Dish acknowledges that they inaccurately billed me for a cancellation fee. They have asked Anderson Financial to remove any derogatories from my report. Anderson Financial ANFI has never done so. I would be glad to join a class action and share my correspondence with DISH and ANFI

Collection Agency refuses to remove incorrect info?

If your original creditor has admitted an error, and has notified the collection agency of the error, they are obligated under the Fair Credit Reporting Act to remove the negative information.

You don't need a class action suit to get this done. Simply read-up on the FCRA, and send the collection agency a letter informing them that they are in violation of the statutes, and that if they do not correct the information, they are subject to a $1000 per incident jusdgement.

Also, send the Credit Reporting Agency (credit bureau) a letter requesting an investigation. Include all communications you have received from the original creditor. The CRA must conclude their investigation with 30 days, or remove the negative information.

Don't let either the collection agency or the CRA bully you. Read the FCRA, it is not that difficult to understand.

BTW, most attorneys will handle simple letters of this type for a small amount of money. It is well worth you while to contact an attorney when it comes to this type of problem. (No, I am not a lawyer).
