My 17-year-old son like in a previous report, rented a motorcycle from Classy Cycles in Panama City Beach, Florida. He was there with friends for the weekend, and he and another boy who was 18 both rented the bikes. The same thing basically occured. He was told to "sighn here" and handed a key. Nothing was mentioned about inspecting anything. He went down the road on the bike only to discover it had no brakes!

He immediately went back and told them and was given another bike. He noticed that this bike leaned over a good bit more than the others and asked "Brandon", who handled his rental, about the leaning. He was told that the bike had always been that way and it was ok. He and the other boy both rented the bikes overnight, and they left happy with their rentals. At some point they went back to their room and parked to go inside for a drink and to eat.

When they started in their door, they heard a crash and turned around to find that my son's bike had fallen over, because the kickstand broke.  My son immediately took the bike back and showed them what had happened and that the bolt holding the kickstand on had broken. They told him he must have been sitting on the bike with the kickstand down and caused this damage.

They made both boys return the bikes, kept both of their $100 deposits, and have since then sent a threatening letter to my son saying if he didn't pay the additional $383.85 in full they would seek legal action. My son called me frantic that day from the beach and I tried to talk to the man over the phone.

He even admitted to me that although my son didn't mean to do it and although previous riders had abused the bike by sitting on it while the kickstand was down and damaged it, since it actually broke while he had it, he was responsible because it was in his possession at the time.

To me, that sounds like these people are not maintaining the equipment they are renting. Matter of fact, the first one had no brakes, that is unsafe. The kickstand was not his fault, he did nothing to cause it, and they accused him of sitting on it and causing it to break.

I have been in many motorcycle shops and sat on their bikes, they never once told me to get off it would break the kickstands. I don't believe that, and regardless, he wasn't doing that. He wasn't on it at all! I am hoping to get some legal help with this. I don't feel thee people deserve $383.00 or the $200 they kept already. This is a very shady business!

As I said, the bolt broke, it has nothing to do with the kickstand being down properly, but I am done arguing with you. Period.

We   can rent to minors  there is no law against that. On the motorcycle that  he rode had  a spring loaded kick stand if you dont put the vehicle correctly on the stand it will  fall over it is  the customers reponsibility for damages to  the  equipment they rent.

First of all, you didn't read very well. The second bike had an issue when it was rented, the first one had no brakes and was swapped, lucky for you he was not hurt. The second bike, he questioned the fact that it was leaning so far, and was told, "It has always been that way". Come to find out, the steel bolt holding the kickstand was damaged from previous rentals and it broke. My son does not weigh enough to break a steel bold designed to hold a kickstand, if he did, then it would not hold the weight of the bike itself. Secondly, it was not night time when it broke, it was only a couple of hours into the rental, and you not only took his deposit and bike, but his friend's also. So you got rental on two bikes that they didn't get to keep for even a fraction of the time allotted, but you got their deposits as well. The equipment you are renting is damaged but is still being rented in the hopes that some sucker will pay for you to do repairs. The proper way to do business is to have an inspection sheet and go over the rental with each customer and have them sign that the vehicle is acceptable before it leaves. However, you don't do that. Regardless, I am just warning others not to rent from your business. It's in their best interest to stay away from you and your establishment. Your rentals are dangerous and can put the lives of others in danger. Geez, renting a bike without brakes? Come on and with damaged kickstands? Come on!

They said they had an  issue with the bike  and  immediatly we fixed it. Next the had the vehicle for  all night they  had no  problems til  the  night.  When it fell  over that usually comes from the  customer not  putting the  kickstand  all  the  way  down. The vehicle  got scratched and  damaged  they  should  have  to pay  for  damages that they did. They sign reponsibilty for the vehicle. We make them reponsible and thats not a  scam dont  damage the equipment and we  have no  issues.

   Your son is 17.  He is not old enough to sign a contract.  Any contract signed by a minor is not enforceable.    I think you should sue the cycle renter to get your son's $100 back.  You would probably win.
