July,2013...Looking to downsize the number of cars, I listed my 1953 Ford Customline Coupe on a website that advertises all over the US. It was registered, insured and driven to local cruises and shows daily. The ad had several pictures of the car and the desription was accurate and not misleading.  Mr. Condondemetraky called inquiring about the car. After a lengthy discussion we came to an agreement on the price which was considerably lower than I was asking.  He paid for the car with his credit card through Pay Pal.                                                                                      

 Several days later a flatbed truck arrived to pick the car up. The driver INSPECTED the car, SIGNED the sheet with the inspection steps on it and gave me a copy.  I drove the car onto the trailer.  

A few days later Mr. Condondemetraky calls and says the car is not worth what he paid for it.  He said the car was only worth 100.00. He asked for a partial refund. I told him that the car was well worth his purchase price especially since he paid less than what I was oringially asking.  He also threatened if I did not comply with his demands that he was going to file a CHARGE BACK with his credit card company. I told him I was not returning any of his money.

That I am not a dealership or business just a private owner.   Mr. Condondemetraky carried out his threat and filed his charge back. His credit card company in turn filed a charge back with my Pay Pal account.  Pay Pal sent the amount of the charge back from my account to the credit card company while the case is being investigated.  Now this man has both my car and his money waiting in the wings.                                                                                      

Meanwhile he has the car advertised for sale on his website dustyoldcars.com and Ebay for twice the amount he paid me for it.  He also has in the discription that the car is appraised for 9000.00. He has a video of him driving the car also in the discription!    I have been in contact with Mr. Condondemetraky telling him that if he wants the money back he has to send the car back.  He does not want to pay the return shipping.  I have been in constant contact with Pay Pal, they are in contact with the credit card company. I have made it known to both that this is a scam he is pulling hiding behind the charge back rules of both companies.

Both are aware thatMr.Condondemetraky does not want to ship the car back.  Pay Pal has warned me that he has to pay return shipping and not to make any agreements with him.  DO NOT deal with this man at all.  It is not worth selling your car to him. This IS NOT the first time he has done this! I am hoping that more people will see this and be forewarned!

Made his life miserable

It is nice to know that karma got that SOB. Trust me I am a pitbull when it comes to anything like this. I wrote Pay Pal everyday also faxed the credit card company everyday. He made the mistake of sending me an email with damaging and incriminating content!

Finally after three months of dedicated hounding, the credit card company gave me my refund. My advice to anyone is do not accept a credit card payment through your paypal, this way you are not dealing with a second party when you have to fight to get your money back.

I am so sorry to hear about the pay pal insident. Seems like intentional misconduct.

 

I am in the bankruptcy business and have owned several muscle cars. Watch out for Russians.  Also, Aftokinitorally Inc. filed chapter 11 bankruptcy this week. Carma is a b***h.  Go after his dealer license if it's exactly what you say happened.  Don't stop until you get justice or waste his time to the 11th degree.  File a small claims case against the business depending on the legal amount for the state small claims limit.

 

I never make huge payments via pay pal or only have a small amount under $100 in your pay pal/bank account.

Give it up DOC if you were the great business that you claim to be, you would not have to keep defending yourself and your business ethics. I won...that is all that matters. My advice to anyone that you pull this scam on is keep fighting and do not give up you will too. Anyone or business that purchases something and does not like it does not get their money returned and keep the item also. Like you say in your own policy 100 percent purchase price reimbursed if not satisfied as long as the vehicle comes back to me. That goes for the person you purchase from also...don't be a hipocrite.

It recently came to our attention that there are individuals that have sold us vehicles, that we have paid for via PayPal, that are attempting to tell people that we are doing something wrong.  This is absolutely FALSE, these people misrepresented their cars and lied to sell them to us.

1. We buy and sell 30-40 cars each month and we accept PayPal for the purchase of vehicles and use PayPal to buy them.  We do thousands of dollars in business each month and we are recognized by PayPal as an excellent Business Customer.

2. When we buy a car using PayPal we spell out the terms of the purchase using a Bill of Sale that specifies the condition of each vehicle.  This always includes if the vehicle runs, drives, has or does not have rust, or if there are other disclosed issued that we need to know about prior to buying the car.

3. Once we receive the vehicle we document, with over 200 pictures, the condition of the car, including if it is rusty or not.  Please see our website, www.dustyoldcars.com.

4. If and only if the vehicle is not as represented do we ask the Seller to provide us with a refund in full or in part.  Most sellers, over 95%, represent their cars honestly and there are no issues.

5. There are a couple of cases listed here, which we have won via PayPal on every issue, that clearly showed that the cars were misrepresented, i.e. very rusty, rotting, patched badly, did not run & drive, and then were not disclosed.

6. In ALL CASES involving this issue you will read the details and find that the Seller tries to make a case that we knew that the car had some issue, or that we are selling it for more than we bought it for, or one better, that they "FORGOT" to look under the car.

7. Everyone knows that if you buy something and it is not as represented that you are entitled to get a full or partial refund.

Keep fighting

 Southernboy KEEP FIGHTING call, call, call! Tell them you have not received the car back from him nor heard from him to make arrangements to do so. Pay Pal has the money in a specific account until it is settled. Did you receive an email stating that he has won the dispute? You will get an email when it is decided. So unless you did...he does not have his money.

