Credit One Bank i just barely activated my card yesterday and i was already charged a 75.00 dollar fee and i have not even used the d*mn thing, this bank does not even have a email address that i can contact them by las vegas, Nevada

This Credit One Bank is a major scam it never said in there policy info that I would be charged a fee for activating the card of course they probably would have charged me if I didn't activate the card, so basically they can burn in h*ll cause they will not get a cent from me.

I thought it was strange that Capital One would change their business practices to some of the same tactics that Premier bank is known for. Premier bank in my opinion is sketcy at best; they have all these fees such as activation fees, Membership fees, bend over and take it fees and the all mighty APR of 24% and up. When I went to type in the web address is when I caught the name difference..and it began my research and reviews. WOW! the reviews took me here.
As I was reading all the reviews I was so glad that I did my due dligence. I think that prepaid credit cards are much more efficent than pre-paying all the fees before you even get the card. I remember that a close friend told me that she actually received her Credit Card bill before receiving the card. The person who said that we need to read everything... is right. But why do they not make it in big bold letters ; as big as the credit line up to $1500.00. We are consumers not lawyers or investigators whom expect companies to be honest and use the trade as an honest representation. Instead they almost rely on the fact that most people do not read the fine print or the back of the offer.

Yes, we were all stupid (and we are well aware of that now) for taking on this company's credit card and it is a stern lesson to us all to read thoroughly (and not just scan) the fine print in future.
However, you are also guilty of scanning because I clearly stated in my report that I am having major problems with this company, despite paying them every month. I know I owe them this debt and that it has to be paid back .. believe me, the card is already cut in two and I will be repaying this in full asap!!
And yes, the District Attorney's Office have a Consumer Protection Unit, which will prosecute companies for unfair business practices.
The purpose of this site is for people to report if they have any problems with companies as a way of warning others who are thinking of doing business with them in the future. It is not for others to come on here and bash us for being so idiotic. But hey, to err is human, right? We live and learn.
If what you say is true about their continual phone calls, I hope you can document it. Under the Fair Debt Collection Act (http://www.ftc.gov/os/statutes/fdcpa/fdcpact.shtm#806) they can't do this. But I'm not sure it's something the DA can address since it's a civil action. Perhaps one of the many attorneys who read ROR can answer that.
There is also a paragraph in the FDCPA that says:
c) CEASING COMMUNICATION. If a consumer notifies a debt collector in writing that the consumer refuses to pay a debt or that the consumer wishes the debt collector to cease further communication with the consumer, the debt collector shall not communicate further with the consumer with respect to such debt, except --
(1) to advise the consumer that the debt collector's further efforts are being terminated;
(2) to notify the consumer that the debt collector or creditor may invoke specified remedies which are ordinarily invoked by such debt collector or creditor; or
(3) where applicable, to notify the consumer that the debt collector or creditor intends to invoke a specified remedy.
If such notice from the consumer is made by mail, notification shall be complete upon receipt.
So perhaps writing them would help stop the abuse as well.

1. The staff at the call center in India are lying to people. They told me if I could make minimum payment that they would bring my account up to date and deduct the late payment fee. I actually thought they were being reasonable and borrowed the money from friends for three months running to make this minimum payment, only to find that my balance went up, instead of down. And my balance has actually gone up far more than the Capital One Card. Next time I speak to them, I WILL BE RECORDING THE CALL.
2. They are not just calling to try and get their money... they are harassing me. Despite the fact that they were made well aware of my situation from day one, they are harassing me for 12 hours a day non stop. I am not exaggerating when I say that they are calling my cell 1 or 2 times every hour and they are calling my house number every 10 minutes (I also have print outs of the number of calls coming in).
When I do answer the phone, it's the same conversation over and over:
"I have been unemployed for three months and do not have any money to give you".
"If you just give us $50".
"I don't have any move to give you. I have no money, no rent, no cable, no food".
If you just give us $50 we will bring your account up to date (liars)"
Then I put the phone down and within 2 minutes they're calling again. It's the same conversation every time.
It has got to the stage where it's pointless answering their calls and 'm having to let my phone go to voice mail because I don't know which calls are from them because they are also using local numbers.
I'm on a back to work program and have been advised that, if you let your phone go to voice mail, then, because they have so many applicants to choose from, a lot of employers will just bin your application if they don't get an answer. Credit One Bank have probably cost me a lot of interviews and I obviously need to get back to work so that I can get rid of this debt asap.
3. I also believe that the naming of the card was a deliberate ploy. I'm reading complaints from a lot of people who thought it was a new Capital One card. As soon as they approve the card, there's a $75 charge and from the other complaints I'm reading, there's no way of canceling out of this contract.
So yes, my complaint is going to the District Attorney's office today and they can decide on whether your company's business practices are dubious or not, whether they believe your calls are 'just chasing payment' or harassment, and whether or not they believe that your company clogging up both of my phones is costing me employment or not.
When someone posts on ROR, whether they ask for advice or not, people will chime in with the truth. To wit:

Because they want their money? Shame on them! Be sure to tell the DA that you owe a balance.
Their business practices are dubious (to say the least) and their charges extortionate.
But you approved the fees when you accepted the card.

