We had purchased a 2004 Mustang in May of 2007. We have never missed a payment in fact paying every mlonth by Money Gram on time. Even while I was off work for 4 mths we still managed by letting our mortgage get behind. Well I called and informed CPS that we could no longer afford the car and want to surrender it voluntarily. Now they say that is not an option, they threaten to garnish our wages, and are now making harassing phones calls several times a day to family and friends. Luckily they do not have my work number. We have told CPS let us know a day and time and we will have the car ready with both sets of keys, as it is stored in garage being winter.

This company will not stop and will not take the car. They have and are doing this to most all others, and something needs to be done to stop this copmpany. I agree when someone said they are loan sharks, either that or with the Mafia. I have never in my life dealt with a comapny like this and will be locating an attorney come Monday for legal help.

Wanting to Join in Class Action Lawsuit

We are also wanting to join in on any Class Action Lawsuit against CPS. PLEASE if there is a lawyer out there listening I too want to sue this company, not for the money just to get out from under the car and from CPS. Harassment is supposed to be illegal. How can they get away with this. We have had to disconnect our home phone as they kept getting it.

CPS have tried pulling a scam twice having a guy call and say he was on his way to repo the car, we waited 3-4 hrs both times, pulled the car out of garage and he never showed up, but both times within 30 minutes from those calls, CPS would call and say they needed to speak to us in regards to our payment. They REFUSE to let us surrender the car, they REFUSE to call us on our cell phones, instead calling my husbands work, family and friends. But NOT us!

SInce last report, I have gotten two phone calls from a guy who claimed he was on his way to get the car, twice he never showed, and twice within 30 minutes from that call CPS phoned and wanted to work something out. They are npw playing the game calling my bluff and it will not work.

STAY FAR FAR AWAY FROM CPR. They are ignorant, arrogant jerks.

Some things you need to know.

First are to really believe that you would let your mortgage payment go behind to be sure the car loan is paid? If this is the case that is not really smart, your mortgage should be the FIRST thing you always make sure is paid.

But don't think a voluntary repo will get you totally out of the loan. A Repo is the same whether it is voluntary or involuntary. If they repo the car the bank will sell it at auction for much less than it is worth. You are still responsible for the difference between that and the loan balance. For example if you owe $20,000 on a loan, the car is worth $16,000, and they repo and sell the car for only $8,000(not out of the question) you still owe $12,000 plus the repo and auction fees. If you fail to pay this they can file suit against you and if they get a judgment, garnishment is a possibility and the can take up to 25% in MI.

You got a loan from a company that deals with "less than perfect credit". Which means you probably had issues in the past. You did not have to get a loan from this company, but I would venture a guess that no other company would finance you. But even if you did get another company don't think that it would be any different.