 

Ask them for the fax number so you can give written documentation. I had plenty (If you have trouble understanding and comunicating with the person no offense meant) ask for another person to talk to.  They Have To forward it to the credit card company. It took just a little over three months to settle it. I just faxed them last week and I got an email telling me they received it.

Your computer and fax machine are your best friend and defense. If you have a printer with a fax and a landline phone faxes do not cost you anything.

I am sure it is busy this time of year. If you do not keep on this and push it that is how he wins.  This is all I can tell you as I really do not have proof of who you are. You could be Dusy Old Cars using an alias for all I know. Trying to get information on how to get better at pulling this scam. If you really are a real person all I can tell you is not to give up.

Documentation and letters are your best ammunition. Even if you keep sending the same thing. Keep reminding them that you will take the car back no problem. They tie your hands here as helping others that are going through this by not being able to communicate off this board. Good luck as far as I am concerned I am not finished....Again file a report with the New Hampshire Attorney General, have plenty of documentation that is the key... I DID!

I lost the chargeback!!

 I lost the chargeback - which was initiated for $3,000 which is over 65% of what the original price of the car was! It's amazing that these scumbags are able to get away with such a ridiculous claim. Paypal did not give me the option to dispute or defend myself against the chargeback. They did not show proof that they sent my evidence to the credit card company. Nor did they allow me to see the scumbag's documentation for me to dispute if it was legit or not. My guess is it was NOT truthful. I have contacted paypal and they will not disclose any information with me and will not allow me to deal with the credit card company as I would like to deal with them personally. They claim that they are the whom the chargeback was against, not me. Which I replied, well are YOU losing money or am I?!?! This is crazy!! What a horror story. They will not get a dime from me, they can send it to collections if they choose and I will take calls from the bill collectors until it gets charged off.

What did you do to be able to contact the credit company? Were you able to defend yourself? Did you get to see the documentation they used for the chargeback on their end? Was it all lies? Please help.

 

I am seeking a small claims suit right now but have to do it in their state I understand and they probably have their grubby hands all over the place. Ugh

100% refund

This is a response for Southern Boy. I recieved my money back 100% from Dusty Old Cars. It took a little over three months but we were patient and did not give in to this mans demands. Either tell him you will take the car back. HE IS responsible for any shipping costs to return your car to you. Or wait and be patient, let Pay Pal & the credit card company know that you will gladly take the car back if he wants his money back.  I was in constant communication with both Pay Pal and the credit card company. This is what we did stood firm and we won. He cannot keep the car and your money too. Do not make any deals with him. Let him know it is one way or the other. Please let me know how you make out.

The owner of this business should read what he prints....IE # 3 in his one rebuttle statement. That if the buyer is not happy with the vehicle and it is not as stated that the money is refunded 100# with the vehicle coming back to him.

If he returns the money to his buyer he expects the vehicle he sold returned. What makes him think that he is exempt from this practice when he purchases a vehicle that he is not happy with and the owner is willing to take the vehicle back and return his money.

Request return of your vehicle

Southern boy tell him to send the vehicle back, that you will gladly take it back, if he wishes his money back. He says it is on his bill of sale that they are intitled to a partial or full refund if the car is not up to HIS STANDARDS I don't know what bill of sale he is looking at but it is not on my copy. Like I said tell him to return the car and you will agree to the refund, see what he say's I doubt he will return your car he will balk at that suggestion. Also I don't know who everybody is that believes you are intitled to a partial or full refund or purchase price if you are not happy with the item and entitled to also keep the item. I know if it was in writing on my copy of bill of sale the item would not be sold to the person asking as such.

Return the item if you are not happy

If you are not happy with the car...RETURN IT! You cannot keep the car and the money too. The owner is willing to take the car back. You DO NOT want to pay return shipping. You stated this yourself. Obviously from other reports not only on this site this is a common practice of yours. You do not keep anything that you purchase especailly for this amount of money and get your money returned too. This is a scam and is illegal!

Charge back from dust old cars

Southern boy we are still awaiting decision from the credit card company. Either way pay pal told us if he keeps the car he has to return the money for vice versa. He cannot do both. If he gets the money and does not return the car Pay Pal said they will fight it. What is your outcome? How long ago did he do this to you? Did he do it through Pay Pal also? I would love to get a hold of you so we can fight this together. I really do not want to put my email out there for this POS to get. Keep us posted of your fight.

 I am in the same situation - EXACTLY THE SAME!!! I am going thru this RIGHT NOW - I am being threatened with a chargeback and this same man is telling me that the car is worth less than half of what he paid for it. This is ridiculous!! This guy is a straight p***k - and he is a millionaire on top of it. They chose to purchase the car, no one MADE them do anything nor did I FALSELY described the car. They know that there are cracks in the system and it is ridiculous for the tiny guys on the totem pole getting screwed more and more everyday. I told this piece of shat that he aint gettin NO MONEY from me he can cry to the credit card company all he wants and I will fight it to the end. I'm old school from the country boyyy you gotta be crazy.

Please let me know what happened!!!

That guy is clearly attempting to perpetrate a scam. Be sure to forward the link of his online ad to your credit card processor. Print out a copy of that ad [now] before he removes it.

The value of the car is not the issue. The issue is that he is either suffering from a case of buyer's remorse (not likely) or he is a scammer (highly likely).
