In 2005 I was starting to get credit card offers in the mail and thought, Oh what the heck, I'll find out if I can get a credit card. I filled out and mailed in the application and a couple of weeks later I received a credit card with a $250 limit. I used it a couple of times and then forgot about it. As a matter of fact I completely forgot about it because I did not receive statements in the mail.

In 2007 I started getting harrassing calls from Capital One and I tried to locate the invoices as I believe the charges were under $100 and the calls said I owed $600+, so I kept searching for the invoices and charges so I had something in hand when they called back.

By the end of 2007 I was receiving harrassing calls from Daniel N. Gordon, PC offices where they claimed if I didn't pay my credit was going to be bad. I decided that after several calls from Daniel N. Gordon, PC, colletion agents for Capital One, that I would pay, since Gordon's office gave me a payoff amount that I could afford, so I paid $513.08 to Daniel N. Gordon, PC, which they said would clear up my negative credit report.

About a month went by and then I started to receive harrassing calls from a different collection company for Capital One. I can't believe it started all over again even though I have copies of the cancelled check which was received by Daniel N. Gordon, PC.

The calls are still coming and it is now July 2008 and Capital One claims I owe them over $700. The collectors keep asking if I have proof and I tell them I have a copy of the check I paid Daniel N. Gordon, PC. The collectors now tell me that Daniel N. Gordon has told them to continue to try to collect from me.

I have gotten tired of the harrassing calls and threats from Capital One collection agents and decided to try to collect information from the callers in order to file a court suit through our local civil attorney, so I tried to get names and numbers from all collectors. The collectors got extremely mad when I tried to get information from them and I haven't received a threatening call in about two weeks.

I am glad I haven't received the calls for a while, but, I believe the harrassment will begin again if something isn't done. I believe they will wait for a while and then try to collect more money from me and I believe with the payment I sent Daniel N. Gordon, PC the debt should be completely retired

Yes, Daniel N Gordon of Daniel N Gordon PC has, in my personal experiences and opinion, had issues with getting confused with his client's cases. I won't go into detail, but can tell you that you need to keep a forward focus on your situation as these people have a habit of being ruthless.

Ok, I'm sorry you paid Daniel N Gordon's office that money. Yes, you shouldn't have paid him a dime, but that's too late now. So, what CAN you do with collection agenceis or attorneys who harass you? Well, keep your cancelled check for one, never lose that as you might need it in a court of law in the future.

This is not rendered as legal advice, but as how I have handled things personally with such "people." As the burden of proof lies with the collector, and by the way, the collector is NOT the creditor...big difference as collectors have no rights really to claim that you owe them money. How do you stop the harassment? Simple, here's an example of a cease all communication letter you can send to any collection agency that is harassing you. For more information on how you can help yourself, I highly recommend the website of budhibbs.com. There is FREE information there that will help you, including ideas for the cease comm letter, which in a nutshell is a document you send to a harassing collector that will stop them in their tracks, legally. Here is something that I would send, and have sent for myself in the recent past.

Dear XXXXX collector,

(Collectors address)

RE: (Their "account" number and origional creditor

This certified letter has been sent to you to inform you that I do not wish to work with a collection agency in any fashion. You are hereby PROHIBITED from communicating with me via ANY method. Violation of this CEASE AND DESIST ALL COMMUNICATION letter is a violation of FEDERAL LAW under FDCPA, the Fair Debt Collection Practices Act of Congress, which allows me various remedies and can result in serious legal and/or criminal consequences for your agency or its employees should they violate this ORDER. I will contact the original creditor and discuss this only with them.

Give this full attention it deserves and govern yourselves accordingly.
