I have decided to make my experience with PKTV, Cooking With The Stars (a TV show currently in production) and Daniel L. Dailey, President and Owner of PKTV, public for a few reasonsFirst, to solicit legal advice and second, to make people aware including former clients why I am no longer with the company.
I received a phone call at my desk in the office of PKTV Monday 10/21/08 from Dan Dailey stating "Get the F@$K outta my office, I don't want to work with you any more, you're fired". I tried to ask what I did wrong but was told to get out and I better not be there when he got in. I was told by another employee that he was drunk and on XANAX pills so don't try and reason with him. Apparently this is a common occurrence and was told by other employees to just go home and see if he calmed down later in the day.
I thought that he may have fired me because i was asking to many questions about why "Cooking with the Stars" had not begun airing on the Bravo network in October as we were told and why it does not appear on the Bravo network website schedule as upcoming programming. I came to find out from both employees of PKTV and others who have communication with Dan Dailey and his employees that he fired me for going out with a group of PKTV staff members Friday 10/17/08, one of which was his former girlfriend who he believed I was sleeping with.
At this point I have NO desire to reconcile with Dan or the company but believe that I was wrongfully terminated and that he has in fact broken the law. I am owed commission money that I don't believe I will ever receive so my question to the public, legal advisors and/or state agencies is how should I proceed and should I request not only my commissions owed but a severance package for wrongful termination.
I know that I can file a report with the Florida Department of Labor as well as the State Attorney's Office but I don't want to go that far if Dan is willing to settle this with me directly. I have also been advised to consult with an attorney who will handle the case on a contingency basis so I will have no out of pocket expenses. I believe this is the best route to go since I have witnesses willing to testify that they indeed heard from him first hand the reason for my termination.
Since being terminated, I have begun looking into some of the past businesses of Daniel L. DaileyGOOGLE is an amazing thing. There are quite a few links on the internet concerning companies that he's owned. I intend to keep this posting current as i go thru this process and i will list some of those links in future postings.
I want to apologize in advance to the other PKTV employees whose businesses will be affected by this and future postings but i feel that i have no other recourse. I intend to keep this process public so that at no time can I be accused of any form of wrong doing while seeking a resolution.
