In accordance with our teleconference I am sending this written complaint to you and I am attaching some of the documents that we discussed.
I purchased a 2006. from Chuck Nash Chevrolet on October , 2007. The contract stipulated a sales price of $25,569.06 at an interest rate of 14.95% and I paid them $3000 as a down payment. The financing was through Triad Capital Corp. and the salesperson was the finance manager, xxxxxx. It was my specific agreement with Chuck Nash that they would only submit my loan application to one lender because my credit had been damaged because I had recently been the victim of identity theft. I told them that I had spent one year and $1500 rehabilitating my credit rating and that I did not want them sending my application to any more than one lender because it would lower my credit rating. Chuck Nash Chevrolet agreed to only submit my loan application to one lender.
I later received more than a dozen rejection letters from various lenders and realized that Chuck Nash had violated our agreement and now my credit rating is destroyed. When I informed Jeremy Jones of this breach of agreement he initially denied this, but later in the conversation admitted he sent the letters and assured me that he would send a letter of retraction to each credit bureau listing all of the lenders he submitted my application to against my instructions, but yesterday he told me he was not going to send the letters out, he was not going to send me a license plate (the paper plate expired on November 2, 2007) and that I if I did not pay for the car in full in two days,they were going to come to Houston and repossess it.
Several weeks after I received the car.a Chuck Nash salesperson named Jeremy Jones called me and told me the bank had denied the loan !(I was later informed by ........ that the reason for the denial was that Chuck Nash had given T a different home address for me then I had given them.)
At this point, Jeremy began to make harassing calls to my office. He told my receptionist that I had not paid for the car and they were coming to repossess it. My receptionist told Jeremy that she did not feel comfortable discussing my personal business and Jeremy told her that I was in a lot of trouble and that they were coming to pick up the car because I had not paid for it.(Which was untrue)(Several of my patients overheard the conversation).
Over the next several weeks Chuck Nash sent me at least three more contracts. Two of them had erroneous information on them, specifically, the interest rates and terms were different and more expensive than I had originally agreed to in the original contract. One of the contracts they overnighted to me was sent to the wrong address which caused further delays. It appeared they were attempting to gouge me for more money.(employee.) confirmed this by informing me that she had personally obtained approval at an interest rate below 13% from HSBC.One of the contracts Jones sent me was for an interest rate of 17.29% and monthly payments of $535.18. The original contract stipulated a 14.95% interest rate and monthly payments of $483.96.
My cardboard license plate expired on November 2, 2007 and despite numerous complaints from me, and numerous promises from Chuck Nash to overnight me a current plate.they have refused to provide me one.
I have never signed a conditional sales and delivery agreement nor have I signed any other loaner agreements with Chuck Nash. They have also deposited the $3000 I gave them on October 12, 2007. Nevertheless, they continue to make harassing telephone calls to me and my staff threatening to repossess the car even though they apparently are not authorized to do this. This is particularly distressing because all of the delays in financing have been as a result of their mistakes.
Jeremy Jones sent me a contract that he stated had been approved and I received it on November 19, 2007. He called me on Tuesday, November 20, 2007, began making abusive comments to me and told me if I did not sign the contract and overnight it to him they were coming to Houston and take my car! I informed him that all of the delays have been due to their mistakes and I complained again that he was violating my privacy by making threatening and false comments to my staff. He told me that he had a legal right to talk to anyone he chose to about my finances and that there was nothing I could do about it. I asked him to stop harassing me and my employees and he refused. Jeremy stated "I'll talk to anybody I want to".
In this teleconference we agreed that I if I would overnight the contract to him, as soon as he received it he would overnight me a current license plate and would write retraction letters to the three credit bureaus stating that I had not authorized them to send out these loan applications. Yesterday he told me that he was not going to send the plate, was not going to write the letters if I did not pay in full for the car in two days he would come to Houston and take it.
Jeremy called me later in the day on Wednesday November 28 told me that HSBC had denied my loan application because the 30 day time limit had expired.(xxxx informed me that this contract had been approved on October 23, 2007 and that it expired on November 23, 2007, therefore Chuck Nash was responsible for the loan being denied.) I replied that I had only received the contract from Chuck Nash one week ago, he told me that that did not matter, that my financing had been denied and if they did not receive payment in full in two days they were going to repossess the car.
In conclusion, I feel I have been victimized by an unscrupulous car dealer who has been careless and negligent with my finances, as well as my privacy.Furthermore, I will or Chuck Nash has apparently violated numerous consumer laws.