Youre lucky with the other creditors. There are many people on ROR who will tell you that Capital One WONT work with them. Credit One is under no obligation to be nice.
With the exception of Charles, the other posters were merely pointing out the truth and facts of life.... that many of these complaints stem from people who don't read the contract or agreement, and then blame the credit companies when they want their money. It sucks that you lost your job but life isn't always fair.

There is a MAJOR problem with this company and I am about to file an official complaint with the District Attorney's office in Nevada.
Their business practices are dubious (to say the least) and their charges extortionate.
I unfortunately lost my job after taking out this card (through no fault of my own I might add). I contacted my creditors immediately and told them what the situation was. For several months now they have all been very understanding and patient with me ... apart from Credit One Bank.
I received a call from Credit One Bank when I missed my first payment. They asked if they could take $25 out of my bank account; that the late charge would be deducted, my account would be brought up to date and that I wouldn't receive any more phone calls until the 1st of the following month. I agreed.
Next day, at 8am, the calls start all over again. I referred them to the call from the previous day and they said they had no record of this (despite the fact that they say all the calls are recorded) and of course, no, the late payment charge wasn't deducted and the account wasn't brought up to date ... they just pile on more charges instead!
And, even although I have been paying them something every month, my balance has gone up $100 over the other companies.
They are the ONLY company that I have been paying a little to each month and yet they are the ONLY company that harass me. They call my house and my cell from 8am until 8pm every day. The calls are coming from an Indian call center, where the staff speak very poor English. The calls come through a call center number and also through local numbers, so it's got to the stage where I'm afraid to answer my phone. I can guarantee that, because of this, they've also prevented me from catching important calls for jobs.
I have to also say that, Capital One, who I also owe to, has been a vastly different experience. They send me letters once a month asking if they can help, they don't bother me on the phone 12 hours a day non-stop. Unlike Credit One Bank, they have received nothing from me in the past 3 months and yet have charged me less in charges and interest.
I'm sorry I ever took this credit card (and yes, that was a VERY poor choice on my part) and would strongly advise anyone against taking one of their cards. Even if you are working and making payments every month, their interest charges are extortionate.

The only thing I want to say and make very clear is this, in the believe the most people that came one this site was looking for help or were trying to help someone out, I dont think the harsh words are needed, I would say give people the info and let them make up their own mind.... People that get these things in the mail sometimes are looking for their last chances just give them that.

Yes...I agree their "terms" are a rip off in every sense of the word..but it is NOT a scam since they fully disclose the terms. And it is not a book or confusing to anyone who can simply read English..they usually explain it all on the back side of the letter. IF there was no disclosure of the fees and interest rate then it should go into the garbage by default.
You ruin your life by your own actions, and you have even admitted this fact. Yet you choose to blame the people who post on here of "ruining your life". How ridiculous. How could someone who lives hundreds of miles away from you POSSIBLY have any effect at all on your pitiful little life ?? Please answer this question when you get out of jail this weekend. Jail-bird Donkey-boy.

Then actually changed our methods to avoid making them again.
My sister who is a bank teller tells me about people who got in trouble at the bank, came in, she explained how to use a check register and how some of the policies really work. Some of them actually take the advice, maybe contact her now and then after that with a question, but change their approach, get control and she doesn't have to see them again. Some people really can learn.
How many people here post amazingly poor choices and then get all bent out of shape when someone suggests what they did wrong, how to correct it and how to avoid doing it again?
Most posters seem to just want sympathy and have no desire to actually learn from their experiences and make changes.
Those are the ones who are the most frustrating and just get themselves deeper and deeper in debt and trouble.

Most posters seem to just want sympathy and have no desire to actually learn from their experiences and make changes.

Take the OP, for example. S/he obviously has bad credit, given the card she got. Note how in just this one case, the bad credit cost this person money, in higher fees and interest rates. There are probably many other times this person had to pay more because of bad credit, e.g. when buying a car.
The smart thing to do is to use this new credit card to build up their credit again, by using it VERY sparingly and paying it off each month (this also avoids interest charges). But what does the OP do? S/he says s/he will not pay a dime of the $75, thus RUINING HIS/HER CREDIT EVEN MORE. This drives me nuts, as it is one of the many things that makes poor people poorer.
You know, when many people say that poor people have themselves to blame for being poor, they mean that the poor should work harder. I do not think that is the problem; the problem is that they make poor decisions. Yes, they also usually start off poor, and are at a huge disadvantage; I do not want to minimize that. But if the poor could just stay away from lotto, rent-a-centers, single motherhood (that one is HUGE), payday loans, etc., it would make a huge difference in their lives.

Again, as you've seen here by other posts, if you don't pay them, your already bad credit will be damaged further. Also, these subprime lenders do not play. They will get a judgement against you & if you actually work, your wages will be garnished + court costs + legal fees. Chalk this up to an ignorant mistake on your part and pay the fee & move on.
Like all the poor folks who signed mortgage agreements & now claim they didn't know what they were signing and have lost their homes, you can't cry wolf once you sign on the dotted line.

You can choose not to pay them, but once you activated the card you commited yourself to the annual fee. They WILL report this to the credit bureaus and you'll be worse off than you are already.
ALL of their credit cards have a $75 service fee for the first year. After the first year, the annual service fee is $99. Their interest rates are equally ridiculous.
These are SUB Prime credit cards for folks with little or bad credit ratings. Perhaps you should READ credit agreements BEFORE you apply for credit.
