The Complainant challenged the truthfulness of 10 specific Statements posted on www.ripoffreport.com by the Author of Report #887156.  The Author did not respond to the Complaint filed by Complainant in the time allowed and therefore is not participating in this Arbitration.

In accordance with the Ripoff Report VIP Arbitration Rules (the “Rules”), the Arbitrator was asked to decide whether each of the 10 challenged Statements is an opinion or a Statement of fact. If, and only if, the Statement is determined to be a Statement of fact, the Arbitrator will then go further and decide if, by a preponderance of the evidence, the statement is true or not. 

Each Statement challenged by the Complainant has been considered, together with any Witness Statements and/or Documents provided by the Complainant for the determination of the truth or falsity of the Statement.  The Author did not, in accordance with the Program Rules, properly submit a response to the Complaint. 

In this case, the Arbitrator has only the evidence submitted by the Complainant to consider.  The evidence submitted included: Ripoff Report #887156; 3 sets of tooth x-rays; a thank you letter to the Complainant for the referral; an additional Ripoff Report; an Arbitration Award; and a determination by the Dental Board of California that the Complainant did not violate the Dental Practice Act.

The Arbitrator was further asked to decide whether the preponderance of the evidence submitted to establish the identity of the Author of Ripoff Report #887156, shown as “LT.” Complainant essentially believes the Author who posted Ripoff Report #887156 is a competitor and posted the Report in retaliation as retribution for testimony given in a trial.  The Arbitrator found it more likely than not, given all of the evidence in this case, that the Author of Report #887156, was using his/her initials as the Author name for the Report.

The Arbitrator determined that certain statements in the challenged Report were false. Therefore, according to the VIP Arbitration Rules, those statements have been redacted.

In my opinion, Dr. David Eggleston is a horrible dentist. (((Statement REDACTED as false pursuant to Ripoff Report VIP Arbitration))). His ego is larger than life and (((Statement REDACTED as false pursuant to Ripoff Report VIP Arbitration))). I lived through sheer hell in pain. (((Statement REDACTED as false pursuant to Ripoff Report VIP Arbitration))). (((Statement REDACTED as false pursuant to Ripoff Report VIP Arbitration))). (((Statement REDACTED as false pursuant to Ripoff Report VIP Arbitration)))! (((Statement REDACTED as false pursuant to Ripoff Report VIP Arbitration))). Please take notice that Dr. David Eggleston (Dr. Eggleston) has issued subpoenas in the Superior Court of the State of Arizona, in the County of Maricopa, Case No. OCSC 30-2012-00592583 (the “Arizona Action”).  In the Arizona Action, Dr. Eggleston seeks to subpoena Xcentric Ventures, LLC (“Xcentric”), the company that owns and operates ripoffreport.com, for your contact and identifying information. Dr. Eggleston is a party in an action in the Superior Court of the State of California, in the County of Orange, Case No. 30-2012-00592583 (the “ California Action”), and seeks this information in connection therewith.


Arizona law requires that you be provided notice of the discovery request (i.e., the subpoena) via the same medium that the false and defamatory statements were originally published. By this post, notice is hereby given to you of Dr. Eggleston’s pending discovery request.


You have a right to timely and anonymously file and serve a response to the subpoena.  Such a response can include an objection to the subpoena.  Any response to the subpoena should be mailed by February 10, 2014, to Katherine M. Harwood, Esq., Ford, Walker, Haggerty & Behar, LLP, 1 World Trade Center, 27th Floor, Long Beach, California 90831. If a response is not received, Xcentric may respond to the subpoena and produce the records as outlined above. 


This notification is being provided to you pursuant to the Court of Appeals, State of Arizona, Division One holding in the matter entitled Mobilisa, Inc. v. John Doe 1, et al., 217 Ariz. 103, 170 P.3d 712 (Ariz. App. 2007).

On May 23, 2012, someone posted a complaint against me stating he/she received lots of bad crowns, lost a tooth, and ended up with 10 root canals.

I suspect this fictitious patient posting was prompted because I testified for a patient as an expert witness in a lawsuit that ended with a $641,442 judgment against the dentist, and I was the subsequent treating dentist in a peer review case that ended in a $27,635 decision against the same dentist.

On June 24, 2012, I offered a full refund if the patient would simply have the current dentist send me x-rays showing the treated tooth decay and the 10 root canals.  The refund would be about $30,000.

As of this date, August 14, 2012, no patient has surfaced for the refund and I have not received any x-rays.

I am a periodontist in Newport Beach and a long time dental patient of Dr. Eggleston.  This complaint is bogus.  I checked with the Dental Board and there have never been any marks, citations, or actions against Dr. Egglestons license.  Also checked for lawsuits - Dr. Eggleston does not have any lawsuits for anything for the last 25 years. 

I go to Dr. Eggleston as a patient because he is an excellent dentist.  He graduated from USC Dental School with the Alpha Tau Epsilon and Omicron Kappa Upsilon honorary awards.  He was the only student in the history of the dental school to receive the top two awards in prosthodontics The Daniel Cave Memorial Award and the Lewis E. Ford Memorial Award. 

Dr. Eggleston is a Board Certified Prosthodontist and past president of the American Board of Prosthodontics, the American College of Prosthodontists, the Academy of Prosthodontics, and the Pacific Coast Society for Prosthodontics.  Currently, he is on the faculty and the Board of Councilors at the Ostrow School of Dentistry of USC.

Dr. Eggleston has a wonderful, caring, professional staff who are extremely accommodating.  Many have been with him for more than 30 years.

Because of Dr. Egglestons qualifications and outstanding reputation in the dental community, he is called upon to testify as an expert witness in dental malpractice lawsuits.  He testifies for the defense when he feels the lawsuit is frivolous, and for the plaintiff when he feels the lawsuit is justified.  In my opinion, this patient complaint is not really a patient, just pay-back from dentist who lost a big lawsuit.

I have informed Dr. Eggleston of this patient complaint on Rippoff Report.com.  Dr. Eggleston is also of the opinion the complaint is bogus.  To demonstrate it, Dr. Eggleston stated, The patient can have the current dentist send me copies of x-rays showing the tooth decay and the 10 root canals.  I will immediately send the patient a full refund for the crowns placed in my office and a full refund for the 10 root canals.
