at its best!

I and my 80 year old parents received numerous calls from an individual identified as "Mr. Robertson." He claimed he represented a Law Firm that was going to prosecute me for fraud involving a delinquent Bank America account. He claimed I maxed-out my credit limit with no intention to pay, thus, "committing a fraud!"

After offering me an unattainable offer, I declined and said it was unreasonable. He continued to say that I would be prosecuted for fraud and misrepresentatiion and continued to call my parents, suggesting that they make good on the delinquent account.

A short time later, I called and made arrangements with someone else that was more suitable to me, taking into account my current income. He called back and said that the employee who had made these "acceptable arrangements," had no right doing this and it was unacceptable to him.

He continued the harassing calls, at which time I refused to answer.

In conclusion, I would love to settle this account, however, his terms, coupled with his demeanor, made it impossible.

Q: Should I call Bank of America and try to settle with them?

Thank you!

#1 Consumer Suggestion

Do Not Deal With Them

AUTHOR: Kmmp - (U.S.A.)

Here is what you need to do, do not talk to them, you need to send them a Cease And Desist Letter and a letter demaning verification of the debt. This will shut them up for 30 days. Search for a website called creditinfo or something like that, that is where I was able to print and download sample letters as I mentioned above. This is a great website for information on how to deal with them. What will eventually happen is that they, having no success in getting you to cough over money, will return the debt to Bank of America. Then you can try dealing with them. If you make any settlement whatsoever, ask them for a settlement letter before you pay them....never send money without it.

Apparently all of us who are in default on a BOA credit card and who have to deal with these slimebags are committing fraud. Also, you can file a complaint. Look up the Federal Trade Commission, they have an online complaint form. Also, look up the Fair Debt Collection Practices Act. It is against the law for them to accuse you of a crime they cannot prove you did.

Good luck.
