Diversified Consultants Inc (DCI) is handling a debt that I had with another company. The very first thing she did the first time she called was give specific information reguarding the debt to the person that answered the phone, which is illegal. I set up a payment plan with a woman by the name of Ashley Smith that had automatic payments coming out approx the 22nd of each month. I got a call from Ashley approx. 04-01-10, letting me know a payment had been returned. I apologized, and explained to her that I was having problems keeping my account positive so that the payments for all my debts would clear. She proceeded to tell me that it was not her problem that I am unwilling to help myself, that I committed fraud, wrote her company a bad check (no checks were involved) and that she would be pursuing me in any way she could to collect the amount due in full. I was trying to tell her that I was not avoiding paying, but she cut me off to say that I was off the payment plan, and hung up on me. Since then, she has been calling almost daily while I am at work, my parents have given her my cell phone number to call, but she won't accept it and asks over and over when I will be home, telling them she "needs" to know when I will be home, refuses to tell them her name or leave a message, and has just today (04-22-10) told my mom that she "is good for nothing" because she didn't know what time I would be home. My dad called the number to try and talk to her supervisor, but could not get ahold of anyone. My parents have also told her every time she calls their house, that I don't live there anymore, it isn't a number to reach me at, and given her my cell phone number, and she continues to call their house. I have not recieved one single call on my cell phone from anyone at DCI, and I have given it to her myself, so I know she has it. At this time it has crossed the line from attempting to collect a debt to being abusive.

Getting the voice recordings from them will be next to impossible.  I'll not give you all the details but they usually aren't used in a friendly manner.  They nvr hold onto them for long either.  i can't give you a time length, but they probably took a cheeper route.  You, yourself, have to record them on your end.  There are cellphones out there now, that have recording devices built in, if you have one, then you've got all you need.  i think just make sure you save the data on the chip and you'll be fine.  DCI is currently in a big lawsuit,  here's the link of the docket (((Redacted)))  and here's the link about the law that was violated, http://www.law.cornell.edu/uscode/15/1692.shtml it's cornells website so it's pretty reliable. :)  This sounds alot like the same incident.  The "bad check" they keep calling you, is as you've already figured out, not true.  They ran an ACH draft to your acct.  It's like you running your credit card for something and it just says the funds aren't there.  If they tell you it's a bad check, then under the facts, they are lying to you.  This is a violation in itself, and i'm sure they've violated more then jus that.  If they don't use the 'Mini Maranda' when they speek to you, they've violated the law.  There are many different things they have to do on every call, or they've violated the law.  Some things are going to differ from state to state, so you'll wanna check into that.  I hope this info helps, let me know if you need any other questions answered.

The last 2 times Ashley has called, I did ask her numerous times through-out the conversation "this conversation is being recorded, correct?" and she did not answer me. If I am to assume that the calls were always being recorded, how do I get the recordings? If you could give me that info it would be greatly appreciated

Dear Kim,

   My name is very unimportant to this discussion, so i hope if you don't mind me not giving it.  The Michael person you've been speeking to, is named Michael Mathew Anna.  I know by the way he talks to you, you'd nvr believe that he's an authority figure up there, but he's 1 of 2 general managers.  What you need to do is get them to allow you to record the calls with them.  Florida is what they call, "A right to know" state, it's meaning in the phrase.  what you need to say is "we're both under the agreement this call is being recorded." or worded how it fits you best.  they will undoubtedly just say yes, they themselves are being recorded, so most likely it will slip their minds. Now this works on ALL Collection agencies.  once you've gotten these people recorded on how they talk to you and your family and then bring this up to an attorney in your area.  If they say it's good, then he'll contact them for you, and begin working out the settlement proceedures.  these guys won't fight you at all.  their insurance covers the costs.  not only will you have your cell phone paid off, but you'll probably get about 5-7,000 depending on the number of infractions and your attorney fee's.  all in all, not a bad way to make these people listen to you and still get your credit repaired.  DCI won't stop calling, these people will try and pester you day in and day out till you either change your # or just disconnect it completely.  I would also, for any of you other reading this, concider doing the same, oh and make sure it's an unlisted #.  any of your information is fed to a company called lexis nexus.  they have a web sight call Accurint where all this data is displayed, at a price of course, and it has your SSN, your B date, and your name.  linked to this will be your cell phone #'s, your parents info and #'s, and any other family member that they can find there.  this program also lists every one living on your street aswell with their numbers, if it can be found, and their ssn's.  I'm not sure if any of this information is useful to any of you, but take it from me, this is the only way to make them pay for the way they've been treating you and your family.  I am a former employee of the company and stand by what i've told you about these people and their practices.  Well again, i hope this helps.  Happy Hunting.
