This means the driver is paying for this contract, not Covenant. This is just plain wrong! If Covenant wants to have contracts like this with their shipper, then Covenant should pay the detention pay to the driver instead of the shipper. The driver is the one sitting without pay. They should be compensated no matter what. Just goes to show that with Covenant, you are just a number... not a driver.
Also, if you do plan to drive for Covenant, always, always, always call the Shipper/Receiver yourself to get directions. Do not count on their directions. I have even sent in updated directions and when I get sent back to the same location, the old (and incorrect) directions are still sent to me. They just don't seem to care about their drivers. Trust me, it's not fun getting lost if a big city with no place to stop and no way to get turned around. GET THE DIRECTIONS YOURSELF!!!

POSTED: Sunday, April 16, 2006Do everything right and document all conversations and qualcomm communications in a notebook. Names, incidents, dates and times.
Then, DO NOT quit. Let them fire you so you can at least collect unemployment while looking for another job.
Be sure to engage in proper DOT logbook proceedures, and make sure you never operate outside of legal hours, and always document ALL time that you are required to be at a shipper or reciever as ON DUTY/NOT driving.
Be sure to put all detention events on your logbook.
Now use your logs as evidence with your state wage and hour division and the USDOL and file wage claims for your detention pay.
Under federal and state laws, employers are required to pay you at least minimum wage for any time that you are required to be at work, or in readiness to work, or on any jobsite.
That is the law. Get paid.
Also seek out a union such as the TEAMSTERS to organize the company. At very least you will cost them 10's of thousands of dollars fighting the organization attempt.
There are many ways to skin this cat.

There are certain areas that detention pay does not pay. One is if you are running dedicated. Another is if your are running interregional. There are a few shippers/receiviers that do not pay detention pay.
Now you realize these companies are out to make money. It is not about you or other employees, its all about the mighty dollar. Sorry but that is in any company/profession.

POSTED: Friday, April 14, 2006As long as you are an EMPLOYEE/Company driver you can file both a state and federal wage claim for your time your employer REQUIRES you to be ON DUTY in READINESS TO WORK.
Also, be sure to log all detention time as ON DUTY/NOT DRIVING. You will need the time documented for your wage claims.
AND, all time detained at a shipper or reciever where you are awaiting load or unload is REQUIRED by DOT to be logged as ON DUTY/NOT DRIVING. (Be sure you are in legal compliance).
Calculate your total ON DUTY time for the week and then figure how much you grossed. It must be at least minimum wage if you are an employee/company driver.
