This company is ripe for several counter-suits for harassment. Creative Memories makes judgments with no proof what-so-ever, they harass innocent individuals through e-mails and the Postal Service.
The bottom line that Creative Memories needs to realize is this: We operate in a Capitalist Economy, there is this great concept in the USA called Free Enterprise. Once Creative Memories has sold their product and got their money, it's none of their damn business what the consumer does with the merchandise, whether he re-sells it or uses it as toilet paper. They may keep their consultants on a short leash, but they are powerless to make demands to private individuals who have no connection, obligation or commitment to their company.
Don't let Creative Memories bully you into giving up your rights. Teach them the lesson they need to learn and buy exclusively from the secondary markets.

It is wonderful that his wife has been one of the lucky Creative Memories consultants who have found a successful way to bring in some additional money into the home.
But I have a word of caution for him and his wife, and a note of agreement regarding the many complaints against Creative Memories.
Once she decides that she no longer wants to sell Creative Memories, whether that is this year or years from now when she's older, what does she do with the remaining stock that she has acquired over the years? Creative Memories would like her to be stuck with it for the rest of her life. Which is truly unreasonable and illegal.
I agree that the company is ripe for law suits and I'm amazed that they haven't been sued multiple times by now.
Creative Memories has the power, and uses it often and indiscriminately, to cancel and prevent sales on ebay of Creative Memories products. Which goes against every right and concept of fair trade, competition, individual rights, and the legal limitations of the non-compete agreements that the consultants do sign.
Creative Memories produces wonderful products, it is a shame that the company is NOT wonderful, but resorts to threats and bullying tactics. I for one will never do business with Creative Memories again and plan on fighting them for my rights every step I can.

You need to go back and read the original post again. Jack did not say he was a CM rep. If he has no contract with CM, he is not bound by their rules.
For example, my wife sells Mary Kay. As an Independant Beauty Consultant, she is discouraged from selling product on eBay, at flea markets, etc. But if someone buys product from her, they have every right to redistribute the products in any means they see fit as they are under no obligation to the company.

I've heard about this secondary selling complaint and I understand the idea of a free market economy. I've also heard of the word "contract" which every consultant signs before starting their business. The contract stipulates the ways in which Creative Memories does business. You don't distribute product through secondary means. If there was no contract in place you would have a point but there is. People who are selling it on ebay, etc... are simply being dishonest in regards to their contract.
