Hello,

I have invested $300 in cresco technologies for their training and placement for SAS clinical program. In the past 2 weeks I have received countless false promises that the service and training will get better. I was promised that each training session would be 60-90 minutes Monday-Friday. Initially I gave them $100 to start the course. After taking the course for 3 days I was getting mildly frustrated because each session was about 30-40 minutes instead of the promised 60-90 minutes. After expressing my frustration level with Niyaz (Manager at Cresco Technologies) he assured me that things will improve because the instructor did not want to overwhelm me since I was a beginner to SAS. After understanding this I continued with cresco tech's training. 

After having numerous conversations with Niyaz (Manager) about the training I was told if I wanted the software I would have to make pay the second installment of $200 which I did. I paid the $200 after I had a long conversation with Niyaz (Manager) and he promised that things will improve. After receiving the link to download the program I needed assistance to install the program. I downloaded the program which took about 6 hours to download, I did not know how to install it because it was .NRG file. So I called and emailed Niyaz for technical support and did not receive a response all day. After sending another frustrating email to him about how I did not appreciate the false promises, I later received an email from him stating that he would assist me in installing the program the next day at 11:00am cst which is 12:00pm est. So the following morning my training with the instructor was scheduled at 10:30am est. which ended at around 11:10 am est. (another 40 min session which was supposed to be 60-90 min) I waited for Niyaz's phone call. Again I did not receive a phone call that I was promised. So I decided to call him instead and I was told he was in a meeting and he would return my phone call when he was finished. Finally he called me back at around 1:20pm est. which is 2 hrs and 20min after the promised time. Again I shared how my frustration level was at a all time high and once again he promised that he would help me install the program today (August 1, 2012) at 5:00pm cst. (6:00pm est my time) and I agreed. So as promised he called me around 5:00pm cst. and he tried installing the program on my PC using Team Viewer. So after spending a half hour trying to figure out how to extract and install a .NRG file he told me he would contact his "Admin department" and call me back (The half hour he spent while I was watching him trying different ways of installing the program it seemed he had no clue of what he was doing). I waited all night until 11:00pm est. and still no phone call. So I finally called him today August 2, 2012 I told him that I was done with Cresco technologies making it clear that I wanted my refund after giving them so many chances. When I asked Niyaz (The Manager) for a refund of $300 so we can peacefully part ways without any confrontations he clearly said "I will check with my management team and call you back" and before I was able to respond to him he quickly hung up. Then he called me back today (August 2, 2012) at 1:17pm est. so we spoke peacefully and he continued to tell me that he was in the process of resolving the software issue and I simply told him do not bother I just wanted my refund. I pleaded to him about a refund and once again he told me he would check with his "management team" for a refund. So It is now nearly 4:00pm est. and I have yet to hear from him.

So to recap I paid an initial start-up fee of $100 and after expressing my disappointment to Niyaz (Manager) he convinced me that it will get better after giving him the benefit of the doubt I paid the $200 installment to get the software. Now the past week and a half I have been calling and letting them know how poor their service is they have continuously dodged my phone call. And now every time I call the receptionist either tells me he is in a meeting, not in the office, or in another department. I also tried calling the refund policy number they provided to me in their terms & conditions (which I have provided below) after paying the initial fee and the phone number is out of service. If any one can please help in resolving this issue I would greatly appreciate it. You can reach me (((REDACTED))) any suggestions are welcome. Thanks.

