My home loan orginatated with Washington Mutual. I requested a loan modification due to a loss in income. After providing over 100 documents via fax, called and letter I received a very small modication BUT my payment went up. I continued to stuggle to make my payment. Then I experience a devastating water main break in the home in January 2009 for over $42,000 in damages. My insurance company paid the claim in payments while Washington Mutual transferred servicing to Chase. I contacted Washington Mutual to report the claim. They provided very little direction which I followed. The insurance funds went into escrow. Could not get the funds out to repair the home so I asked to have it applied to the past due payments so I could get the mortgage on track. I was told that would not happen. I called everyday for months. Then I was directed to use the same contact information but it was now Chase. I again explained that I received a loan modification BUT my payment increased and now could not live in the house due to the damage - I requested help resolving funds in escrow to repair the home and get a loan modification. More letters (I sent my certified), faxes and calls and got no where with the modification. I was continually asked to provide the same information and documents over and over. Did not receive information that information was still need or the modification was denied. Then I am notified by a realtor that my home was foreclosured and that poster notification was posted all over the property. I have been given time to remove my personal items. During the process the asset management company had the law mowed and people coming and going from my property that still had my horses, dogs, furniture, clothing, farm equipment, dishes, appliances and many other personal effects. The posters could be seen from the road. And I was robbed. In the full light of the day, two trucks, one trailor and five men (according to the neighbor) pulled up and robbed my barn taking my horses, dogs, saddles, feed, briddles, reigns, bits, buckets, and grooming equipment. So not only has Chase unlawfully foreclosed on my home then my property is taken and I can't make a claim "because I no longer own the home". I contact the police, the realtor, asset management company, local media and so on. Sent a certified letter to Chase detailing RESPA law, TILA law, HMDA law, and servicing law. No reply. I have reason to believe that WaMu and Chase have been non-compliant with many RESPA, TILA, HMDA, Civil Rights and mortgage servicing law. Not to minimize the great loss of members of our family = our horses.
