pcs and cavalry.

Same problem but was resolved

Sprint sold my one day account to Cavalry. Cavalry in turn reported me to Equfax. I just happened to subscribe to their credit watch and they in turn notified me of the collection report. I contacted them the following day by phone. I advised them that Sprint had made an error and attempted to give them the name of the supervisor at Sprint who could resolve the problem. They were not interested. So it appeared it was a declared war. I called my lawyer and it seems they were in violation for Title VIII of the Fair Collections Act as they never made a demand of me prior to reporting me to the credit bureau. That is an automatic $1000 fine. I sued in small claims court (Butte County, CA. Case DSC06589) and actually was able to serve them. In the mean time they contacted all the credit bureaus and removed the report. April 8 we are off to small claims court!

I went through the same fight with these people. They kept insisting that I MUST fill out their paperwork and submit a police report if I was claiming "identity theft". Uh, no, it is not MY job to prove that the account is not mine..it was Calvary's job to prove that it is...which was not possible, as I have never had a Sprint PCS account in my life.

Unfortunately, the credit bureaus are absolutely worthless in helping you get erroneous information cleared. You can dispute, they "verify" the information, although I have no clue how they can "verify" something that does not exist. Credit reporting regulations need to be revamped to keep things like this from happening to consumers.

When these "debt buyers" sell the same information over and over, a person may have multiple entries for the same alleged debt pop up on their credit report, significantly lowering their FICO.

It is really unfortunate, but I had to end up having my attorney write a very strong-handed letter to PROVE the account was mine or face legal consequences. It worked. I have almost been waiting for this "debt" to get sold again, since Calvary finally was made to realize that I wasn't going to pay something that doesn't exist, just because they said I owed it.
