Mugshots is a despicable company. What they are doing is making money off of other people's misery. The fact that they are charging people to remove their mugshots even though the person has been exonerated. I have a feeling that pretty soon the Government or some senator will push a law to outlaw these types of businesses. It's nothing but extortion that mugshots.com is committing.

The operation mugshot sites are likely protected by the First Amendment, since the information contained on the site is public records. Mugshot sites will often charge to unpublish material from their site, and they have the right to do so. While this practice upsets those affected, it is again legal since the sites can make decisions as to which mugshots to include, and which to unpublish. Unpublishing is a major issue in the publishing world and it doesn't start or end with one site or another (Google "Unpublish" or "Unpublishing"). This is simply the cost of living in the Information Age, when public information is readily available.

give you plenty of ammunition to make a complaint to the Florida Attorney General's Office, Division of Consumer Protection, and the Federal Trade Commission.
Forget about "use of likeness" claims, they won't go anywhere. Focus on what these companies are doing; deceptive and unfair trade practices in violation of the Florida's Deceptive and Unfair Trade Practices Act, and the Federal Trade Commission Act. Make sure and file your complaint in writing and follow up by telephone.

They don't suggest you endorse their products. That statute won't apply. In all reality no law is broken, you just upset because your mugshot is on the site. As one attorney recently said addressing that exact same issue, "Life is unfair, but that does not always give rise to legal claims."
