As an FYI to consumers reading this report, this organization is a franchise of Cingular, now the new AT&T.
These individuals, starting with Chris Kelly ( Owner ) - his girlfriend Robyn Register, his Corporate staff - Sara Neil ( Human Resources rep without a degree ) Tammy Carrington ( Commission Theft Specialist ) Amber & Naydeen ( They handle the returns & refunds ) As a customer expect a hell of a rollercoaster ride to try to get that refund... They fabricate ways, reasons and lame excuses on how to keep a sales associate from obtaining the commission check they work hard for. As a former employee I was disgusted on the way this Corporate office is ran. The unprofessionalism level, the lack of proper communication and their low ways to rip off not only their customer but also their emloyees made me resign after a thorough conversation with a Representative of the Department of Labor.
I have collected all the proper documentation needed, from the Elementary level employee handbook to their lack of ethics commission structure. I have contacted 9 ex-employees so far, and we are going to start a Class Action Lawsuit against this company, they have proper documentation as well and they have been cheated out of their commissions as well. The attorney which will most likely be representing the case adviced me that at least 8 ex-employees which had worked for the company at least the 3 consecutive months required to start commissioning would be the minimum needed to start the law suit process.
However, I have heard from so many people that have gone through this experience with this organization ( If it can be called an organization ) That our goal is to have at least 40+ ex-employees represented so that in the event that some are not elegible for the Class Action Law Suit we still have a cushion to take this Cloney and his clowns out of Business.
More than personal gain for the 9 of us already starting the process, our goal will be to have this guy removed from the AT&T network and take him out of Business period so that he can learn how to properly & respectfully treat not only his customers but his employees as well if he's able to ever recover and start another business. He has locations in Florida & Alabama representing AT&T but in Georgia he owns locations that represent T-Mobile.
A close friend helping out in the process of this Class Action Lawsuit, ran into this website online & adviced me to Post something here. His emloyee records will be subpoena hoping to gain more ex-employees, however, the more we have on board to begin with, will only make this transaction a fast and smooth one which is the Goal.

POSTED: Friday, August 27, 2010I don't really remember a lot of facts. It's been about a few years since I've worked at CEP/EDP, but if I can help or participate, I will. What's up #11. I think we've talked, and you are correct.
Another thing that would be interesting, Chris Kelley has started several side companies of his own interest. I had a suspicion that his sports memorabilia business was just a ploy to use money from EDP to buy items he wanted, and failed to report the value as income or pay taxes on them. It would be interesting to see if that suspicion was correct.
Some additional things to consider: When equipment or money goes missing, employees are held financially responsible. Companies pay insurance for things like this. So EDP.....aka Chris Kelley.....actually profits off of stolen phones and equipment. They never do a police investigation unless they can't withhold the amount. Also, the retail cost of the equipment is withheld from employees for missing equipment, as opposed to the actual amount of proper restitution. He pays literally $10-30 for blue tooth equipment, and as little as $0.20 for some of the phone accessories. If one device goes missing, he deducts $100, or whatever the price tag is in store, and divides it across everyone that worked hours in that store for the month. Tell me the last time you heard of Sears or Walmart docking their employee's pay because their inventory came up short. It doesn't happen because they insure their assets and they have a knowledge of the risk. EDP does not assume any risk. I personally filed a police report for stolen equipment and pushed local law enforcement to do an investigation of mall cameras. My commission was still withheld for the retail amount of the stolen merchandise.
Something else of interest: the DOL had an investigation and found that overtime wasn't being paid. Not only were the employees that had worked overtime awarded in the investigation, but we learned you actually earn overtime on commission. I'm not going to get into algebraic functions, but if you work overtime, part of your commission is calculated into an hourly rate and you get 1.5 times your commission for the amount of overtime hours you worked.
It's sad that I lived through AT&T Wireless, Cingular, and (The New) AT&T Mobility, and their dedicated representatives know how fraudulent and undermining the corporate activities are. I remember working one night and processed a return; prior to having dedicated refund people. Before they existed, if there was the smallest scratch or missing equipment, missing bar code on the box, the employee was responsible for accepting it, and the retail cost of the phone was deducted from their commission (although they were still reimbursed by AT&T.....so again, they benefit from minor damage to a phone). A customer came to me to return 3 phones. One was scratched, but not majorly. I was instructed to charge a restocking fee per phone plus the full retail cost of the scratched phone. Since this was a buy one get 2 free deal, instead of getting money back, this customer would have owed the company money if she wanted to return her equipment. She called the cops on me. What a fun night that was.
These are just a minor examples of their business vision. They don't protect their staff, which is the concern of every normal business. They use their staff to leverage unreasonable income sources. I don't know how well the rules of commission are regulated, but there is definitely some moral issues with promising that the sky's the limit with their commission structure, then they end up putting you in debt to them by withholding your earnings for reasonable business responsibilities. To me, that seems illegal, but I know the rules of commission are very gray. I'd rather be written up and paid as promised than expect a $1,500 check and instead learn that I get nothing and I still owe $200 when the next month check comes out.

POSTED: Wednesday, August 25, 2010thanks everyone for all the info, I also have insider info , I was a sales rep. in the AT&T Wireless store (cellular express plus) altamonte mall and was never paid a commision check that was over 28 dollars. chris kelley and his managers tell you how you can make all this money if you just add features to the att customers account that the customers dont even want. what cris kelley and his managers dont understand is they are not their when the customer returns to the store and wonders why their bill is so high. we have to take all the blame. during this time we were not allowed to sell the i phone like the real at&t stores can do. So they make us sell this generic china look alike iphone that we had to tell our customers they could not put the at&t insurance on or it would not be covered. next thing you know all the fake iphones we sold were coming back because they would not get on the internet or send picture messages-that was a nightmare in itself especially when customers found out it was some kind of china phone and not the real iphone. not only is this the worst company to work for, i cant believe AT&T Wireless lets them get away with this!!! please keep me informed thank you

I have valuable information to share on why Chris Kelly gets away with treating former employees so bad. What no one understands is how he can treat At&t Wireless customers even worse.
Come to find out Chris Kelley is actually bonafide business partners with a AT&T Wireless manager by the name of Jacob Mullins out of Jacksonville Florida. Supposely this Jacob Mullins guy holds a forcefield over each and every one of Chris Kellys Cellular Express locations.
So if you look up cellular Express Plus or any of his other names doing business as At&T Wireless in the state of Florida, and they to are defrauding At&T Wireless customers then you must go directly to Jacob Mullins or his boss which is Mr. Steve Sitton out of atlanta georgia. Again please count me in!!!!!!!

POSTED: Wednesday, May 21, 2008I am extremely upset at how this company does business. Since the whole selling the store, I have been unlucky to find a job. I am about to start a waitressing job, but the money is just not always there. Because of all the problems with job hunting and working, I am starting to fall behind in bills and these people do not care. Its like they want their employees to fail at life. I have worked hard trying to build the credit I have and I am still fighting to keep it good, but when they will not pay me what I have worked my butt off for, it is very hard to make ends meet.
I should be getting two commissions checks from them [[that is from this year--not really sure what I was to receive in 2006]] and also one more hourly check but I have not heard anything. While working their, I was outselling the manager of the store and some of the other employees that have been working there longer, but I was the one who did not receive anything.
If anyone could help in shutting them down it would be wonderful. Mr. Kelley and his staff are not the right people to be in the business world. Customers that I have helped even said that Mr. Chris Kelley was rude and unwilling to help them with the problems they were having. I have first hand experience dealing with this money hungry group who love to blame everyone else for their own mistakes.