Terms & Conditions
This Training Agreement (hereinafter "Agreement") is entered into by and between, "Cresco Tech" WHEREAS, Cresco Tech provides certain software-related services to businesses, including Analysis, design, programming and implementation of application systems; and WHEREAS, Cresco Tech, in an effort to fortify its workforce, is interested in entering into Arrangements to provide certain individuals with software training that, in Cresco Tech's opinion, could Render such individuals qualified to seek and gain employment with Cresco Tech; and WHEREAS, Consultant has expressed an interest in working as an employee of Cresco Tech And receiving such software training; NOW, THEREFORE, in consideration of the respective promises and representations contained in this Agreement, Cresco Tech and

Consultant agrees as follows:
Cresco Tech shall provide the following services to Consultant: Cresco Tech shall provide marketing services to the consultant. If Consultant participates and completes, to Cresco Tech's satisfaction, the pre-marketing Process referred to in Paragraph 1.a of this Agreement, Cresco Tech will, within two to three months of the date Consultant completes pre-marketing process and upon starting marketing and upon Submitting the updated resume as per the requirements, and upon clearing the vendor submissions, secure and will try to coordinate at least three Interviews between Consultant and current or prospective Cresco Tech clients who may be interested in utilizing Consultant's services. (Not Applicable if consultant has restrictions.)
Consultant shall diligently complete the pre-marketing process contemplated by Paragraph 1.a of this Agreement, and shall attend all phases, and other scheduled tasks that are part of the pre-marketing. Consultant shall also make himself or herself available for all of the Interviews called for by Paragraph 1.b of this Agreement. Satisfactorily to participate in the pre-marketing or fail to be available for Cresco Tech presentations/Mock-interviews or fail to attend interviews with Cresco Tech clients, Cresco Tech will be relieved of all of its obligations under this Agreement, and will be entitled to retain the Security Deposit.
If Cresco Tech secures the interviews referred to in Paragraph 1.b of this Agreement, and if one of the current or prospective Cresco Tech clients who Interviewed with Consultant wishes to utilize Consultant's services, Consultant will be required to execute with Cresco Tech an employment Agreement. Consultant should work with the Company after the placement for a minimum of 12 In exchange for the services called for by Paragraph 1 of this Agreement, Consultant shall pay to Cresco Tech an agreed upon fee (hereinafter "Security Deposit").

The Security Deposit is due in full on or before the commencement of the marketing services called for by Paragraph 1 of this Agreement. If Consultant is employed by Cresco Tech as contemplated by Paragraph 3 of this Agreement, Cresco Tech will refund the Security Deposit to Consultant after Three (3) months in Three monthly installments, the first installment starting at the beginning of the fourth month of theCommencement of that employment; provided, however that Cresco Tech shall be entitled to retain the security deposit if the Consultant fails to complete the pre-marketing process, fails to attend the Presentations/mock-interviews contemplated by Paragraph 1.b of this Agreement, or fails comply with the terms of the employment contract with Cresco Tech. Cresco Tech makes no representation that the marketing service called for by this Agreement is suitable for any purpose other than Consultant's employment with Cresco Tech. Cresco Tech does not warrant the suitability of such marketing services for any particular purpose, and disclaims all liability for any claims regarding any deficiency with it. This Agreement constitutes the entire agreement between Cresco Tech and Consultant regarding its subject matter, and supersedes all prior agreements or understandings between Cresco Tech and Consultant regarding that subject matter.
This Agreement shall be subject to and interpreted in accordance with the laws of the State of Michigan. Should it be necessary for Cresco Tech to take any legal action to enforce any of the terms of this Agreement, Consultant agrees to pay all costs and reasonable attorney's fees incurred by Cresco Tech in connection with such action. Should any portion of this Agreement be deemed unenforceable by any court of law, arbitrator, or any other person or entity entitled to adjudicate rights and obligations under it, the remaining provisions hereof shall remain in full force and effect to the broadest extent possible

Change of Trainer 
 
If you want to change the trainer you have to make a written request to ahamed@crescotech.com before 3 sessions.After attending 3 sessions you cannot change the instructor.If have changed the trainer once then the third change will not be made after attending the 2 classes.

Refund Policy
Cancellation of sale is subject to following refund policy:100% Refund before attending a class 80% Refund if requested upto 2 hours (or 10% of the course depending on the course) of classes. No Refund after attending 2 hours of classes (or 10% of the course depending on the course) or after attending 3 sessions.Request for Refund must be made in writing and mailed to ahamed@crescotech.com.  Any oral request for refund will not be accepted.
